    Constitution and Public Sphere: Systemic differentiation, inclusion and recognition

    Tras algunas aclaraciones iniciales, el trabajo arranca con una presentación del concepto de Constitución y del de esfera pública pluralista. A partir de ahí analiza los conceptos de inclusión (como posición de la persona en relación a los sistemas funcionales) y de reconocimiento (como problema de doble contingencia en la interacción cotidiana). Y concluye ocupándose de los límites de la esfera pública y de la posibilidad de que puedan ser superados en el ámbito de la estructura de una sociedad mundial.After some initial explanations, the author introduces the concept of Constitution and that of a plural public sphere. Drawing from them, an analyses of the concepts of inclusion (in terms of where the person stands in functional systems) and recognition (in terms of a problem of double contingency in daily interaction) is undertaken. Finally, as a conclusion, the paper reflects on the limits of the public sphere and on the possibility to overcome them at the level of a worldwide society structure

    In a 2008 article, one of Robert Alexy's disciples, Lorenzo Zucca pontificated Alexy as the "prophet of proportionality doctrine." This panegyric labeling was reverberated later by two other disciples, Klatt and Meister in a monographic work on the subject. When it comes to the religious dimension, this sort of qualification is not problematic, but rather legitimizing. In the field of philosophy, science, and theoretical reflection in general, this is disastrous, since it tends to undermine one of the presuppositions of science and other forms of reflective knowledge, "limitationality," namely, the assumption that knowledge is never exhausted. Virgílio Afonso da Silva, in his article "The Federal Supreme Court needs Iolau: Response to Marcelo Neves's objections to the balancing and optimization", proposes to present a review of my book "Between Hydra and Hercules." comments to Virgílio Afonso da Silva's criticism of my book, to prove, with clear arguments, that these are mistaken objections and that sometimes they seem to me hurried, since they simplify (and, in part, distort) my line of rationale in a somewhat rhetorical way to impute to him the appearance of a fragility, strictly, non-existent

    O presente trabalho relata e analisa o uso da repetição em processos criativos experenciados pelo autor durante sua graduação em Interpretação Teatral na Universidade Federal do Rio Grande do sul (UFRGS). O principal objeto de pesquisa é a noção repetição utilizada na constituição do espetáculo Alhures - estágio de atuação do autor –, como ela é aplicada e como transforma as cenas apresentadas. O trabalho também analisa experimentos de criação derivados do espetáculo em questão, como partituras, textos e desenhos. Passando por referências como Pina Bausch, Ciane Fernandes, Fayga Ostrower, Maria Lídia Magliani, Jacques Lecoq e Yoshi Oida, o autor explora diferentes campos das artes buscando e pesquisando a repetição, suas diferentes formas de variação.The present work reports and analyzes the use of repetition in creative processes experienced by the author during his graduation in Theater Interpretation at the Federal University of Rio Grande do Sul (UFRGS). The main object of research is the notion of repetition used in the constitution of the show Alhures – acting internship of the author -, how it is applied and how it transforms the scenes presented. The work also analyzes creative experiments derivative from the show in question, such as scores, texts and drawings. Going through references such as Pina Bausch, Ciane Fernandes, Fayga Ostrower, Maria Lídia Magliani, Jacques Lecoq and Yoshi Oida, the author explores different fields of the arts seeking and researching repetition, its different forms of variation

    O depósito legal estadual e o registro de direito autoral como mecanismos de proteção da propriedade intelectual de obras bibliográficas do Tocantins

