    Поняття громадського контролю за діяльністю суддів і система суб’єктів його здійснення

    The author of the article substantiates the modern tendency of the formation, development and spread of an increasing number of levers and protectors from state’s abuse of power, change of the state’s essence and its purpose in the society. The public and various elements of its control and supervisory activity play a significant role in this. Theoretical aspects of the issue of public control in general or in the context of a certain sphere of state power functioning, in particular are studied. Considering this, the author offers own definition of the category of public control over judges (courts) in Ukraine. The system and the legal status of various public control subjects are briefly characterized, their classification is performed and the place of control over judges among other subjects is determined. It has been established that public control over judges (courts) in Ukraine is the system of statutory measures and procedures implemented by civil society subjects in relation to judges, candidates for judges positions, members of judicial administration and self-government agencies (candidates for these positions), courts as institutions in order to to ensure the conditions for the selection of professional and honest judges, the effective, impartial administration of justice and the objective informing the public about the current state of affairs in the judicial sphere. Summarizing the analysis of the system of public control subjects, their administrative powers and capabilities, the author has noted that their absolute majority, except the Public Integrity Council, is not endowed with real (or at least close to such) levers of influence on the processes in the judicial sector. Accordingly, the purpose of their functioning is reduced to a greater extent to the accumulation, analysis and dissemination of socially important information about courts and judges, to the formation of public resonance on the facts of their not fair practice, other cases of law or professional ethics’ violation.Обоснована современная тенденция становления, развития и распространения всё большего количества рычагов и предохранителей от злоупотребления государством властными полномочиями, изменение сущности государства и его назначения в обществе, значительную роль в чём играют общественность и различные элементы её контрольно-надзорной деятельности. Изучены теоретические аспекты вопроса общественного контроля вообще или в разрезе отдельной сферы функционирования государственной власти в частности, с учётом чего предложено авторское определение категории общественного контроля за судьями (судами) в Украине. Кратко охарактеризованы система и правовой статус различных субъектов общественного контроля, разработана их классификация, определено место среди других субъектов контроля за судьями.Обґрунтовано сучасну тенденцію становлення, розвитку та поширення дедалі більшої кількості важелів і запобіжників від зловживання державою владними повноваженнями, зміни сутності держави та її призначення в суспільстві, значну роль у чому відіграють громадськість та різні елементи її контрольно-наглядової діяльності.     Color space distortions in patients with type 2 diabetes mellitus

    Color vision impairment was examined in patients with type 2 diabetes mellitus (DM2) without retinopathy. We assessed the type and degree of distortions of individual color spaces. DM2 patients (n = 32), and age-matched controls (n = 20)were tested using the Farnsworth D-15 and the Lanthony D-15d tests. In addition, subsets of caps from both tests were employed in a triadic procedure (Bimler & Kirkland, 2004). Matrices of inter-cap subjective dissimilarities were estimated from each subject’s “odd-one-out” choices, and processed using non-metric multidimensional scaling. Two-dimensional color spaces, individual and group (DM2 patients; controls), were reconstructed, with the axes interpreted as the R0G and B0Y perceptual opponent systems. Compared to controls, patient results were not significant for the D-15 and D-15d. In contrast, in the triadic procedure the residual distances were significantly different compared to controls: right eye, P 0.021, and left eye, P 0.022. Color space configurations for the DM2 patients were compressed along the B0Y and R0G dimensions. The present findings agree with earlier studies demonstrating diffuse losses in early stages of DM2. The proposed method of testing uses color spaces to represent discrimination and provides more differentiated quantitative diagnosis, which may be interpreted as the perceptual color system affected. In addition, it enables the detection of very mild color vision impairment that is not captured by the D-15d test. Along with fundoscopy, individual color spaces may serve for monitoring early functional changes and thereby to support a treatment strategy

    Opinion Dynamics of Learning Agents: Does Seeking Consensus Lead to Disagreement?

