Fundamentos jurídicos para la inclusión del matrimonio igualitario en el Código Civil Peruano

Las parejas del mismo sexo en el Perú no pueden contraer matrimonio porque la ley no se los permite. En este trabajo de investigación presentamos los fundamentos jurídicos por los cuales debería modificarse el Código Civil a fin de incorporar en la norma el denominado matrimonio igualitario u homosexual. Eso de acuerdo a las conclusiones que hemos arribado en base a entrevistas realizadas a juristas peruanos y congresistas que presentaron en el Parlamento los proyectos de unión civil y matrimonio igualitario; al derecho comparado de siete países de la región, y a la revisión documental doctrinal. Asimismo tomando en cuenta la jurisprudencia nacional, a través de acciones de amparo; y la jurisprudencia de la Corte Interamericana de Derechos Humanos (CorteIDH), específicamente la Opinión Consultiva OC -24/17, que fue tomada en cuenta por cortes de Ecuador y Costa Rica para aprobar el matrimonio entre personas del mismo sexo. Los derechos que se trasgreden a este grupo históricamente discriminado, son los derechos a la igualdad y no discriminación, derechos patrimoniales como a bienes y herencia; y derechos sociales como los de compartir seguridad social hasta cuestiones básicas como es la toma de decisiones médicas de la pareja en estado de grave, solo por citar algunos ejemplos.The couples of the same sex in Peru can not get married because of the law that Does not allow them to do so. Funcionamiento del grupo de voluntarios del Albergue Ángel Guardián Canino y Felino del municipio de La Ceja. Una lectura a partir de la teoría de los movimientos sociales

RESUMEN: Esta investigación se plantea desde las teorías de los movimientos sociales, desde una perspectiva psicosocial mostrando la influencia de las acciones individuales en el funcionamiento del grupo, la misma se realiza mediante una etnografía por medio de una inmersión completa en todas las dinámicas del grupo de voluntarios del Albergue Ángel Guardián canino y felino del municipio de La Ceja. Se presenta la sistematización y el registro de las actividades realizadas por el grupo de voluntarios del albergue Ángel Guardián canino y felino del municipio de La Ceja, así mismo se ilustra la concepción de movimiento social desde diferentes autores y teorías, pretendiendo ubicar al grupo ya mencionado en contraste con dichos conceptos. De igual forma destaca los intercambios, costumbres, roles, labores, acciones, historia y entorno, del grupo de voluntarios del albergue Ángel Guardián canino y felino del municipio de La Ceja y los ubica dentro del paradigma social y psicológico, resaltando la importancia y el impacto del grupo en mención con respecto a los jóvenes del municipio, a las nuevas alternativas para la población, y con la adopción de nuevas ideologías encaminadas al respeto hacia los derechos de los animales.ABSTRACT: This research is stated since the theories of social movements, taking a psychosocial perspective showing the influence of individual behavior inside the social group. This study follows the ethnographic principles, based on a total immersion among the dynamics of the group “voluntarios del Albergue Ángel Guardián Canino y Felino” from La Ceja, Antioquia. The activities carried out by the social group “voluntarios del Albergue Ángel Guardián Canino y Felino” are systematized and registered to illustrate the concept of social movement since several authors and theories, aiming to place the group mentioned above in contrast with the theory. Besides, this research highlights the relationships, practices, roles, responsibilities, actions, history and context which belong to the group “ Voluntarios del Albergue Ángel Guardián Canino y Felino” Moreover, the social group is placed in the social and psychological paradigms, Taking into account the importance and impact of the social group above the young people from La Ceja, Antioquia, and the emerging alternatives to the population, thus, the adoption of new ideologies addressed to the respect of animals’ rights

La discriminación política frente a la unión civil o matrimonial de personas del mismo sexo

