Plain Meaning or Pragmatics? Differing Interpretations of the Clean Water Act’s Jurisdictional Provisions

There is significant discord among circuit courts over whether a broad or narrow construction of the Clean Water Act’s jurisdictional provisions is appropriate in determining when circuit courts should have direct jurisdiction to review petitions challenging regulations. The broad interpretation of these provisions emphasizes the practicality of direct circuit court review of a wider range of regulations, whereas the narrow interpretation uses the plain language. In Friends of the Everglades v. U.S. Environmental Protection Agency, the U.S. Court of Appeals for the Eleventh Circuit addressed this issue as applied to petitions for review of the “water transfer rule.” Adopting the plain language approach, the court held it did not have jurisdiction to review the petition because the challenged regulation was not within the jurisdictional provisions. The Supreme Court denied certiorari. This Comment notes that both approaches can benefit the environment but argues that the long-term implications of the plain language approach could be detrimental due to judicial inefficiency and a lack of consistent application of the law across districts

Using HGM Analysis to Aggregate Wetlands as “Similarly Situated” Under the \u3cem\u3eRapanos\u3c/em\u3e “Significant Nexus” Test

Wetlands are vital to the health of the nation’s waterways. Even small, geographically isolated wetlands can perform important functions that benefit their surrounding ecosystem. Despite the important role of smaller wetlands, the federal Clean Water Act (CWA) protection of these areas is limited to those wetlands that satisfy legal tests limited by the Commerce Clause of the Constitution. The main test to establish jurisdiction—the “significant nexus” test—relies on a connection between a wetland and a navigable-in-fact waterway. Smaller wetlands, however, may not each have individual connections that are sufficient to satisfy the significant nexus test. When wetlands are “similarly situated,” therefore, the individual effects of each wetland may be aggregated to assess the connection to a navigable-in-fact waterway. This Note proposes that the hydrogeomorphic (HGM) classification system, which is already used to assess wetland functions and values, be used to establish when wetlands are similarly situated. Using HGM classification this way is consistent with the legislative purpose of the CWA and Supreme Court precedent in United States v. Rapanos, would improve the efficiency of CWA jurisdictional determinations, and would allow small, geographically isolated wetlands to fall under the CWA’s protections

This is the first study to report a high-throughput approach integrating gene expression data from Spodoptera frugiperda guts and their associated metatranscriptomes. Videojuegos comerciales en el contexto escolar: Una aproximación a su estado del arte

El presente artículo corresponde a una condensación cualito – cuantitativo del Estado del Arte que conforma el capítulo 2 de la tesis doctoral “Resignificación de los videojuegos comerciales como herramientas pedagógicas en el aula de clase: Caso Los Sims”. Esta propuesta investigativa fue desarrollada bajo el enfoque de tres principales teorías Aprendizaje Significativo, Aprendizaje en Ámbitos Semióticos, y Aprendizaje y Videojuegos. El aporte innovador de este trabajo doctoral consistió en la posibilidad de reunir estos tres elementos teóricos para dar luz a una nueva propuesta que permita la utilización de los videojuegos comerciales como herramientas pedagógicas en el aula de clase. En este artículo se presenta todo el proceso de formulación de dicho estado del arte el cual fue la base para construir esta propuesta investigativa. Consiste en una breve descripción de las bases de datos especializadas consultadas durante el proceso y se presenta un análisis cualitativo y cuantitativo de los resultados obtenidos a partir de dichas consultas. Finalmente, se exponen elementos fundamentales del estado del arte y su estrecha relación con este trabajo investigativo

Common-sized financial statements in the retail and airline industries in Colombia

This teaching case study intends to serve Financial Statement Analysis courses in the undergraduate and master’s degree, by helping student’s learning process, applying real-life examples in evaluating the ability to use and interpret fundamental data, assessing and analyzing the Cash Conversion Cycle and Return on Assets. Common-sized financial statements and other financial ratios from two Colombian companies, operating in the retail and airline industries are compared, highlighting the differences in cash conversion cycle, their components and the drivers of return on assets in each industry. Derivados de Benzoacetonitrilos como inhibidores bacterianos

71 P.La tendiente problemática generada por el fenómeno de resistencia mostrada por algunos microorganismos patógenos a humano de importancia clínica hace necesaria la búsqueda de nuevas sustancias químicas que sean capaces de suplir aquellas que ya han disminuido su efecto. Los heterociclos nitrogenados han mostrado un sinnúmero de actividades biológicas, actuando como agentes antioxidantes, inhibidores enzimáticos, antitumorales y como antimicrobianos, aprovechando las características se sintetizó una serie de ellos, mediante la reacción de condensación de Knoevenagel donde se usó como precursor el benzotiazolacetonitrilo más aldehídos de diversidad estructural en presencia de etanol. Estos fueron purificados mediante técnicas cromatográficas convencionales, analizados espectroscópicamente para determinar estructura de cada compuestos, para ello se utilizó espectroscopia infrarrojo que aporto información sobre los grupos funcionales presentes en la molécula, espectroscopia de Resonancia Magnética Nuclear de protón y Carbono trece que permitió conocer número y cantidad de protones y carbonos presentes en la estructura complementando esta información con parámetros fisicoquímicos como punto de fusión. Una vez confirmada la estructura propuesta se evaluó la actividad antimicrobiana sobre bacterias patógenas a humano mediante la técnica de difusión en agar y microdilución en microplacas de 96 pocillos.Se sintetizaron10 compuestos clasificados como acrilonitrilos con diferentes patrones de sustitución, los cuales fueron evaluados sobre cepas bacterianas Gram positivo y Gram negativo de interés clínico

This arises with the approval of the law December 11/2018 where it is stated that, above all, large companies are obliged to disclose nonfinancial information in their annual reports.Este trabajo surge con la idea de ver como las empresas actualmente tienen que incluir en sus informes anuales información no financiera correspondiente al año en curso, es decir, información sobre el personal, información medioambiental e información de gobierno corporativo, todo esto complementando a la información financiera. Todo ello sería para ayudar a las empresas a gestionar mejor su rendimiento y el impacto que producen en la sociedad.