    We study opinion dynamics in a population of interacting adaptive agents voting on a set of complex multidimensional issues. We consider agents which can classify issues into for or against. The agents arrive at the opinions about each issue in question using an adaptive algorithm. Adaptation comes from learning and the information for the learning process comes from interacting with other neighboring agents and trying to change the internal state in order to concur with their opinions. The change in the internal state is driven by the information contained in the issue and in the opinion of the other agent. We present results in a simple yet rich context where each agent uses a Boolean Perceptron to state its opinion. If there is no internal clock, so the update occurs with asynchronously exchanged information among pairs of agents, then the typical case, if the number of issues is kept small, is the evolution into a society thorn by the emergence of factions with extreme opposite beliefs. This occurs even when seeking consensus with agents with opposite opinions. The curious result is that it is learning from those that hold the same opinions that drives the emergence of factions. This results follows from the fact that factions are prevented by not learning at all from those agents that hold the same opinion. If the number of issues is large, the dynamics becomes trapped and the society does not evolve into factions and a distribution of moderate opinions is observed. We also study the less realistic, but technically simpler synchronous case showing that global consensus is a fixed point.     Fluxes of atmospheric muons underwater depending on the small-x gluon density

    The prompt muon contribution to the deep-sea atmospheric muon flux can serve as a tool for probing into the small-x feature of the gluon density inside of a nucleon, if the muon energy threshold could be lifted to 100 TeV. The prompt muon flux underwater is calculated taking into consideration predictions of recent charm production models in which the small-x behaviour of the gluon distribution is probed. We discuss the possibility of distinguishing the PQCD models of the charm production differing in the small-x exponent of the gluon distribution, in measurements of the muon flux at energies 10-100 TeV with neutrino telescopes.Comment: 9 pages, 4 eps figures, uses iopart.st

    Increase in susceptibility to insecticides with aging of wild \u3ci\u3eAnopheles gambiae\u3c/i\u3e mosquitoes from Côte d’Ivoire

    Background: Appropriate monitoring of vector insecticide susceptibility is required to provide the rationale for optimal insecticide selection in vector control programs. Methods: In order to assess the influence of mosquito age on susceptibility to various insecticides, field-collected larvae of An. gambiae s.l. from Tiassalé were reared to adults. Females aged 1, 2, 3, 5 and 10 days were exposed to 5 insecticides (deltamethrin, permethrin, DDT, malathion and propoxur) using WHO susceptibility test kits. Outcome measures included the LT50 (exposure time required to achieve 50% knockdown), the RR (resistance ratio, i.e. a calculation of how much more resistant the wild population is compared with a standard susceptible strain) and the mortality rate following 1 hour exposure, for each insecticide and each mosquito age group. Results: There was a positive correlation between the rate of knockdown and mortality for all the age groups and for all insecticides tested. For deltamethrin, the RR50 was highest for 2 day old and lowest for 10 day old individuals. Overall, mortality was lowest for 2 and 3 day old individuals and significantly higher for 10 day old individuals (P \u3c 0.05). With permethrin, the RR50 was highest for 1 to 3 day old individuals and lowest for 10 day old individuals and mortality was lowest for 1 to 3 day old individuals, intermediate for 5 day old and highest for 10 day old individuals. DDT did not display any knockdown effect and mortality was low for all mosquito age groups (\u3c7%). With malathion, the RR50 was low (1.54 - 2.77) and mortality was high (\u3e93%) for all age groups. With propoxur, no knockdown effect was observed for 1, 2 and 3 day old individuals and a very low level of mortality was observed (\u3c 4%), which was significantly higher for 5 and 10 day old individuals (30%, P \u3c 0.01). Conclusion: Results indicate that for An. gambiae s.l. adults derived from wild-collected larvae, there was an influence of age on insecticide susceptibility status, with younger individuals (1 to 3 days old) more resistant than older mosquitoes. This indicates that the use of 1 – 2 day old mosquitoes in susceptibility assays as recommended by the WHO should facilitate detection of resistance at the stage where the highest rate of the resistance phenotype is present

    Measurement of the production of a W boson in association with a charm quark in pp collisions at sqrt(s)=7 TeV with the ATLAS detector

    The production of a W boson in association with a single charm quark is studied using 4.6 fb^-1 of pp collision data at sqrt(s)=7 TeV collected with the ATLAS detector at the Large Hadron Collider. In events in which a W boson decays to an electron or muon, the charm quark is tagged either by its semileptonic decay to a muon or by the presence of a charmed meson. The integrated and differential cross sections as a function of the pseudorapidity of the lepton from the W-boson decay are measured. Results are compared to the predictions of next-to-leading-order QCD calculations obtained from various parton distribution function parameterisations. The ratio of the strange-to-down sea-quark distributions is determined to be 0.96 +0.26 -0.30 at Q^2=1.9 GeV^2, which supports the hypothesis of an SU(3)-symmetric composition of the light-quark sea. Additionally, the cross-section ratio sigma(W^+ + bar{c})/sigma(W^- + c) is compared to the predictions obtained using parton distribution function parameterisations with different assumptions about the s-bar{s} quark asymmetry.Fil: ATLAS Collaboration, G.     GMRT mini-survey to search for 21-cm absorption in Quasar-Galaxy Pairs at z~0.1

