The haitian constitutions: why an untold story about popular constitutionalism and fundamental rights? / As constituições haitianas: por que uma história não contada sobre constitucionalismo popular e direitos fundamentais?

This paper discusses the outstanding process of political effervescence seen in Haiti during the nineteenth century, after the revolution of slaves in the French colony by a bloody fight for emancipation, delivering to its illiterate people written constitutions in the period between 1801 and 1816 and, supposedly, the freedom by the way of a Constituent Assembly. Those documents astonishes as they are riches on fundamental (and even social) rights and guarantees, much more forcefully than later seen in the Americas or even in Europe. Important scholars gave fair attention for that on history and social studies, but the same doesn't occur in Law, and even less in constitutional law. The main argument of this article is that the suppression of the insurgency also perpetuates it with the subsequent constitutional silent about the episode and that this silence remains, unjustifiably, nowadays between the constitutional scholars studying popular constitutionalism and fundamental rights.ResumoEste artigo discute o impressionante processo de efervescência política visto no Haiti durante o século XIX, após a revolução dos escravos da colônia francesa por meio de sangrenta luta pela emancipação, entregando aos seus analfabetos constituições escritas no período entre 1801 e 1816 e, supostamente, a liberdade pelo caminho de uma Assembléia Constituinte. Esses documentos surpreendem, já que retratam diversos direitos e garantias fundamentais (e mesmo sociais), com muito mais intensidade do que visto mais tarde nas Américas ou até mesmo na Europa. Estudiosos importantes deram a devida atenção para que nas disciplinas de história e ciências sociais o tema fosse destacado, mas o mesmo não ocorre no Direito, e menos ainda no direito constitucional. Questioning our faith in the judiciary: from institutional entrenchment to the monopoly of constitution

This paper intends to question the role of the Brazilian Supreme Federal Court as an agent of democratic construction and its role as guardian of the constitution. The interest in the Supreme Court is due to the political arrangement and the overlapping of powers and functions of the court than the other powers. A Constitutional Court with inflated powers can lead to democratic dysfunction and judicial hegemony about institutions. Notably, an expansion of the Brazilian Supreme Federal Court’s powers should create a way for it to interpret the Constitution and its influence on the political process. There is no doubt that the Brazilian Supreme Federal Court has become an important political actor, making it present in almost all legal and political areas. However, constitutional monopoly, judicial activism, and excessive interference in the political process degenerate the original democratic model, deconstructing the excess of faith deposited in the judiciary. 

Clima Organizacional: Um Estudo em uma Instituição de Ensino Superior

Este estudo teve por objetivo identificar o clima organizacional do Centro de Ciências Sociais Aplicadas – CCSA, da Universidade Regional de Blumenau - FURB, através da percepção dos professores. O estudo iniciou com a revisão da literatura, conceituando clima organizacional, na visão de diversos autores. Em seguida foi aplicado um questionário, contendo perguntas abertas e fechadas, aos professores do CCSA , num total de 86 pesquisados, dos quais 34 responderam as questões propostas. A análise dos dados revelou que o CCSA apresenta um bom clima organizacional, embora haja falhas na comunicação interna. A pesquisa não teve a pretensão de esgotar o assunto, que pode ser ampliado e aprofundado em outros trabalhos

Pressupostos e aplicação do instituto da desconsideração da personalidade jurídica nas sociedades limitadas no Brasil: uma análise crítica e jurisprudencial.