    It discusses the protection of intellectual property through a proposed law mechanism for a state legal deposit system containing the copyright registration for the State of Tocantins, where it is also an important instrument for the formation of a heritage collection. The loyal deposit is the sending of copies of any publication produced in a country. In Brazil, the mechanism has been in operation since the imperial period and is currently in force under Law No. National. In addition to the national law, twelve Brazilian states have State Legal Deposit mechanisms, the oldest being the decree of the state of Paraná in 1964 and the most current of the state of Rio Grande do Norte in 2017. In addition to the deposit that helps to form library collections, also helps to preserve memory, thus enabling the control, elaboration and dissemination of current national bibliography, as well as the defense and preservation of the language, safeguarding the memory for the next generations, it also allows the protection intellectual property as a prior registration for copyright, even though its registration with copyright offices is not mandatory. Methodologically, the research is characterized by being of a bibliographic and documentary nature, of an applied nature, with a qualitative approach. It brings a historical approach to the legal deposit and copyright in various biases such as the "Library of Alexandria" as the first depositary unit. It presents the scenario of Legal Deposit mechanisms in Brazilian states. Electronic legal deposit takes place as a factor of technological innovation for access to information and objects of physical and electronic legal deposit. It makes an approach to copyright considering factors on the issue of copyright in the Berne Convention of 1908 and on rights in works produced by machines. It also deals with UNESCO's guidelines for legal deposit and identifies the role of bibliographic control in the preservation of intellectual production heritage. Finally, it brings: a proposal for a decree-law for legal deposit for the State of Tocantins that also addresses copyright protection; strategic tools such as the CANVAS business model and the SWOT matrix and a textbook-format textbook entitled “A guide to copyright registration, legal filing and ISBN application for independent writers: contributions to the protection of Intellectual Property”.Discorre sobre a proteção da propriedade intelectual através de mecanismo de lei proposto para um sistema de depósito legal estadual contendo o registro de direito autoral para o Estado do Tocantins, onde também se configura como instrumento importante para formação de acervo patrimonial. O depósito leal é o envio de exemplares de toda publicação produzida em um país. No Brasil o mecanismo funciona desde o período imperial e hoje está vigente por força das leis nº 10.994, de 14/12/2004, para livros e 12.192, de 14/01/2010 para obras musicais, as quais tem como depositária legal a Biblioteca Nacional. Além da lei nacional, doze estados brasileiros dispõem de mecanismos de Depósito Legal Estadual, sendo o mais antigo o decreto do estado do Paraná em 1964 e o mais atual o do estado do Rio Grande do Norte em 2017. Além do depósito que ajuda a formar os acervos das bibliotecas, ajuda também a preservar a memória, possibilitando assim, o controle, a elaboração e a divulgação da bibliografia nacional corrente, bem como a defesa e a preservação da língua, salvaguardando a memória para as próximas gerações, também possibilita a proteção da propriedade intelectual como registro de anterioridade para direitos do autor, mesmo não sendo obrigatório seu registro nos escritórios de direitos autorais. Metodologicamente a pesquisa caracteriza-se por ser de cunho bibliográfico e documental, de natureza aplicada, com forma de abordagem qualitativa. Traz uma abordagem histórica sobre o depósito legal e o direito autoral em diversos vieses como a “Biblioteca de Alexandria” como primeira unidade depositária. Apresenta o cenário dos mecanismos de Depósito Legal nos estados brasileiros. Transcorre o Depósito legal eletrônico como fator de inovação tecnológica para o acesso à informação e os objetos de depósito legal físico e eletrônico. Faz uma abordagem sobre o direito autoral considerando fatores sobre a problemática do direito autoral na convenção de Berna de 1908 e sobre direitos em obras produzidas por maquinas. Trata ainda das diretrizes da UNESCO para depósito legal e identifica o papel do controle bibliográfico na preservação do patrimônio da produção intelectual. Traz, por fim: uma proposta de decreto-lei para depósito legal para o Estado do Tocantins que aborde também a proteção de direitos autorais; ferramentas estratégicas como o modelo de negócios CANVAS e a matriz SWOT e um material didático em formato de livro intitulado “Um guia sobre o registro de direito autoral, depósito legal e pedido de ISBN para escritores independentes: contribuições na proteção da Propriedade Intelectual”

    Retailers face a complex task in formulating prices strategies. While the goal of pricing is to lay down a general course of action, pricing methods are procedures which enable organizations to make their pricing decisions. The scope of this paper is to explore retail pricing goals along with the methods that are employed for pricing, and to investigate whether the methods employed succeed in achieving the objectives. It was found that the companies used in the sample are basically pursuing quantitative rather than qualitative objectives and that they lay emphasis on achieving sales and making profits by following market developments. Another significant factor was that, the firms in the sample seemed to attach less importance to customer-oriented methods and employ the traditional methods of costing, probably due to their simplicity

    The effect of income on the energy mix: Are democracies more sustainable?

    This paper shows that the effect of income on the energy mix depends on the democracy level. We find that more democratic countries tend to depart from the hydroelectric power, oil, and geothermal sources of energy to rely on coal, natural gas, and modern renewable sources (nuclear, biomass, wind, and others). Less democratic countries tend to become more dependent on oil and natural gas with their own development. Moreover, the energy ladder transition from hydroelectric sources to natural gas appears to be escalated more quickly for less democratic countries. These transitions are thus more environmental friendly for more democratic countries than for less democratic ones.
