    A guarda preventiva de logs no Marco Civil da Internet : uma análise comparada à jurisprudência europeia sobre proteção de dados pessoais

    Trabalho de conclusão de curso (graduação)—Universidade de Brasília, Faculdade de Direito, 2016.O presente estudo tem como objetivo analisar a instituição no Marco Civil da Internet do dever de guarda de logs para os provedores de aplicação e de conexão, a partir da comparação dos fundamentos que balizaram os recentes julgados de tribunais europeus, quais sejam, o Tribunal de Justiça da União Europeia e o Tribunal Federal Constitucional Alemão, quanto a Diretiva 2006/24/EC e a Lei de Telecomunicações Alemã,no que se refere à proteção dos dados pessoais e da privacidade. Partindo do pressuposto de que a Constituição Federal de 1988 tem como fundamento a dignidade da pessoa humana e outros valores fundamentais, busca-se verificar de que forma foi sancionada a regulação e as medidas técnicas de segurança no Decreto 8.771/16 e, seda forma como foi posta, não extrapola o limite e se caracteriza em uma violação ao direitos fundamentais dos cidadãos que utilizam da rede em território nacional.This paper analyzes the duty of Internet Service Providers (ISPs) and Application Service Providers (ASPs) as a precautional measure to retain metadata, such as connection logs and application logs, for a certain period of time, imposed by the Brazilian Civil Rights Framework for Internet, specifically in the respect for private life and the protection of personal data. This intends to be done by comparing its shape to the legal fundaments exposed in recent decisions of European Courts about the Directive 2006/24/EC and the German Law that internalized the directive. Assuming the fact that the Brazilian Constitution is founded on the principle of human dignity and other fundamental values, the focus is to verify under which circumstances the regulation and the technical protection measures were sanctioned and if these configure a encroachment and a violation of fundamental rights of citizens that use the net in Brazilian national territory

    Ambiente de contratação livre de energia sob tarifa binômia para consumidores em baixa tensão

    Considerando tendências futuras e mudanças propostas na legislação do setor elétrico brasileiro, apresenta-se neste trabalho uma análise de tarifação binômia de consumidores conectados na rede de baixa tensão, bem como a possibilidade desses consumidores migrarem para o ambiente de contratação livre a partir dessa modalidade de tarifação. Essa migração assegura a viabilidade do próprio consumidor celebrar contratos bilaterais com os fornecedores de energia, buscando reduzir custos e riscos. A análise inicia com uma obtenção das curvas e fatores de carga do consumidor, com o objetivo de conhecer as características de consumo do mesmo e, desse modo, garantir a aplicação da tarifa binômia proposta no trabalho. Essa proposta decorre de estudos sobre alternativas de tarifação binômia apresentadas pela ANEEL na audiência pública n° 059/2018. A partir das alternativas decorrentes dessa audiência pública, este trabalho propõe uma opção de tarifação binômia, utilizando características presentes em duas das alternativas de tarifação apresentadas pela ANEEL: a primeira, chamada de alternativa 4b - Custo fixo diferenciado por faixa de consumo; e a segunda, chamada de alternativa 5 - Demanda. Em seguida, é verificada a viabilidade de migração para o ambiente de contratação livre de energia para consumidores com diferentes características de consumo, fatores de carga e demanda, conectados em baixa tensão, buscando, adicionalmente, avaliar o tipo de energia, incentivada ou não, a ser contratada visando maior economia. Para ilustrar a proposta, serão apresentados exemplos e análises com dados de consumidores dos subgrupos B1 e B3.Considering future trends and proposed changes in the legislation of the Brazilian electricity sector, this paper presents an analysis of the binomial charging of consumers connected to the low voltage grid, as well as the possibility of these consumers migrating to the free contracting environment under this binomial tariff. This migration ensures the viability of the consumer to enter into bilateral contracts with energy suppliers, seeking to reduce costs and risks. The analysis begins by obtaining the curves and load factors of the consumer, in order to know the consumption characteristics and, thus, ensure the application of the proposed binomial tariff at this paper. This proposal stems from studies on the binomial tariffs alternatives presented by ANEEL at public hearing No. 059/2018. Based on the alternatives arising from this public hearing, this paper proposes a binomial tariff, using characteristics present in two of ANEEL’s charging alternatives: the first one, called alternative 4b - Fixed cost differentiated by consumption range; and the second one, called alternative 5 - Demand. Then, the feasibility of migrating to the free contracting environment of energy for consumers with different consumption characteristics, load and demand factors, connected in low voltage, is verified, seeking, additionally, to evaluate the source of energy, incentivized or not, to be purchased for greater savings. To illustrate the proposal, examples and analyzes with consumer data of subgroups B1 and B3 will be presented

    Influence of upwelling and tropical environments on the breeding development of the intertidal barnacle Tetraclita stalactifera (Lamarck, 1818)

