Can a trademark be copyright protected?

Co do zasady znaki towarowe mogą być na gruncie prawa polskiego, jeśli spełnią przesłanki ochrony, kwalifikowane jako utwory w rozumieniu ustawy o prawie autorskim i prawach pokrewnych. Zgodnie z tą ustawą utworem jest każdy przejaw działalności twórczej o indywidualnym charakterze ustalony w jakiejkolwiek postaci, niezależnie od wartości, sposobu i przeznaczenia. W związku z powyższym w praktyce pojawia się pytanie, czy znakom towarowym, które są najczęściej pojedynczymi wyrazami lub ewentualnie prostym zestawieniem kilku wyrazów i które służą odróżnianiu towarów i usług jednych przedsiębiorców, od towarów i usług innych przedsiębiorców, powinno przyznawać się ochronę prawnoautorską. Przyznanie prawnoautorskiej ochrony pociąga za sobą bowiem poważne konsekwencje, gdyż prawa autorskie przysługujące twórcy do utworu mogą być przeszkodą w późniejszej rejestracji znaku towarowego, a także podstawą unieważnienia już zarejestrowanego znaku towarowego. W artykule zostały przeanalizowane poglądy doktryny i orzecznictwo sądów powszechnych.Trademarks may be subject to copyright protection as long they fulfil the requirements of copyright law. Consequently, a practical question arises whether a trademark, being a single word or a simple sequence of words, may be protected under copyright law. Such protection entails serious consequences because copyright granted to a creator of a work may later become an obstacle when it comes to the registration of a trademark. It may also constitute grounds for invalidating a trademark already registered. The author examines views of the doctrine and judicial decisions of common courts in the above matters

Mieczysław Kotlarczyk – a Teacher and Artistic Friend of John Paul II

Mieczysław Kotlarczyk played an important role in the life of Pope John Paul II. The spiritual bond between friends born in the same city exerted a significant impact on both their lives and work. And yet it remains unknown to the public, just as Kotlarczyk himself. Raised in a theatre-related family, Kotlarczyk remained affiliated with the theatre throughout his life. This paper presents his life path and the fate of the Rhapsodic Theatre, which Kotlarczyk was managing from 1941, and which operated under the auspices of the “Unia” (“Union”) underground organization. After World War II, despite reprisals from the communist authorities and the subordination to thesecret service, Kotlarczyk tried to continue his activity. In 1953, the Rhapsodic Theatre was liquidated by the authorities. Even though in 1957, as part of the so-called thaw, there was a consent to reactivate the theatre, ten years later however, it was definitely shut down. On the Lawrence–Doniach and Anisotropic Ginzburg–Landau Models for Layered Superconductors

The authors consider two models, the Lawrence-Doniach and the anisotropic Ginzburg-Landau models for layered superconductors such as the recently discovered high-temperature superconductors. A mathematical description of both models is given and existence results for their solution are derived. The authors then relate the two models in the sense that they show that as the layer spacing tends to zero, the Lawrence-Doniach model reduces to the anisotropic Ginzburg- Landau model. Finally, simplified versions of the models are derived that can be used to accurately simulate high-temperature superconductors
