Forbidden Citizens: The Chinese Diaspora of Monterey Bay

The purpose of this essay is to educate California State University Monterey Bay students, the professors, and members of the Marina, Seaside, and Monterey community about the oppressive history that occurred in Pacific Grove towards the early Chinese who traveled to California. As far as research methods go, I read scholarly articles that included a history of the reoccurring conflicts between the Chinese fishermen and the business along Cannery Row, and books on what the Chinese endured while traveling to California. I attended events in the town of Pacific Grove that relate back to my topic, such as The Walk of Remembrance which is an event to bring awareness of the Chinese who have been present in the Monterey Bay area since before the 1850’s. I went to the Pacific Grove Museum of Natural History to educate myself from a historian’s point of view of the town, and I interviewed members of the community who are educated in the oppressive history of the area. The community members I interviewed have lived in the Monterey Bay area their whole life, and they have been involved with the community in educating about the oppression many of the early Chinese and Chinese American citizens faced

Índices de medición de mercado de trabajo, derechos humanos y trabajo temporario agrícola en la provincia de La Rioja

Dentro del marco de transformaciones estructurales de la economía nacional de las últimas décadas, este trabajo pretende realizar un aporte teórico sobre la transversalidad de los derechos humanos en los mecanismos de medición del mercado de trabajo temporario agrícola en Argentina. Dos de las perspectivas desde la que puede analizarse el trabajo agrícola son: desde el punto de vista económico, mercado de trabajo, o bien, desde el jurídico, y dentro del universo normativo, desde ámbito de los derechos humanos. Esta vinculación entre lo económico y lo jurídico, tiene por objeto integrar la dimensión de los derechos humanos a los índices de medición de trabajo agrícola estacional, a fin de visibilizar la vulnerabilidad social de los trabajadores. Desde el punto de vista económico, realizaremos un primer acercamiento al mercado de trabajo temporario agrícola en la provincia de la Rioja y la problemática de los indicadores utilizados en su medición. Consideraremos también, las características particulares que adquieren la precariedad y la informalidad laboral ponderando sus efectos sobre el nivel de vulnerabilidad social que producen. A partir del enfoque de derechos humanos nos concentraremos en los índices de medición de progresividad de los derechos económicos sociales y culturales. Finalmente, desarrollaremos este trabajo desde la perspectiva de que “Todo estudio de un mercado de trabajo resulta estratégico para comprender no solo las dinámicas de producción económica sino también de configuración social...y la construcción de igualdad como utopía democrática” (Isuani. To sow rights: reconfiguration of the argentine rural worker, as a subject of regional and universal right

Este artículo analiza la reforma del régimen de trabajo rural en Argentina, desde el debate teórico sobre la reconfiguración del trabajador, como sujeto de derecho universal, y la transformación del demos, frente a la normativa supraestatal generada por los procesos de integración regional y de globalización. El objetivo de este trabajo consiste en indagar sobre la incidencia de este proceso en el grado de incorporación de estándares internacionales de derechos humanos, en la normativa que regula el trabajo agrícola argentino. En el primer apartado se desarrolla el debate sobre las variaciones en el concepto de ciudadanía, a fin de repensar en qué medida incide en la reconfiguración jurídica del trabajador, de ciudadano nacional a sujeto de derecho regional y universal. En el segundo, se realiza un breve análisis de cierta normativa supranacional que manifiesta la internacionalización de los derechos de los trabajadores. Finalmente, se comentan los puntos estratégicos de la última reforma del régimen de trabajo rural argentino, procurando destacar los principales cambios producidos por esta legislación en materia de incorporación de Derechos Económicos, Sociales y Culturales. La metodología seleccionada para el desarrollo de esta propuesta consiste en el análisis teórico y normativo, sobre la transformación del demos y de las normas referidas al nuevo régimen de trabajo agrario argentino (Ley Nacional 26.727), a los derechos humanos de los trabajadores en MERCOSUR, como organismo de integración regional, y del PIDESC.This paper analyzes the reform of rural labor in Argentina, from the theoretical debate linked to the reconfiguration of the worker as a subject of universal rights and the transformation of demos, opposite the supranational rules generated by the processes of regional integration and globalization.The aim of this study is to analyze the impact of this process, rules and institutionally by the degree of incorporation of international human rights standards in the national legislation related to the new regime of Argentine agricultural work.The structure of this analysis contains three sections. In the first, the theoretical debate on the transformation of citizenship, caused by the tension between national legislation and international rights, to rethink the extent influences the transformation of the legal status of the worker, the subject develops subject to national law to regional and universal right. The second will make a brief analysis of some supranational law which manifests the internationalization of the rights of workers. Finally, we discuss the strategic points of the last reform of the Argentine rural work, trying to analyze the main changes. The selected for the development of this proposed methodology consists of theoretical analysis of the transformation of demos and regulations for the new regime of Argentine farm work (National Law 26,727), which will be supplemented by referring to bodies of Latin American regional integration and International Treaties on Human Rights, specifically on Economic, Social and Cultural Rights (ESCR).Fil: Sanchez Enrique, Daniela Veronica. Temporary rural work and legal fragmentation in Argentina

