A inversão do contencioso

O tema que nos propomos desenvolver insere-se no âmbito dos procedimentos cautelares e aborda a nova figura da inversão do contencioso que o Código de Processo Civil de 2013 acrescentou. Acompanhando a evolução a que assistimos em sede de Direito Comparado e satisfazendo compromissos europeus, o legislador português, com a inversão do contencioso, consagrou uma verdadeira exceção à regra da instrumentalidade dos procedimentos cautelares em relação à ação judicial principal e definitiva. Como o conseguiu, quais os pressupostos de que fez depender esta figura e quais as consequências processuais e para as partes, é o que nos oferecemos explicar com este trabalho.N/

Este artigo desenvolve-se a partir de uma pesquisa onde se aproximam as perspectivas da arquitetura e o pensar filosófico, debruçadas para compreender os laboratórios de informática como um dos espaços escolares propícios para a educação filosófica. Observa-se a crescente instalação, disponibilidade e utilização de laboratórios de informática como parte do programa da edificação de uso educacional. A revisão bibliográfica, adotada como metodologia, aponta a arquitetura como ferramenta organizacional dos ambientes escolares partindo de condicionantes como dimensionamento e padrões de habitabilidade do espaço físico. Como uma ciência social aplicada, a arquitetura relaciona pessoas, atividades e ambientes, relação que vai além dos aspectos perceptivos e que influencia diretamente na qualidade do desempenho de funções e das vivências. O acompanhamento constante das inovações tecnológicas permite colaborar, cada vez mais, com a educação filosófica, potencializando a formação do ser humano como cidadão

A ANÁLISE CONCETUAL DA PROVA EM PROCESSO CIVIL

Summary This article focuses on a dogmatic reflection on the concept and function of evidence in civil proceedings. To this end, it addresses evidence as the object of instruction as well as a number of problems associated with the burden of proof. This analysis also deals with the dialectics between the burden of proof and the burden of claim. The reflection we propose on the concetual basis of the evidence also covers questions relating to the instructional activity, the value of the evidence, the binding force of the means of proof and its limitations. From the theoretical framework described, it is also fundamental to proceed to the methodological classification of the test, also questioning its extra procedural value, always seeking to find foundations in the principles underlying the instructional activity. Para o efeito, é abordada a prova como objeto da instrução bem como um conjunto de problemáticas associadas ao ónus da prova. Esta análise debruça-se, também, sobre a dialética entre ónus da alegação e ónus da prova. A reflexão a que nos propomos sobre o fundamento concetual da prova perpassa ainda questões relacionadas com a atividade instrutória, o valor da prova, a força vinculativa dos meios de prova e as suas limitações. Análise da produção acadêmica brasileira a respeito do tema “livro didático de biologia e a evolução biológica”

Esta pesquisa, caracterizada como um estudo do tipo “estado da arte”, teve como objetivo analisar a produção acadêmica brasileira de dissertações e teses, defendidas no período de 2008 a 2018, que incluíram como foco de suas investigações o tema “Livro Didático de Biologia e a Evolução Biológica”. Foram identificados sete documentos, levantados em duas bases de dados on-line, cuja seleção ocorreu por meio da leitura de títulos, resumos e palavras-chave, sendo, posteriormente, examinados em sua integralidade. Os resultados encontrados evidenciaram que o tema é pouco explorado, principalmente no que diz respeito a pesquisas de Doutorado e de Mestrado Profissional, com estudos concentrados na Região Sul do Brasil, de forma mais específica no Estado do Rio Grande do Sul. Ficou constatado que a maior parte dos objetivos propostos pelos pesquisadores foi analisar o conteúdo evolutivo presente nos livros didáticos de Biologia e/ou sua forma de abordagem. A maioria dos resultados desses estudos apontou deficiências e limitações na apresentação dos conceitos/conteúdos biológicos encontrados nos livros didáticos investigados

Magnetic, electronic, and structural investigation of the strongly correlated Y1−x_{1-x}Smx_xCo5_5 system

SmCo$_5$ and YCo$_5$ are isostructural compounds both showing large magnetocrystalline anisotropy, where the former originates mainly from the crystal-electric field and magnetic interactions. We investigate the contribution of both interactions by partially substituting Y by Sm in as-cast polycrystalline Y$_{1-x}$Sm$_{x}$Co$_5$ (with $x$=0, 0.1, 0.2, 0.3, and 0.4) and measuring their structural, magnetic, and electrical properties through X-ray diffraction, magnetization, and electrical transport measurements. Our results suggest an interplay between microstructure strain in as-cast samples and the electronic and magnetic interactions

Virginia Woolf, neuroprogression, and bipolar disorder

Family history and traumatic experiences are factors linked to bipolar disorder. It is known that the lifetime risk of bipolar disorder in relatives of a bipolar proband are 5-10% for first degree relatives and 40-70% for monozygotic co-twins. It is also known that patients with early childhood trauma present earlier onset of bipolar disorder, increased number of manic episodes, and more suicide attempts. We have recently reported that childhood trauma partly mediates the effect of family history on bipolar disorder diagnosis. In light of these findings from the scientific literature, we reviewed the work of British writer Virginia Woolf, who allegedly suffered from bipolar disorder. Her disorder was strongly related to her family background. Moreover, Virginia Woolf was sexually molested by her half siblings for nine years. Her bipolar disorder symptoms presented a pernicious course, associated with hospitalizations, suicidal behavioral, and functional impairment. The concept of neuroprogression has been used to explain the clinical deterioration that takes places in a subgroup of bipolar disorder patients. The examination of Virgina Woolf’s biography and art can provide clinicians with important insights about the course of bipolar disorder

