Admission of Business Records into Evidence: Using the Business Records Exception and Other Techniques

    Get PDF
This article discusses problems encountered by attorneys faced with complex civil litigation where much evidence is contained in business-related documents. The article discusses evidentiary problems that recur in a majority of business documents, such as opinions by persons who are unavailable or nonexperts that are contained in these documents, and multiple levels of hearsay within business documents. In addition, this article explores the alternative options available to counsel when attempts to use the business records exception fail

Assessing the impact of new rules of cost planning on BIM schema pertinent to quantity surveying practice

Not until recently, the establishment of a whole life cycle budget for a constructed facility largely depended on the initiative of using the standard method of measurements (SMM) structural approach to the development of a cost or budget plan. This method, argues the RICS (2009), “created inconsistency in measurement and descriptions, resulting in the production of unclear basis for the estimates”. The constraints associated with traditional cost planning and estimating tend to be compounded by the complexity associated with the deployment of building information model (BIM) technology that is pertinent to the achievement of whole life cycle cost management of a constructed facility. This research is aimed at exploring the impact of the new rules of measurement on the building information model schema pertinent to the quantity surveying practice on construction based projects. The research presumes that even though the new rules of measurement are not mandatory, they are likely to influence cost planning and estimating practice because they have been developed with a view to setting “the best practice” in the development of cost plans. The likely impact could subsequently affect the current building information model schema for cost management

Whale Watching as Ecotourism: How Sustainable is it?

    Get PDF
Australia has long tried to portray itself as an environmentally responsible state and has consistently been a strong supporter of Whale Watching as an alternative to the practice of commercial and ‘scientific’ whaling. This paper explores whale watching in an effort to determine the economic and social viability of it as a sustainable marine tourism activity —and whether in the future the whale and the tourist can coexist or will the latter as with previous human activities such as whaling yet again create a ‘tragedy of the commons’ and displace the former. As an ecotourism product, whale watching holds the potential for sustainable practice, one that is both ecological and profitable. Responsible whale watching is seen as a clean, green industry that simultaneously supports local economies and promotes whale education and conservation. The question is can it live up to these expectations

The English pronunciation teaching in Europe survey: selected results

    Get PDF
The results of EPTiES reveal interesting phenomena across Europe, despite shortcomings in terms of construction and distribution. For example, most respondents are non-native speakers of English and the majority of them rate their own mastery of English pronunciation favourably. However, most feel they had little or no training in how to teach pronunciation, which begs the question of how teachers are coping with this key aspect of language teaching. In relation to target models, RP remains the variety of English which teachers claim to use, whilst recognizing that General American might be preferred by some students. Differences between countries are explored, especially via replies to open-ended questions, allowing a more nuanced picture to emerge for each country. Other survey research is also referred to, in order to contextualise the analyses and implications for teaching English and for training English teacher

Confianza metacognitiva: una aproximación desde la neurociencia

This is an Accepted Manuscript of an article published by Taylor & Francis Group in [JOURNAL TITLE] on [date of publication], available online at:http://www.tandfonline.com/[Article DOI].Metacognition refers to thinking about our own thinking and implies a distinction between primary and secondary cognition. This article reviews how neuroscience has dealt with this distinction between first and second-order cognition, with special focus on meta-cognitive confidence. Meta-cognitive confidence is important because it affects whether people use their primary cognitions in guiding judgments and behaviors. The research described in this review is organized around the type of primary thoughts for which people have confidence, including judgments about memory, choices, and evaluative judgments. Along with other areas, prefrontal cortex and parietal regions have been consistently associated with judgments of meta-cognitive confidence in these three domains. Although metacognitive confidence might be associated with particular brain activity in most of the studies reviewed, confidence often seems to be confounded with other potentially important dimensions, such as effort and ease. Given that people tend to be less certain in tasks that are more difficult, more research is needed to examine the brain activity specifically linked to confidence.

Universidad Nacional Agraria La Molina. Tesi

The Gambian epauletted fruit bat, Epomophorus gambianus, is widely distributed across sub-Saharan Africa. Its assembled and annotated mitochondrial genome (GenBank accession no. KT963027) is 16,702 bases in length, containing 13 protein-coding genes, 22 transfer RNA genes, two ribosomal RNA genes and two non-coding regions: the control region (D-loop) and the origin of light-strand replication (OL). The average base composition is 32.2% A; 27.6% C; 14% G; and 26.1% T. The mitogenome presented a structural composition greatly conserved between members of the Pteropodidae family. This is the final version of the article.