Este trabajo de tesis tuvo como finalidad determinar si existe discriminación del Estado contra las parejas homosexuales al no legislar y dar una ley de Unión Civil o de Matrimonio que permita no se vulneren sus derechos humanos fundamentales a formar una familia. Se usó como técnica el enfoque cualitativo. Se consideró la técnica de la entrevista abierta con cuestionario, a abogados expertos en derecho civil y de familia, derecho comparado y constitucional, todos conocedores e involucrados en este tema, además a tres ex congresistas autores de dos proyectos de ley de Unión Civil y uno de Matrimonio Igualitario, que se presentaron en el Congreso entre el 2013 y 2017. También se hizo una investigación de autores que han tratado el tema para la base teórica; y el análisis e interpretación del derecho comparado de ocho países de la región donde se dan estas dos figuras jurídicas, y la jurisprudencia de la Corte Interamericana de Derechos Humanos (CorteIDH), específicamente la Opinión Consultiva OC-24/17, que es la más reciente en reconocer los derechos de las parejas del mismo sexo. Al terminar esta investigación, se concluyó que siendo una realidad estas familias en la sociedad, no tienen un sustento legal que les ampare en sus derechos a la igualdad y no discriminación, derechos sociales y patrimoniales, como si tienen las parejas heterosexuales, y que es necesario darles una protección jurídica normativa

ANALIZA HRVATSKOG TRŽIŠTA CRAFT PIVA NA PRIMJERU MIKRO PIVOVARE

U zadnjih pet godina po uzoru na sličan pokret nastao u Sjedinjenim Američkim Državama, pojavljuje se novi segment u hrvatskoj pivskoj industriji - craft pivovare, male nezavisne pivovare s autorskim potpisom, malom količinom proizvodnje, u privatnom vlasništvu i koje proizvode karakteristične pivske stilove. Hrvatska pivska industrija je najvećim dijelom tržišta pod kontrolom tri velike pivovare u vlasništvu stranih korporacija, a pivski stil na koji se fokusiraju je lager. Kao reakcija tome, 2013. godine iz rastućeg homebrewing pokreta nastaju prve craft pivovare. Danas u Hrvatskoj postoji preko sedamdeset craft pivovara, a Zakon o trošarinama predviđa za njih i srodne pivovare kategoriju male nezavisne pivovare s posebnim oporezivanjem. Proizvodi craft pivovara dostupni su u većini maloprodajnih lanaca, a rast njihovog udjela na tržištu utjecao je i na industrijske pivovare - dva od tri tržišna lidera izašla su s proizvodima i brandovima koji imitiraju craft, s time da je Zagrebačka pivovara, tržišni lider u industrijskom pivarstvu uspješno infiltrirao craft tržište sa svojim brandom Grif te time kompletirao portfolio i otežao širenje craft proizvoda u nove ugostiteljske objekte. Industrijski segment craft pivarstva analiziran je kroz primjenu Porterovog modela pet konkurentskih sila te on-line istraživanje. Prema Porterovom modelu izveden je zaključak da je craft pivarstvo srednje atraktivna industrija s obzirom na konkurentske sile te da je njegova atraktivnost, odnosno dugoročni profitni potencijal manji u odnosu na mainstream pivarstvo, iako je je u rastu i iako je ulazak u industrijski segment craft piva puno lakši (zbog manjih ulaznih barijera). Istraživanje je provedeno na 1127 ispitanika te je, iako vođeno na nereferentnom uzorku, potvrdilo dvije teze: da Zmajska pivovara drži top-of-mind poziciju kod hrvatskih potrošača craft piva te da je marketinška komunikacija ključna u formiranju sposobnosti potrošača da uspješno identificira autentična craft piva od industrijskih supstituta u užem stilu. Studija slučaja analizira Zmajsku pivovaru koja je prepoznata kao tržišni lider i za koju je istraživanje pokazalo da drži top-of-mind poziciju kod potrošača. Zmajska je osnovana 2013.g., prva je hrvatska craft pivovara s 12 zaposlenih, vlastitim pogonom, punionicom i ugostiteljskim objektom u kojem prezentira svoje proizvode. Analiza njihove marketinške komunikacije pokazala je opravdani fokus na digitalne kanale, a kao preporučeni komunikacijski ciljevi prepoznati su edukacija potrošača o craft pivarstvu te učvršćivanje pozicije Zmajske pivovare kao tržišnog lidera iz perspektive potrošača. Preporučene metode realizacije tih ciljeva su razvoj video i tekstualnog sadržaja, ulaganje u PPC oglašavanje te fokus na sponzorstva i kolaboracije s predstavnicima nezavisnih scena drugih kategorija.In the last five years, based on a model of a similar movement in the United States of America, a new segment emerges in the Croatian beer industry – craft breweries, privately-owned small independent breweries with small-scale production which produce characteristic beer styles with the maker’s signature. The Croatian beer industry is mostly dominated by three big breweries owned by foreign corporations, and the beer style they are focusing on is lager. As a reaction to that, in year 2013 first craft breweries emerged from the growing homebrewing movement. Today, there are over seventy craft breweries in Croatia, and the Excise Law has a specific “small independent brewery” category for them and similar breweries with special taxation. Craft brewery products are available in most retail chains, and their market share has also affected industrial breweries - two out of three market leaders emerged with products and brands that imitate craft, with the Zagreb brewery, the market leader in industrial brewing successfully infiltrating the craft market with its brand “Grif”, thus completing the portfolio and making it difficult for craft products to expand to new catering facilities. The industrial segment of craft brewery was analyzed through the application of the Porter model of five competitive forces and on-line research. According to the Porter model, it was concluded that the craft industry is a medium-attractive industry with regard to competitive forces and that its attractiveness or long-term profit potential is smaller compared to mainstream brewery, although it is growing and although the entry into the industrial segment of the craft is much easier (due to smaller input barriers). The survey was conducted on 1127 respondents, and although it was conducted on a non-referential sample, it confirmed two theses: that the Dragon Brewery holds a top-of-mind position with Croatian craft beer traders and that marketing communication is key in shaping the consumer's ability to successfully identify authentic craft beer of the suburban industrial substituents. The Case Study analyzes the Zmajska brewery, which has been recognized as a market leader and for which research has shown to hold a top-of-mind position with consumers. Zmajska was founded in 2013, the first Croatian craftsman with 12 employees, own drive, briquette and catering facility where he presents his products. The analysis of their marketing communications has shown a justified focus on digital channels, and as the recommended communication goals, consumer education on craft brewery is recognized and the position of Zimnica brewery as a market leader from a consumer perspective. Recommended methods of realizing these goals are the development of video and text content, PPC advertising, and the focus on sponsorship and collaboration with representatives of independent scenes of other categories