    We present the results from our 21-cm absorption survey of a sample of 5 quasar-galaxy pairs (QGPs), with the redshift of the galaxies in the range 0.03<zg<0.18, selected from the SDSS. The HI 21-cm absorption was searched towards the 9 sight lines with impact parameters ranging from 10 to 55 kpc using GMRT. 21-cm absorption was detected only in one case i.e. towards the Quasar (zq=2.625 SDSS J124157.54+633241.6)-galaxy (zg=0.143 SDSS J124157.26+633237.6) pair with the impact parameter 11 kpc. The quasar sight line in this case pierces through the stellar disk of a galaxy having near solar metallicity (i.e (O/H)+12=8.7) and star formation rate uncorrected for dust attenuation of 0.1 M_odot/yr. The quasar spectrum reddened by the foreground galaxy is well fitted with the Milky Way extinction curve (with an Av of 0.44) and the estimated HI column density is similar to the value obtained from 21-cm absorption assuming spin temperature of 100K. Combining our sample with the z<0.1 data available in the literature, we find the detectability of 21-cm absorption with integrated optical depth greater than 0.1 km\s to be 50% for the impact parameter less than 20 kpc. Using the surface brightness profiles and relationship between the optical size and extent of the HI disk known for nearby galaxies, we conclude that in most of the cases of 21-cm absorption non-detection, the sight lines may not be passing through the HI gas. We also find that in comparison to the absorption systems associated with these QGPs, z<1 DLAs with 21-cm absorption detections have lower CaII equivalent widths despite having higher 21-cm optical depths and smaller impact parameters. This suggests that the current sample of DLAs may be a biased population that avoids sight lines through dusty star-forming galaxies.     Measurement of the parity-violating asymmetry parameter αb and the helicity amplitudes for the decay Λ0b→J/ψ+Λ0 with the ATLAS detector

    A measurement of the parity-violating decay asymmetry parameter, αb, and the helicity amplitudes for the decay Λb0→J/ψ(μ+μ-)Λ0(pπ-) is reported. The analysis is based on 1400 Λb0 and Λ¯b0 baryons selected in 4.6  fb-1 of proton-proton collision data with a center-of-mass energy of 7 TeV recorded by the ATLAS experiment at the LHC. By combining the Λb0 and Λ¯b0 samples under the assumption of CP conservation, the value of αb is measured to be 0.30±0.16(stat)±0.06(syst).     The Case for a Low Extragalactic Gamma-ray Background

    Measurements of the diffuse extragalactic gamma-ray background (EGRB) are complicated by a strong Galactic foreground. Estimates of the EGRB flux and spectrum, obtained by modeling the Galactic emission, have produced a variety of (sometimes conflicting) results. The latest analysis of the EGRET data found an isotropic flux I_x=1.45+-0.05 above 100 MeV, in units of 10^-5 s^-1 cm^-2 sr^-1. We analyze the EGRET data in search for robust constraints on the EGRB flux, finding the gamma-ray sky strongly dominated by Galactic foreground even at high latitudes, with no conclusive evidence for an additional isotropic component. The gamma-ray intensity measured towards the Galactic poles is similar to or lower than previous estimates of I_x. The high latitude profile of the gamma-ray data is disk-like for 40<|b[deg]|<70, and even steeper for |b|>70; overall it exhibits strong Galactic features and is well fit by a simple Galactic model. Based on the |b|>40 data we find that I_x<0.5 at a 99% confidence level, with evidence for a much lower flux. We show that correlations with Galactic tracers, previously used to identify the Galactic foreground and estimate I_x, are not satisfactory; the results depend on the tracers used and on the part of the sky examined, because the Galactic emission is not linear in the Galactic tracers and exhibits spectral variations across the sky. The low EGRB flux favored by our analysis places stringent limits on extragalactic scenarios involving gamma-ray emission, such as radiation from blazars, intergalactic shocks and production of ultra-high energy cosmic rays and neutrinos. We suggest methods by which future gamma-ray missions such as GLAST and AGILE could indirectly identify the EGRB.Comment: Accepted for publication in JCAP.