The present work critically discusses how the Disregard of Legal Entity is applied by Brazilian courts currently and how at permissive intentions are interpreted in practice. Therefore, a study about legal entities, in general, is elaborated, restricting its definition to corporate companies, followed by personified companies, until reaching the modern concepts of anonymous and limited companies. A historical debate is also held, responsible for contextualizing the first cases that unleash the emergence of the doctrine that involves the Disregard of Legal Entity, addressing the evolution of Brazilian positive law itself, in this sense, culminating in the distinction between the Major Theory and the Minor Theory of disregard for personality. In addition to discussing the procedural issue of the matter, which involves the Legal Personality Disregard Incident, the present work criticizes the position adopted by the national courts regarding the application of the aforementioned institute, in the branches of Civil Law, Consumer, Labor and Tributary. The main discussion, that circulates the matter, moves towards balancing the use of the Disregard of Legal Entity, where the disruption of the partner's patrimonial autonomy must be episodic, limited to the specific case and dependent on the observance of the presuppositions provided by law - given the importance of the activity for the national economy itself -, but also not can the business society serve as a personal shield and generate a scenario of impunity, allowing the fraudulent use of legal personality, for the practice of abusive acts, marked by misuse of purpose and patrimonial confusion, in order to harm creditors.O presente trabalho disserta, criticamente, sobre o modo como o instituto da desconsideração da personalidade jurídica (DPJ) é aplicado pelos tribunais brasileiros na atualidade e como os pressupostos permissivos são interpretados, na prática. Para tanto, é feita uma abordagem acerca do tema das pessoas jurídicas, apontando sua definição para as sociedades empresariais, seguidas pelas sociedades personificadas, até alcançar os modernos conceitos das sociedades limitadas e anônimas. Em continuidade, procede-se à contextualização histórica dos primeiros casos que desencadearam o surgimento da doutrina, que envolve a desconsideração da personalidade jurídica, versando a evolução do direito positivo brasileiro neste sentido, e culminando com a distinção entre a Teoria Maior e a Teoria Menor como vertentes de sua interpretação. Discorre-se, ainda, sobre a questão processual da matéria, prevista pelo CPC/15, como incidente, propondo uma análise crítica do posicionamento adotado pelos tribunais pátrios, concernente à aplicação do instituto nos ramos do Direito Civil, do Consumidor, do Trabalho e Tributário. A principal discussão, que circunda a matéria, caminha no sentido de balancear o uso da DPJ, onde o rompimento da autonomia patrimonial do sócio deve ser episódico, limitado ao caso concreto e atrelado à observância dos pressupostos previstos em lei – dada a importância da atividade empresarial para a própria economia nacional - , mas também não pode a sociedade empresária servir de escudo pessoal e gerar um cenário de impunidade, permitindo o uso fraudulento da personalidade jurídica, para a prática de atos abusivos, marcados pelo desvio de finalidade e pela confusão patrimonial, com o intuito de prejudicar credores

NONPARAMETRIC METHOD: KERNEL DENSITY ESTIMATION APPLIED TO FORESTRY DATA

Probability density function can be fitted through parametric or non-parametric methods. The use of a non-parametric method is interesting and appropriate, considering its flexibility and better adjustment to multimodal data. The objective of the present study was to compare the performance of the non-parametric distribution in relation to the parametric distribution in these cases. We used six separate sets of forest database with bimodality and asymmetric characteristics. The probability density functions were estimated for each set of data using the KDE method. To evaluate the effectiveness of the KDE method, parametric probability distributions were also adjusted for the same data. The Kolmogorov-Smirnov test was applied to evaluate the goodness of fit of the parametric distributions. The distributions obtained through the two methods were compared graphically to identify if the nonparametric and parametric methods are equally efficient to obtain the underlying distribution, especially for bimodal and asymmetric distributions. The KDE method is an appropriate alternative for describing probability distributions in forest data, especially when bi- or multimodality occurs

CONDICIONANTES LITO-ESTRUTURAIS NA EVOLUÇÃO DE REGOLITOS: BACIA DO ALTO RIO FORTALEZA, BANANAL (SP)

The present study aimed to evaluate the influence of lithological structures on the development of regoliths in the Fortaleza Upper River Basin (SP). For this purpose, the granulometry and mineralogy of sand and clay were analyzed for the application of weathering indexes. The regoliths of the upper Fortaleza River basin showed high thickness and advanced degree of weathering. The mineralogical analysis showed that are predominantly kaolinite and the abrupt textural variations result found in most cases, the influence of original material (gneiss). However, the evolution of these regoliths is tightly constrained by geological structures and topographic position of each profile. Well, the profiles located in areas with greater availability of water flows were more developed. Still, the role of subsurface flow side, the frequent fluctuations of the water level near the base of the slope and the occurrence of artesian flows, are encouraging of regoliths the development, even in deeper layers.O presente estudo teve como objetivo geral avaliar a influência das estruturas litológicas no desenvolvimento dos regolitos da Bacia do Alto Rio Fortaleza (SP). Para tanto, foram analisados a granulometria e a mineralogia da areia e argila para aplicação de índices de intemperismo. Os regolitos da bacia do alto Rio Fortaleza apresentam elevada espessura e avançado grau de intemperismo. As análises mineralógicas mostraram que são predominantemente cauliníticos e as bruscas variações texturais encontradas resultam, na grande maioria dos casos, da influência do material de origem (gnaisse). Entretanto, a evolução desses regolitos é fortemente condicionada pelas estruturas geológicas e pela posição topográfica de cada perfil. Pois, os perfis localizados em áreas com maior disponibilidade de fluxos d´água foram mais desenvolvidos. Ainda, a atuação do escoamento subsuperficial lateral, as frequentes oscilações do lençol freático próximo a base da encosta e a ocorrência de fluxos artesianos, estão favorecendo o desenvolvimento de regolitos, mesmo nas camadas mais profundas