En este trabajo se presenta la cartografía geológica y estructural de la porción Este del Distrito Minero Segovia - Remedios, con eje sobre el río Bagrecito y las fallas Nus y Bagre, aplicada a la exploración de yacimientos minerales auríferos, en una zona de 120 Km2. En especial se caracterizan y se describen petrográficamente las unidades metamórficas, intrusivas, volcánicas y sedimentarias aflorantes en la zona; adicionalmente se registran los patrones estructurales predominantes de fallas, estratificación, foliación, vetas y fracturas, así como la definición de las relaciones entre estas y la asociación - relación con los yacimientos minerales

Integrated analysis of gene expression by association rules discovery

BACKGROUND: Microarray technology is generating huge amounts of data about the expression level of thousands of genes, or even whole genomes, across different experimental conditions. To extract biological knowledge, and to fully understand such datasets, it is essential to include external biological information about genes and gene products to the analysis of expression data. However, most of the current approaches to analyze microarray datasets are mainly focused on the analysis of experimental data, and external biological information is incorporated as a posterior process. RESULTS: In this study we present a method for the integrative analysis of microarray data based on the Association Rules Discovery data mining technique. The approach integrates gene annotations and expression data to discover intrinsic associations among both data sources based on co-occurrence patterns. We applied the proposed methodology to the analysis of gene expression datasets in which genes were annotated with metabolic pathways, transcriptional regulators and Gene Ontology categories. Automatically extracted associations revealed significant relationships among these gene attributes and expression patterns, where many of them are clearly supported by recently reported work. CONCLUSION: The integration of external biological information and gene expression data can provide insights about the biological processes associated to gene expression programs. In this paper we show that the proposed methodology is able to integrate multiple gene annotations and expression data in the same analytic framework and extract meaningful associations among heterogeneous sources of data. An implementation of the method is included in the Engene software package