    Cabo Frio, devido suas características oceanográficas, causado pela é uma importante região biogeográfica transicional entre águas tropicais e sub-tropicais. Isto é ressurgência da Água Central do Atlântico Sul (ACAS) e a presença de águas tropicais da Corrente do Brasil (CB) e de Água Costeira (AC). A craca do mediolitoral Tetraclita stalactifera e seus estágios de maturação larval foram analisados a fim de serem correlacionados às condições ambientais. Dois locais com características termais contrastantes foram escolhidos: a Ponta da Cabeça (PC), que está sobre influência sazonal da ressurgência e a Ponta da Fortaleza (PF), sob influência da água tropical. Em cada local, indivíduos de T. stalactifera foram coletados mensalmente e a condição de suas lamellas ovígeras aferida e classificada desde o estágio 0 (vazio) até o IV (prestes a liberar). Nossos resultados amostram um efeito sazonal na PC, enquanto no local PF foi identificado um desenvolvimento contínuo. A disponibilidade de larvas náuplios também segue esta tendência. As diferenças observadas entre os locais podem ser explicadas pelas diferenças na temperatura da água e as respostas eco-fisiológicas exibidas por T. stalactifera na região.Cabo Frio, with its unique oceanographic conditions, is an important biogeographical transitional region between tropical and sub-tropical waters. This is due to the presence of upwelling from the Central Water of the South Atlantic (CWSA), and the presence of tropical waters from the Brazilian Current (BC) and Coastal Water (CW). The intertidal barnacle, Tetraclita stalactifera, and its brooding stages were analyzed to correlate environmental conditions with reproductive development. Two thermal contrasting sites were chosen: Ponta da Cabeça (PC), which is under the influence of seasonal upwelling, and Ponta da Fortaleza (PF) which experiences tropical influences. At each site, T. stalactifera specimens were collected monthly and their egg lamellae conditions classified into stages from 0 (empty) to IV (ready to release). Our results show a seasonal effect on brooding at the PC site and a continuous development at the PF site. Nauplii larval availability also followed this trend. Differences between the sites could be due to ecological differences related to water temperature and the ecological-physiological response of the barnacles to these differences

    This study aims to critically analyze the provisions of Law 13.964/2019, self-titled Anti-Crime Law, limiting itself to the examination of the provisions of material criminal law, which are based on the political discourse of penal punitivism to combat crime to deepen the criminal treatment, resulting in a worrying violation of the fundamental rights of convicts. Among these provisions, it receives greater prominence in this study, which modifies Article 75 of the Penal Code, increasing the maximum time of execution of prision sentences from 30 to 40 years.O presente estudo pretende analisar criticamente os dispositivos da Lei 13.964/2019, autointitulada Lei Anticrime, limitando-se ao exame dos dispositivos de direito penal material, que se fundam no discurso político do punitivismo penal de combate à criminalidade para recrudescer o trato penal, resultando em preocupante violação aos direitos fundamentais dos condenados. Dentre esses dispositivos, recebe maior destaque neste estudo o que modifica o artigo 75 do Código Penal, aumentando o tempo máximo de cumprimento das penas privativas de liberdade de 30 para 40 anos

    Stingless bee further improve apple pollination and production

    The use of Africanised honeybee (Apis mellifera scutellata Lepeletier) hives to increase pollination success in apple orchards is a widespread practice. However, this study is the first to investigate the number of honeybee hives ha-1 required to increase the production of fruits and seeds as well as the potential contribution of the stingless bee Mandaçaia (Melipona quadrifasciata anthidioides Lepeletier). We performed tests in a 43-ha apple orchard located in the municipality of Ibicoara (13º24’50.7’’S and 41º17’7.4’’W) in Chapada Diamantina, State of Bahia, Brazil. In 2011, fruits from the Eva variety set six seeds on average, and neither a greater number of hives (from 7 to 11 hives ha-1) nor a greater number of pollen collectors at the honeybee hives displayed general effects on the seed number. Without wild pollinators, seven Africanised honeybee hives ha-1 with pollen collectors is currently the best option for apple producers because no further increase in the seed number was observed with higher hive densities. In 2012, supplementation with both stingless bees (12 hives ha-1) and Africanised honeybees (7 hives ha-1) provided higher seed and fruit production than supplementation with honeybees (7 hives ha-1) alone. Therefore, the stingless bee can improve the performance of honeybee as a pollinator of apple flowers, since the presence of both of these bees results in increases in apple fruit and seed number.Fil: Blandina Felipe, Viana.     COMPARISON BETWEEN THE DOUBLE BUFFER METHOD AND THE EQUIVALENT RECTANGLE METHOD FOR THE QUANTIFICATION OF DISCREPANCIES BETWEEN LINEAR FEATURES

