    From Navas to Kaltoft: The European Court of Justice’s evolving definition of disability and the implications for HIV-positive individuals

    This article will examine the definition of disability developed by the European Court of Justice for the purposes of the Employment Equality Directive and examine whether it is sufficient for the purpose of bringing People Living with HIV/AIDS within its scope. The article will argue that in order to adequately protect People Living with HIV/AIDS within the EU from discrimination, the European Court of Justice needs to ensure that a coherent EU wide definition of disability, based fully upon the social model of disability, is adopted. This is necessary in order to ensure adequate protection not only for People Living with HIV/AIDS but for all individuals with disabilities from discrimination throughout the EU. In addition to this central argument, this paper will argue that the lack of a coherent definition of disability grounded in the social model fragments protection for People Living with HIV/AIDS across the EU leading to a number of possible unintended consequences

    Following the diffusion of HRM as the dominant legitimating managerial ideology, some employers have started to see the built working environment as a component in managing organisational culture and employee commitment. A good example is where the work space is designed to support a range of officially encouraged ‘fun’ activities at work. Drawing on recent research literature and from media reports of contemporary developments, this paper explores the consequences of such developments for employees’ social identity formation and maintenance, with a particular focus on the office and customer service centre. Our analysis suggests that management’s attempts to determine what is deemed fun may not only be resented by workers because it intrudes on their existing private identities but also because it seeks to re-shape their values and expression

    The effects of spring stiffness on vortex-induced vibration for energy generation

    Vortex-induced vibration (VIV) is the turbulent motion induced on bluff body that generates alternating lift forces and results in irregular movement of the body. VIV-powered system seems a good idea in greening the energy sector and most importantly is its ability to take advantages of low current speed of water to generate electricity. This paper aims to investigate the effects of spring stiffness on the characteristic of VIV. The study is important in order to maximize these potentially destructive vibrations into a valuable resource of energy. Five cylinders with the range of 0.25 to 2.00 inch diameter are tested to study the behavior of VIV. Results from this experiment indicates that, the 2.0 inch cylinder gave the lowest error in frequency ratio which is 1.1% and have a high potential of lock-in condition to occur. In term of maximum amplitude, this cylinder gave the highest amplitude of oscillation motion that is equal to 0.0065 m

    Non-consensual sterilization of women living with HIV

    Women living with HIV are stigmatized and discriminated against. They often wish to have children, but they are subjected to the practice of forced (involuntary) sterilization in at least 27 countries under the guise of protecting maternal health and preventing the birth of infected infants. Some women are not asked to give consent, or a third party consents on their behalf. Others are given insufficient information or fed misinformation. The circumstances under which such women have been asked to sign consent forms for sterilization include fear, coercion, intimidation and undue influence. Courts have been clear that such practice is a breach of human rights. But, so far, it has not been formally declared in courts that such practice constitutes discrimination. More needs to be done in terms of education, sanctions against those who carry out this practice and help for victims

    The epistemological model of disability, and its role in understanding passive exclusion in eighteenth and nineteenth century protestant educational asylums

    This article examines how the process of constructing knowledge on impairment has affected the institutional construction of an ethic of disability. Its primary finding is that the process of creating knowledge in a number of historical contexts was influenced more by traditions and the biases of philosophers and educators in order to signify moral and intellectual superiority, than by a desire to improve the lives of disabled people through education. The article illustrates this epistemological process in a case study of the development of Protestant asylums in the latter years of the nineteenth century

    The architecture of a probation office: a reflection of policy and an impact on practice

    This article illustrates how the physicality of a probation office can be considered both integral to, and representative of, several important changes in the probation service’s recent history through analysis of research conducted in a probation office. I suggest that the relationship between the ‘protected’ zone of the office and the ‘unprotected’ zone of the waiting area and interview rooms is similar to Goffman’s ‘frontstage’ and ‘backstage’ and expand on his theory of social action by describing how the architecture of probation represents and potentially perpetuates the rise of risk, punishment and managerialism in probation. The article then moves onto the exterior and location of the office to look at how these represent probation’s move away from the communities it serves as well as inadvertently increasing the amount of punishment certain offenders receive. This has significant consequences if the policy of probation moves towards modes of practice which no longer prioritise standardisation and punishment over professional judgment and the importance of the offender-officer relationship and the article concludes by looking to some examples of more inclusive forms of office design and architecture