Este artículo realiza una revisión del marco legal en materia detrabajo rural temporario en Argentina, cuya fragmentación genera lasegmentación del diseño institucional en materia sindical y de organismos decontrol, que pervive aún luego de la última reforma del régimen de trabajoagrícola argentino, Ley 26.727 /11. Existen trabajadoresexcluidos de esta ley, a quienes se les aplican Convenios Colectivos de Trabajo(CCT) especiales, como en el caso de la cosecha de uva (85/89 y 154/91) y defruta CCT 1/76 o CCT 271/96 y cuya norma subsidiaria es la Ley 20.744, Ley deContrato de Trabajo (LCT). Por tanto, existen disposiciones contradictoriassobre un mismo fenómeno como el de las empresas de colocación de mano de obra, queestán permitidas en ciertos ámbitos del trabajo agrícola mientras que en otros,debido a ciertos tipos de cosecha a los que no se les aplica el régimen detrabajo agrícola de la Ley 26.727, están prohibidos. Este nivel defragmentación normativa afecta al trabajo temporario rural por sus característicasde estacionalidad, temporalidad y movilidad, ya que a un mismo trabajadorpueden aplicársele distintos regímenes laborales a lo largo del año,dependiendo del tipo de cosecha que realice. La estructura de este trabajo se dividiráen dos apartados, en primer lugar se analizará la situación de fragmentaciónjurídica, sindical y de inspección del sector de empleo rural temporario. Ensegundo lugar, se desarrollará lo relativo a la incidencia de estafragmentación en el caso de las cooperativas de trabajo, la intermediaciónlaboral y las empresas de colocación de mano de obra rural, comomanifestaciones de tercerización laboral en el ámbito rural.This article aims to analyze the legal fragmentation in the temporary rural work in Argentina, and the institutional consequences, and control agencies working conditions, from the perspective of its impact on the Economic, Social and Cultural Rights of workers from the last reform of Argentine agricultural work Law 26.727/11. This issue is relevant for existing workers excluded of the agricultural labor regime, who are subject to special collective labor agreements (CCT), as in the case of the grape harvest (85/89 and 154/91) and fruit or CCT CCT 1/76 271/96 and Law 20.744, whose subsidiary rule is the Labor Contract Law (LCT). In this context of legal fragmentation, there are cases of conflicting provisions on the same phenomenon, which are allowed in certain areas of agricultural labor in others, because certain types of crop to who does not apply the system of agricultural work of the Law 26,727, they are prohibited. This level of regulatory fragmentation justifies an analysis of its impact on the sector of temporary work to consider the characteristics of seasonality, seasonality and mobility that characterizes the agricultural employment, the same worker may disqualifies different labor standards throughout the year, depending on the type of crop. The structure of this work is divided into two sections, first the situation of legal, union fragmentation and inspection of temporary rural employment sector and second, what will be developed on the incidence of fragmentation in the case of cooperatives, labor intermediation and placement firms rural labor, as manifestations of labor outsourcing in rural areas.Fil: Sanchez Enrique, Daniela Veronica. A comparison of a first and third year UG enterprise unit: lessons from experiential learning and interdisciplinarity

[EN] Drawing from several years of experience, this work describes lessons learnt in designing, delivering and assessing two interdisciplinary enterprise units offered undergraduate students from any discipline studing at the University of Manchester (UK). Both units are electives (optional). One unit is delivered to first year undergrdaute students whereas the other unit is delivered to third/fourth year undergraduate students. Experiential learning and interdisciplinary cohorts are core aspects of both units. Students work on ‘real-world’ projects to develop a credible and competitive solution within a tight dead-line. In this paper, findings are drawn from data collected from staff and teaching assistants observations, students’ reflective diaries and students’ feedback. Findings showed that in general, students at both levels, year 1 and year 3/4, regarded the experience challenging at first due to the ‘unusual’ learning environment when compared to the education that most students have experienced prior to the units here discussed. However, most students highly regarded the interdisciplinary experiential learning experience. The paper contributes to the growth of knowledge and aids understanding of how experiential learning and interdisciplinarity have been effectively combined and introduced in the university curriculum. Although this works focused on enterprise education the experience-based guidance here described is also applicable to a much wider range of situations and academic areas of study.
