Strategian jalkauttaminen Kaakkois-Suomen poliisilaitoksella

Tutkimuksen tekijä sai pohdittavaksi Kaakkois-Suomen poliisilaitoksen päälliköltä, kuinka vastata Poliisihallituksen ja poliisilaitoksien väliseen tulossopimukseen huomioimalla poliisilaitoskohtaisia erityispiirteitä. Tutkimusongelma oli se, ettei tieto välity ruohonjuuritasolta poliisilaitoksilta Poliisihallitukselle. Myös strategian jalkauttamisessa on haasteita. Tiedon pitäisi välittyä tasaisen jatkuvana virtana molempiin suuntiin. Tutkimus pyrkii löytämään keinoja tämän tiedon keräämisen, jalostamisen ja välittämisen parantamiseksi, sekä myös strategian jalkauttamiseksi. Tässä samassa tiedon virrassa syntyisi uusia työtapoja ja organisaatiokulttuuri kehittyisi myönteisesti, koska strategian jalkauttaminen olisi tehokkaampaa. Teoriaosuus rakentui aiheesta löytyneeseen kirjallisuuteen. Empiirinen osuus käynnistyi henkilöhaastatteluilla ja kulminoitui kvalitatiivisella tutkimusmenetelmällä tehtyyn videoituun otantaan. Tässä haettiin focus group –keskustelun kautta syvällistä tietoa aiheesta ja mahdollisuuksista parantaa sitä. Haastattelujen ja ryhmäkeskustelun perusteella kävi ilmi, että Kaakkois-Suomen poliisilaitoksen henkilöstöllä oli selkeä tarve saada strategista ohjausta ja kehittää organisaation sisäistä viestintää. Tutkimuksessa esitettiin myös jatkotoimenpiteet ja implementointisuunnitelma vuonna 2011 tehtyyn tutkimukseen, jossa tämän tutkimuksen tekijä selvitti tiedonkulkua Kymenlaakson poliisilaitoksella. Tältä osin saatiin luotua selkeä kaksisuuntainen prosessi, jossa strateginen ohjaus kulkee vertikaalisessa prosessissa tuottaen reaaliaikaista tietoa laitoksen johdolle, Poliisihallitukselle sekä sisäasiainministeriölle. Toinen tärkeä työssä syntynyt saavutus oli henkilöstön työhyvinvoinnin parantaminen osallistamismahdollisuuksia synnyttämällä sekä strategista viestintää selkeyttämällä.The author of this thesis got the assignment from the chief of Southeastern Finland Police Department. The assignment included the task to investigate how to respond to the performance agreement between the National Police Board and the police departments so that the special features of an individual police department could be taken into account. The research problem was that information does not transfer from grass roots of the local police stations to the National Police Board. There are also challenges concerning strategy implementation. Information should be flowing continuously in both directions. The target of this research was to find out ways to enhance the collecting, refining and transferring of information and also to implement the strategy. This information flow could also help to find out new working methods and to create positive organizational culture owing to more effective strategy implementation. The theory part was built on literature on the subject matter. The empirical part started with interviews among the staff and culminated in a videotaped sampling using qualitative research method. Focus group discussions were used to gain deeper and more processed information on the topic. Interview and group discussion results showed that the staff of the Southeastern Finland Police Department had a clear need for strategic guidance and for improvement of internal communication. The research also includes a proposal for follow-up actions and an implementation plan for the research results made in 2011 concerning communication flows in Kymenlaakso Police Department. That research showed a clear two-way process where strategic guidance is a vertical process producing real-time information to the management of the Police Department, to the National Police Board and to the Ministry of the Interior. Another important achievement of the research was the improvement of work welfare through creating possibilities to participate and clarifying strategic communication

Finland: European Integration and International Human Rights Treaties as Sources of Domestic Constitutional Change and Dynamism

The Constitution Act of 1919 was replaced in 2000 by a new Constitution, which was amended in 2012. While the institution of exceptive enactments, which enables the adoption of laws that are in conflict with the Constitution, had earlier assumed a key role in constitutional adjustment for EU integration, the 2012 amendments expressed a constitutional commitment to EU membership and provided for the transfer of powers to the EU. As a result, exceptive enactments are no longer needed for such transfer. Instead of a constitutional court, a key role in constitutional review is played by the Constitutional Law Committee of Parliament through ex ante review of legislative proposals or other matters pending before Parliament, including proposals for EU legislation, for their compatibility with the Constitution and Finland’s international human rights obligations. From the late 1980s onwards, the constitutional tendency has increasingly been towards rights-based judicial review. Aside from the ECHR and other human rights treaties, EU membership has greatly contributed to both judicial empowerment and enhanced rights protection. Areas where EU law has presented constitutional challenges include: (a) the European Arrest Warrant, with regard to which Finland introduced constitutional and legislative safeguards for the sake of fundamental rights; (b) the Laval and Viking Line stream of case law; and (c) concerns around preserving ‘the quality of law’ when implementing EU law. In result of the ex ante constitutional review of the draft ESM Treaty, a change in the draft treaty stemming from constitutional concerns about increased financial liabilities without parliamentary control was proposed and achieved.Peer reviewe