Tiktok: Como herramienta de innovación en la comunicación política ecuatoriana

En la historia de la comunicación han existido varias ramas de estudio que han enfocado sus esfuerzos en expandir el objeto de estudio de tan hermosa ciencia, partiendo por los antiguos teóricos de Grecia y Roma, donde se empleaba la retórica para convencer al pueblo, hasta los fenómenos de las redes sociales y la hipermedialidad de hoy en día; la comunicación ha atravesado innumerables cambios a través del tiempo y ha evolucionado hasta convertirse en un objeto de análisis complejo, un ente vivo, polisémico y repleto de intriga y misterio. Este trabajo centra sus esfuerzos en torno a dos grandes ideas que son la comunicación política y las redes sociales emergentes, estos tópicos qué se combinan en una idea más revolucionaria y seductora, cómo lo es el tratamiento de la comunicación política ecuatoriana en la red social TikTok. Y es que la política en la sociedad ecuatoriana es a veces vista con desdén, como un discurso barato de líderes que no cambiarán la realidad del pueblo, sino la de sus propias vidas; pero hay que recordar que los tiempos han cambiado, qué la gente tiene acceso al conocimiento a través de la internet, en donde las redes sociales se han convertido en un nuevo escenario para el ejercicio de la política y la comunicación.Los invito a leer y adentrarse en este trabajo académico, qué pretende averiguar acerca de dos fenómenos que sucedieron en el período de febrero a abril año 2021 y que como consecuencia dieron la victoria del actual presidente de la república Guillermo Lasso, es así que sin más dilación, se averiguará sí TikTok es una herramienta de innovación en la comunicación política ecuatoriana.In the history of communication there have been several branches of study that have focused their efforts on broadening the object of study of such a beautiful science, starting from the ancient theorists of Greece and Rome, where rhetoric was used to convince people, to the phenomena of social networks and today's hypermediality; communication has undergone countless changes over time, evolving into an object of complex analysis, a living, polysemic entity full of intrigue and mystery. This work focuses on two main ideas: political communication and the emergence of social networks. These themes are combined in a more revolutionary and seductive idea, which is the treatment of Ecuadorian political communication in the social network TikTok. Politics in Ecuadorian society is sometimes viewed with contempt, as a cheap discourse of leaders who do not want to change the reality of the people, but their own lives; but we must remember that times have changed, that people have access to knowledge through the Internet, where social networks have become a new scenario for the exercise of politics and communication. Del fracaso al éxito escolar : una mirada transformadora desde la intervención con los docentes de los grados quinto y sexto de la institución educativa San Juan Bosco en la ciudad de Medellín

RESUMEN: Del fracaso al éxito escolar: una mirada transformadora desde la intervención con los docentes de los grados quinto y sexto de la Institución Educativa San Juan Bosco en la ciudad de Medellín, es producto de la reflexión a la labor como docentes, de la inquietud por trascender en el quehacer pedagógico, pasar de la sola instrucción a la formación de seres humanos conscientes de sus limitantes, además de sus habilidades para impactar su propio entorno de manera positiva. Por tal razón, se propone analizar cómo se incide en el rendimiento académico de las estudiantes del grado sexto desde la implementación de la estrategia pedagógica “Transformando nuestras prácticas” con los docentes, buscando la planeación de la enseñanza desde la secuencia didáctica para redundar en procesos de aprendizaje significativos y por ende el éxito escolar. Lo anterior, desde la investigación acción educativa con la participación activa y directa en el proceso y el paradigma social crítico para la acción reflexión. Además, su sistematización como seguimiento a la apropiación de la estrategia y el análisis de las actas del comité de evaluación y promoción de tal manera que permita revisar los resultados de éxito y/o fracaso escolar desde el año 2011 hasta el año 2020, dicho por Mejía (2012) “que a través de la reflexión y del seguimiento sobre la práctica se genere un producto distinto a la práctica misma y a lo que se había planeado” (p.17).ABSTRACT: From Failure to School Success: A transformative look from the intervention with the teachers from the fifth and sixth grades of the San Juan Bosco Educational Institution in the city of Medellín, this workshop is the result of our reflection as elementary and high school teachers, of the concern for transcend in the pedagogical task, moving from the single instruction to the formation of human beings aware of their limitations, as well as their ability to impact their own environment in a positive way. Consideraciones petrográficas, geoquímicas y geocronológícas de la parte occidental del batolito de santa marta