    Currently, in Brazil, for the assessment of the Positional Accuracy of non-point features (lines and polygons), there is no standard norm of execution. This work aims to compare the results of two methodologies that allow determining the average value of the discrepancies between linear features. The first, Equivalent Rectangle Method, aims to determine the discrepancy by considering an equivalent rectangle for the polygon obtained from the two homologous lines. The second, Double Buffer Method applies a buffer on both lines and obtains the average discrepancy value based on the relation of the areas of the generated polygons. These methods were compared in two steps. Initially, an experiment was performed with features of known measurements, where the displacement of the homologous lines was controlled in azimuth and distance. In this step, it was verified that the shape of the feature and the direction of the displacement interfere in the results of both methods when compared to the traditional procedure of measurement of discrepancies by homologous points. In the second stage, we evaluated the vector data of the OpenStreetMap (class of roads), with reference to a more accurate vector dataset produced for the Mapping of the State of Bahia. As a result, for the 1:25,000, 1:50,000, 1:100,000 and 1:250,000 scales, it was obtained, respectively, the PEC-PCD for the Equivalent Rectangle Method "C", "B", "A" and "A" and the PEC-PCD for the Double Buffer Method "R", "C", "B" and "A", where "R" means that it has not achieved the minimum PEC-PCD classification

    Antibacterial and antioxidant activities of Licania tomentosa (Benth.) fritsch (crhysobalanaceae)

    This work describes the chemical composition, and evaluates the antimicrobial and antioxidant activities of a hydroalcoholic extract from the leaves of the Licania tomentosa. Gram positive and negative bacterial strains were used in this work. Examination of the phytochemical composition of L. tomentosa revealed the presence of secondary metabolites such as tannins, flavonoids, saponins, alkaloids, steroids and triterpenoids. An antibacterial assay pointed out that the extract had a lower minimal inhibitory concentration (MIC - 32 μg/mL) towards Staphylococcus aureus (ATCC12692). The extract also presented antibacterial activity against other assayed bacteria, with the MIC varying between 64 and 512 μg/ mL. Our findings reveal that the extract presented an antioxidative capacity lower than that of BHT at the same concentration, used as positive control. Our results suggest that the levels and combinations between the secondary metabolites of this plant should be investigated to explain the demonstrated antibacterial activity

    A incorporação dos tratados internacionais no direito interno

    Monografia (graduação)—Universidade de Brasília, Faculdade de Direito, 2014.Os tratados internacionais, após a afirmação de uma nova ordem mundial, globalizada, que preza pela cooperação internacional entre os países, concretizaram-se como a principal fonte do direito internacional. Nesse contexto, a incorporação dos tratados internacionais no direito interno é um dos problemas de maior grandeza no âmbito das relações entre o direito internacional público e o direito estatal de cada país. Por meio deste trabalho pretende-se perscrutar o conflito entre as normas internacionais e as normas internas. Para tanto, esclarecer-se-á o modo de solução adotado pelo Supremo Tribunal Federal, a opção pelo monismo moderado. Apresentar-se-á também exceções a essa solução adotada, abordando-se a controvérsia em torno dos direitos humanos. Por fim, demonstrar-se-á a ausência de regras claras e coerentes do ordenamento jurídico brasileiro no que tange à incorporação dos tratados internacionais, tendo como pano de fundo, o caso da Convenção nº 158 da OIT.After the affirmation of a global new world order, which stands for international cooperation among countries, international treaties are the main sources of international law. In this context, the incorporation of international treaties into domestic law deal with problems related to conflicts between international law and national law. This monograph analyzes the conflict between international and internal rules. For this purpose, it studies the solution adopted by the Supreme Federal Court, which has chosen a moderate monism theory. This work presents the exceptions to this adopted solution, addressing the controversy surrounding international human rights treaties. Lastly, it proves the absence of clear and coherent rules of the Brazilian legal order, regarding the incorporation of international treaties, against the backdrop of Convention 158 of the ILO

    Estimation of soil phosphorus availability via visible and near-infrared spectroscopy

    Spectroscopic techniques have great potential to evaluate soil properties. However, there are still questions regarding the applicability of spectroscopy to analyze soil phosphorous (P) availability, especially in tropical soils with low nutrient contents. Therefore, this study evaluated the possibility to estimate P availability in soil and its pools (labile, moderately labile and non-labile) via Vis-NIR spectroscopy based on intra-field calibration. We used soils from two different locations, a plot experiment that received application of phosphate fertilizers (Field-A) and a cultivated field where a grid soil sampling was performed (Field-B). We used the technique of diffuse reflectance in the visible and near-infrared (Vis-NIR) to obtain the spectra of soil samples. Predictive modeling for P availability and labile, moderately labile and non-labile pools of P in soil were obtained via partial least squares (PLS) regression; classification modeling was performed via Soft Independent Modeling of Class Analogy (SIMCA) on three P availability levels in order to overcome the limitation on quantifying P via Vis-NIR spectroscopy. We found that isolating P contents as the only variable (Field-A), Vis-NIR spectroscopy does not allow estimating P pools in the soil. In addition, quantification of P available in the soil via predictive modeling has limitations in tropical soils. On the other hand, estimating P content in soil through classes of availability is a feasible and promising alternative