Selective separation of manganese, cobalt, and nickel in a fully aqueous system

The continued electrification of society and the related growing demand for rechargeable batteries require in turn the elaboration of efficient and sustainable recycling strategies for their recovery and valorization. An important separation relevant to nickel metal hydride (NiMH) and lithium-ion battery recycling is the intertransition element separation between Ni(II), Co(II), and Mn(II). In this work, a fully aqueous process for the recovery of Mn(II) and Co(II) from concentrated Ni(II) effluents typical of NiMH battery leachate is disclosed consuming only Na2CO3. In the first instance, Mn is selectively precipitated as Mn(IV) by oxidation using ozone as an oxidant, resulting in a significant enrichment of Mn in the precipitate relative to its original solution concentration. Second, a thermo- and acid-responsive aqueous biphasic system (ABS) based on the ionic liquid (IL) tributyltetradecylphosphonium chloride ([P44414]Cl) and NiCl2 was used to recover Co(II). By using the high NiCl2 content found in NiMH leachates both as the ABS phase former and salting-out agent, no additional salt is required. Through careful manipulation of the Co(II) to Ni(II) and the IL to Co(II) molar ratios, an effective and selective separation of Co(II) from Ni(II) was achieved. Finally, Co(II) is precipitated from the IL-rich phase and the IL is regenerated in one step by the addition of Na2CO3 to induce a new phase separation.publishe

Intrapulpal temperature variation during bleaching with various activation mechanisms

OBJECTIVES: The aim of this study was to evaluate the intrapulpal temperature variation after bleaching treatment with 35% hydrogen peroxide using different sources of activation. MATERIAL AND METHODS: Twenty-four human teeth were sectioned in the mesiodistal direction providing 48 specimens, and were divided into 4 groups (n=12): (G1) Control - Bleaching gel without light activation, (G2) Bleaching gel + halogen light, (G3) Bleaching gel + LED, (G4) Bleaching gel + Nd:YAG Laser. The temperatures were recorded using a digital thermometer at 4 time points: before bleaching gel application, 1 min after bleaching gel application, during activation of the bleaching gel, and after the bleaching agent turned from a dark-red into a clear gel. Data were analyzed statistically by the Dunnet's test, ANOVA and Tukey's test (a=0.05). RESULTS: The mean intrapulpal temperature values (ºC) in the groups were: G1: 0.617 ± 0.41; G2: 1.800 ± 0.68; G3: 0.975 ± 0.51; and G4: 4.325 ± 1.09. The mean maximum temperature variation (MTV) values were: 1.5ºC (G1), 2.9ºC (G2), 1.7ºC (G3) and 6.9ºC (G4). UMA ANÁLISE DA FERRAMENTA ALICE NO ENSINO DA LÓGICA DE PROGRAMAÇÃO

O presente artigo avalia a ferramenta Alice como forma de incentivar os alunos a obterem êxito na disciplina de Lógica de Programação nos cursos técnicos de Informática de escolas profissionais do município de Fortaleza. A escolha de tal software educativo se deu pelo fato do ambiente ser de fácil utilização, atraindo o aluno por meio de animações e interações entre personagens e objetos, lembrando muito os jogos de vídeo games, algo presente no cotidiano do aluno. Diante disso, busca-se mostrar se essa ferramenta de fato traz resultados positivos para o ensino de lógica de programação, que é considerada uma disciplina difícil por muitos estudantes. A metodologia utilizada foi a pesquisa descritiva, com análise dos dados feitas com alunos de uma escolha de Fortaleza. Com base nos resultados do trabalho, verificamos que, através do uso da ferramenta Alice, houve uma melhora nas notas dessa disciplina e percebido um grande entusiasmo por essa nova forma de ensinar e de aprender lógica de programação

Abrangência Espacial da Neve em Santa Catarina, Brasil, nos dias 22 e 23 de julho de 2013

Snowfall in Santa Catarina (SC) occurs from April to September with more often in July and August. Eventually, the snow cover is wider and reaches areas where it is not common. This paper aims to substantiate the snow coverage in SC on July 22-23 2013. This analysis is confronted with terrain of SC state. For this, it was used two maps of the Geographic Information System (GYS), showing the cities where had snow and the distribution of these cities relative to terrain. An additional analysis was made using observed and simulated air temperature fields for the period of snowfall. The snow was registered in 126 cities localized in all mesoregions of state. We have found that, with snow coverage of 64 %, including coastal regions, the event on July 22-23 2013 was the more intense and extensive snowfall registered until now.O fenômeno neve em Santa Catarina ocorre entre os meses de abril e setembro, com maior frequência em julho e agosto. Eventualmente, a neve é espacialmente mais abrangente e atinge áreas do Estado que normalmente não registram este fenômeno. Este trabalho tem como objetivo documentar a abrangência do evento de neve ocorrido entre os dias 22 e 23 de julho de 2013. A análise é confrontada com o relevo do Estado. Para tanto, utilizou-se dois mapas do Sistema de Informações Geográficas, mostrado os municípios em que o fenômeno foi observado e a distribuição espacial da neve em relação ao relevo. Uma análise adicional é realizada utilizando campos de temperatura do ar observados e simulados numericamente para o período que efetivamente ocorreu neve. Os resultados mostraram que 126 municípios registraram neve com localização em todas as mesorregiões do Estado. Constata-se que, com a abrangência espacial de 64 %, incluindo a região litorânea, o evento de neve dos dias 22 e 23 de julho de 2013 é o mais intenso e espacialmente abrangente já registrado no Estado de Santa Catarina