En este trabajo se presentan los resultados del análisis químico de elementos mayores y trazas para muestras tomadas en la margen occidental del Batolito de Santa Marta. También se describe petrográficamente el batolito, incluyendo sus facies félsicas, máficas y diques pegmatíticos asociados. Con los resultados de estos análisis químicos, llevados a aracno-gramas y de discriminación tectonomagmática propuestos por Pearce et al. (1984) y Pearce (1996), sumado a las relaciones de campo encontradas, se propone un Arco Magmático para el ambiente de formación del batolito. Una edad U-Pb convencional de 51.57 ï½± 1.3 Ma confirma la presencia del magmatismo paleógeno en esta zona

Terrenos, complejos y provincias en la cordillera central de Colombia

The Central Cordillera of Colombia consists of several tectonostratigraphic terrains that have not been fully recognized yet. To the east of San Jerónimo Fault are found the Chibcha, Tahamí, Panzenú (Puquí) and Anacona (Caldas) terrains with continental basement, and between the Romeral and the Cauca fault systems the Quebradagrande, Amagá-Sinifaná, Heliconia and Arquía terranes, mostly oceanic, are found. The Chibcha terrain is formed by a Grenvillian basement covered by Lower Paleozoic sediments that suffered a slight metamorphism, while in the Tahamí the metamorphism is Late Permian to Triassic, indicating that it was formed within the collision zone of Pangea but rather in the Paleopacific margin of Pangea as part of the Terra Australis Orogen. The metamorphism in the Panzenú Terrain is somewhat older, Carboniferous. The Anacona Terrain presents Devonian metamorphism and was not affected by the Triassic metamorphism that affected the Tahamí, indicating that it had not been amalgamated yet during the Triassic orogeny. A number of narrow belts of allochtonous rocks were accreted after Mid-Cretaceous times to the Tahamí Terrane which are from east to west: the Quebradagrande Complex, the Sinifaná low-grade metasedimentary rocks and the Amagá Granite (Amagá-Sinifaná Terrane), the ophiolitic rocks of Heliconia and the Arquía Complex. All of them are located between the systems of faults Cauca and Romeral.La Cordillera Central de Colombia está compuesta por varios terrenos tectonoestratigráficos que no han sido aún bien reconocidos. Al este de la Falla San Jerónimo se encuentran terrenos continentales como los terrenos Chibcha, Tahamí, Panzenú (Puquí) y Anacona (Caldas), mientras que entre los sistemas de Falla de Romeral y de Cauca se encuentran los terrenos Quebradagrande, Amagá-Sinifaná, Heliconia y Arquía, predominantemente de carácter oceánico. El terreno Chibcha incluye un basamento grenvilliano con sedimentos del Paleozoico Inferior, que sufrieron un leve metamorfismo, mientras que el metamorfismo del terreno Tahamí parece ser Pérmico muy tardío a Triásico, evidenciando que se formó en la margen paleopacífica de Pangea, como parte del orógeno de Terra Australis, más bien que en la zona de colisión continental.  El terreno Panzenú sufrió un metamorfismo Carbonífero, anterior al del Tahamí. El terreno Anacona presenta edades de metamorfismo Devónicas y no fue afectado por el metamorfismo Triásico, indicando que aún no se había amalgamado al terreno Tahamí durante la orogenia Triásica. Un conjunto de delgadas franjas alóctonas parece haberse amalgamado después del Cretáceo Medio al Tahamí, y está constituido de oriente a occidente por las rocas del Complejo Quebradagrande, las Metasedimentitas de Sinifaná y el Stock de Amagá (terreno Amagá- Sinifaná), las rocas ofiolíticas de Heliconia y las rocas metamórficas del Complejo Arquía. Todas ellas se encuentran localizadas entre los sistemas de fallas Cauca y Romeral