AS CONCEPÇÕES DE PODER E AUTORIDADE NECESSÁRIAS À INTERPRETAÇÃO DA LEI Nº. 13.869/2019

O advento da Lei nº 13.869/2019 causou muita polêmica ao criminalizar condutas oriundas de abuso de autoridade. Ocorre que grande parte desta polêmica reside no fato de a lei utilizar de elementos do tipo de natureza sui generis. Assim, no intuito de compreender melhor as disposições gerais da referida lei, o presente trabalho pretende analisar algumas concepções filosóficas de Poder e Autoridade, para depois compreender como tais concepções auxiliam na interpretação jurídica dos elementos subjetivos (psíquicos) constantes na Lei nº. 13.869/2019

INTRODUÇÃO À ROBÓTICA: UTILIZANDO ARDUINO PARA A CONSTRUÇÃO DO DROIDE BB-8 INTRODUCTION TO ROBOTICS: USING ARDUINO FOR THE CONSTRUCTION OF THE DROID BB-8

A possibilidade de realizar programação em dispositivos é uma realidade cada vez mais presente em diversos equipamentos que integram o cotidiano (por exemplo, celulares e até relógios). Uma maneira de explorar o potencial da programação em tais dispositivos é realizar a construção de um robô. Tal ação parte da programação, percorre o controle de componentes eletrônicos e materializa-se por completo com o corpo do robô. A fim de aumentar a atratividade dessa tarefa, é proposta a construção do droide BB-8, presente no filme Star Wars e conhecido por muitas pessoas. Pretende-se realizar o processo de construção em oficinas práticas nas quais o detalhamento dos procedimentos e a documentação do processo serão priorizados. Tal ação poderá potencializar a construção de outros robôs cuja aplicação é limitada apenas pela imaginação dos seus construtores

Dystrophic calcification vs sialolithiasis in a pediactric parotid gland : a case report

Calcinosis is a connective tissue disorder characterized by ectopic calcification in soft tissues. It is subdivided into: dystrophic, metastatic, idiopathic and iatrogenic calcification. The formation of mineralized material in the salivary glands is a common finding in the daily practice of dentists and other specialists. In most cases, this calcification is a sialolith. However, a type of ectopic calcification termed dystrophic calcification is characterized by inappropriate biomineralization in soft tissues and may be associated with trauma, chronic and localized infection or inflammatory diseases. We report a case of a 9-year-old female patient who complained of small nodules in the left parotid region, which begun two years before. Her main complaint was of recurring periods of worsened symptoms characterized by the exacerbation and symptomatic remission of the gland volume with occasional otolaryngologic infections. A tomografia computadorizada e sua reconstrução 3D aumentam a reprodutibilidade das classificações das fraturas da extremidade proximal do úmero?

OBJECTIVE:to determine whether 3D reconstruction images from computed tomography (CT) increase the inter and intraobserver agreement of the Neer and Arbeitsgemeinschaft für Osteosynthesefragen (AO) classification systems.METHODS:radiographic images and tomographic images with 3D reconstruction were obtained in three shoulder positions and were analyzed on two occasions by four independent observers.RESULTS:the radiographic evaluation demonstrated that using CT improved the inter and intraobserver agreement of the Neer classification. This was not seen with the AO classification, in which CT was only shown to increase the interobserver agreement.CONCLUSION:use of 3D CT allows better evaluation of fractures with regard to their component parts and their displacements, but nevertheless the intraobserver agreement presented is less than ideal.OBJETIVO:determinar se as imagens da reconstrução 3D da tomografia computadorizada (TC) aumentam a concordância inter e intraobservador dos sistemas de classificação de Neer e Arbeitsgemeinschaft für Osteosynthesefragen (AO).MÉTODOS:foram obtidas imagens radiográficas em três posições do ombro e imagens tomográficas com reconstrução 3D, que foram analisadas em dois tempos por quatro observadores independentes.RESULTADOS:a avaliação radiográfica demonstrou que o uso da TC melhora a concordância intra e interobservadores para a classificação de Neer. O mesmo não foi observado na classificação AO, na qual a TC demonstrou aumento somente da concordância interobservadores.CONCLUSÃO:o uso de TC 3D permite uma melhor avaliação da fratura quanto às partes que a compõem e aos seus desvios, mas mesmo assim apresenta uma concordância intraobservadores menor do que a ideal.Universidade Federal de São Paulo (UNIFESP)UNIFESPSciEL
