Propiedad intelectual y jurisdicción contencioso-administrativa: La autorización de los juzgados centrales

En este trabajo se estudia el procedimiento de salvaguarda de los derechos de propiedad intelectual y, en concreto, un especial trámite que prevé la participación de la jurisdicción contencioso-administrativa en el mismo. Se trata de la autorización judicial de las resoluciones de la sección segunda de la Comisión de Propiedad Intelectual y de ciertas medidas accesorias a las sanciones por el incumplimiento reiterado de dichas resoluciones. Pretende darse cuenta del régimen jurídico de estas autorizaciones, dada la escasa atención que el legislador les presta. Para ello se toman como modelo el resto de autorizaciones que dicta la jurisdicción contencioso-administrativa –en especial la autorización de entrada– y lo que la jurisprudencia del Tribunal Constitucional y de los tribunales superiores de justicia ha ido estableciendo al respectoThis paper analyses the intellectual property rights protection administrative procedure and, in particular, a special phase of this procedure foreseeing the partaking of the administrative- contentious courts in it. El debate virtual: su interés como herramienta de enseñanza-aprendizaje en el EEES

El Espacio Europeo de Educación Superior exige que la docencia tradicional incorpore nuevas herramientas de enseñanza-aprendizaje para ajustarse al nuevo modelo educativo diseñado. El debate virtual es un instrumento de interés para cumplir dicho fin, puesto que, entre otros, permite al docente guiar y orientar parte del trabajo autónomo de los alumnos que ahora se incorpora al currículo de créditos ECTS. Las reflexiones contenidas en este artículo se basan en la experiencia docente del Área de Derecho Administrativo de la Universidad de Lleida.The European Space of Higher Education requires the traditional teaching methodologies to incorporate new teaching-learning strategies in order to adjust to the new educational model designed. The online discussion forums are an interesting instrument suitable to accomplish such an aim, since they allow the professor to guide and direct part of the autonomous work that now is taken into account in the curriculum based on the European Credit Transfer System. Individual rights vs public health in the fight against contagious diseases: proposals to improve the current legal framework

El mandato constitucional de tutela de la salud pública obliga a los poderes públicos a articular mecanis-mos para proteger a la población ante enfermedades contagiosas. La puesta en práctica de tal obligaciónexige un marco normativo que cumpla con la finalidad de protección de la salud colectiva de forma eficaz,pero que, a la vez, respete los derechos y libertades individuales de los sujetos que puedan verse afectadospor la actuación de las Administraciones públicas. En este artículo se analiza, desde la perspectiva jurídica,la normativa actual que regula la adopción de medidas sanitarias para proteger la salud pública frente aenfermedades contagiosas. Del análisis se deriva que dicho marco normativo genera inseguridad jurídicaal otorgar un amplio margen de discrecionalidad a favor de la Administración y regular mínimamentecualquier tipo de cautela. Todo ello se traduce en el debilitamiento de los mecanismos de garantía de losderechos y libertades de los ciudadanos, principalmente concentrados en la autorización o ratificaciónjudicial de las medidas. Ante ello, a modo de conclusión, se articulan distintas propuestas de reforma dela normativa para la mejora de la regulación estudiada con el fin de que, mediante un marco regulatorioque ofrezca mayor seguridad jurídica, sea posible garantizar la legalidad de la afectación de los derechosy libertades de la ciudadanía sin mermar la eficaz protección de la salud pública

Fur Activates the Expression of Salmonella enterica Pathogenicity Island 1 by Directly Interacting with the hilD Operator In Vivo and In Vitro

Previous studies have established that the expression of Salmonella enterica pathogenicity island 1 (SPI1), which is essential for epithelial invasion, is mainly regulated by the HilD protein. The ferric uptake regulator, Fur, in turn modulates the expression of the S. enterica hilD gene, albeit through an unknown mechanism. Here we report that S. enterica Fur, in its metal-bound form, specifically binds to an AT-rich region (BoxA), located upstream of the hilD promoter (PhilD), at position -191 to -163 relative to the hilD transcription start site. Furthermore, in a PhilD variant with mutations in BoxA, PhilD*, Fur·Mn2+ binding is impaired. In vivo experiments using S. enterica strains carrying wild-type PhilD or the mutant variant PhilD* showed that Fur activates hilD expression, while in vitro experiments revealed that the Fur·Mn2+ protein is sufficient to increase hilD transcription. Together, these results present the first evidence that Fur·Mn2+, by binding to the upstream BoxA sequence, directly stimulates the expression of hilD in S. enterica

Control by Fur of the nitrate respiration regulators NarP and NarL in Salmonella enterica

Anaerobic metabolism is controlled by several transcriptional regulators, including ArcA, Fnr, NarP, and NarL, with the Fnr and ArcA proteins sensitive to the cell’s redox status. Specifically, the two-component ArcAB system is activated in response to the oxidation state of membrane-bound quinones, which are the central electron carriers of respiration. Fnr, by contrast, directly senses cellular oxidation status through the [4Fe-4S] cluster present in its own structure. In this study, a third additional redox-associated pathway that controls the nitrate respiration regulators NarL and NarP was identified. The results showed that, in Salmonella enterica, the expression of these two transcriptional regulators is under the control of Fur, a metalloregulator that senses the presence of Fe2+ and regulates the homeostasis of this cation inside the cell. Thus, the Fur- Fe2+ complex increases the expression of narL and represses that of narP. Furthermore, studies of S. enteric mutants defective in the Fur-regulated sRNA RfrA and RfrB showed that those sRNA control both narP and narL expression. These results confirm Fur as a global regulator based on its involvement not only in iron uptake and detoxification but also in the control of nitrate/nitrite respiration by sensing cellular redox status.
