    The Relevance of Statistics to Prove Discrimination: A Typology

    Substantial confusion exists among lawyers, litigants and the courts about how to identify and prove discrimination. The difficulty is primarily a result of the absence of a definition of discrimination in the federal civil rights statutes, and uncertainty as to what social policies the anti-discrimination statutes seek to accommodate. This Article provides an approach for identifying and proving discrimination through the use of statistical evidence. The Article begins by classifying discrimination cases into five basic types, based on the nature of the harm involved in each type of case. The Article then describes the potential uses of statistical evidence by each type of plaintiff and analyzes the probative value of statistical evidence in proving the various types of discrimination. The Article then concludes with the argument that statistics are of great practical value as evidence of discrimination

    The increasing proportion of women among the body of UK veterinary surgeons practicing clinical medicine has been consistently highlighted in RCVS surveys (RCVS 2006, 2010, 2014a). Despite women outnumbering men in clinical practice (57% v 43%) in 2014 (RCVS, 2014a) they do not own veterinary practices or hold practice partnerships or leadership positions in proportions that may be expected, even when adjusting for age and experience (RCVS, 2014b)

    Gender Sorting at the Application Interface

    We document gender sorting of candidates into gender-typed jobs at the point of initial application to a company. At this step of the hiring process, the firm has implemented a policy whereby organizational screeners’ discretion has been eliminated such that there is no opportunity for contact between hiring agents and applicants. Thus, the job choices studied here offer unique insight as they are uncontaminated by screeners’ steering of candidates toward gender-typed jobs. Even in the absence of steering, we find clear patterns of gendered job choices that line up with gender stereotypes of job roles. Moreover, these gendered patterns recur both within individuals and within race groups. Comparing our findings to the pattern of job sorting in the external local labor market, we find that supply-side factors do not fully account for the levels job sex segregation observed in the open labor market. Although probably not the entire story, we show clear evidence that supply-side sorting processes are important factors contributing to job sex segregation
