O crédito tributário no processo de insolvência: Análise dos regimes jurídicos português e espanhol
El presente trabajo aborda problemas referentes a la participación de la
Administración Tributaria y al tratamiento del crédito tributario en el contexto del concurso de acreedores y en los
demás procesos de recuperación, en el ámbito de las órdenes jurídicas portuguesa y española.
Analizamos la naturaleza universal del concurso de acreedores y las características del crédito tributario; listamos
algunas cuestiones prácticas concretas resultantes de la articulación de estas temáticas y estudiamos el
tratamiento del crédito tributario en los concursos transfronterizos.
Estudiamos los distintos principios y valores que orientan las dos ramas del Derecho que aquí relevan (concursal y
tributario) y los desafíos que pone su convivencia
O crédito tributário e as obrigações fiscais no processo de insolvência
Dissertação de mestrado em Direito Tributário e FiscalA presente dissertação, intitulada «O Crédito tributário e as obrigações fiscais no
processo de insolvência», visa dirimir alguns dos problemas de articulação de duas
áreas distintas do Direito: Insolvência e Tributário. As relações entre estes dois campos
do Direito merecem reflexão e busca de soluções, de modo a esclarecer questões que –
na prática – se manifestam quotidianamente. Os problemas inerentes ao tratamento do
crédito tributário; a posição da Administração Tributária, enquanto credora, no processo
de insolvência; as principais consequências que a declaração de insolvência provoca nos
atos tributários e processos pendentes de natureza tributária e as questões da
responsabilização pelas dívidas de natureza tributária são, entre outras, questões que a
prática pretende ver respondidas. O problema ganha novos contornos num momento em
que a legislação falimentar será alterada (já aprovada e publicada, encontrando-se em
curso período de vacatio legis) e há uma quase permanente torrente legislativa na área
do Direito Tributário.
Para o efeito, procedemos à análise documental: quer legislativa, quer doutrinal e
jurisprudencial de ambos os mencionados ramos do Direito, visando estabelecer elos de
ligação entre eles e, assim, lograr a obtenção de respostas.
Da pesquisa elaborada foi possível situar os problemas com que inicialmente nos
deparámos, quer ante o nosso ordenamento jurídico, quer ante os demais analisados,
com especial incidência no espanhol. Partindo desse ponto, da realidade, do «ser», foi
então possível chegar ao que, no nosso entendimento, se deverá buscar, ao «dever ser»
desejado, e no caminho do qual a construção da relação entre o Direitos da Insolvência e
Tributário deverá ser perspectivada e erigida.
Pese embora haja uma evolução positiva nestas matérias – e que a iminente
alteração legislativa cuidará de reforçar – há, ainda, e continuarão a subsistir, muitas
questões nebulosas a imporem clarificação e esclarecimento, não só por razões de
certeza e segurança jurídica mas, também, visando a total transparência do processo
insolvencial e dos processos e procedimentos de natureza tributária. É para a resolução
de todas as questões que a articulação prática destas matérias coloca que o presente
estudo contribui.This dissertation, «Tax credit and tax obligations in insolvency proceedings»,
aims to resolve some of the problems derived from the articulation of two distinct areas
of Law: Insolvency and Tax. The relations between these two types of
law merit reflection and a search for solutions in order to clarify some issues that appear
in daily practice. The problems relating to the processing of tax credit; the position of
the Tax Administration, as a creditor in insolvency proceedings; the main consequences
of a declaration of insolvency for tax acts and pending tax proceedings and the question
of liability for tax debts are, among others, some issues that need to be addressed. The
problem assumes a new dimension since current insolvency legislation will soon be
modified (the text of the Law has already been approved and published, and will soon
be implemented) and there is almost permanent legislative revision to the said Tax Law.
Hence, we researched documentation, such as: legal texts, legal doctrine and
judicial decisions from both Law branches, in order to establish connections between
them and, thereby, attain some answers.
As a result of our study, we managed to provide a framework for the problems we
had previously described, both in Portuguese and other systems of Law from abroad,
particularly Spanish. From there, we were able to ascertain realized what measures
should be taken in order to make the system evolve from the existing «as is» to the
desired «should be».
Even though there has been positive development in these subjects – reinforced by
the recent law modifications that will soon be implemented – there are, and will persist,
many cloudy questions requiring clarification, not only because of the need for Legal
certainty but, also, in order to attain full transparency in insolvency processes and in the
tax processes and proceedings. This work contributes to answer those remaining
questions
Juventudes partidárias portuguesas : que visão sobre o desenvolvimento global?
O ponto de partida da nossa reflexão passou pela dúvida em relação ao conhecimento aprofundado dos/as jovens portugueses relativamente às temáticas Globais e aos paradigmas que vêm sendo dominantes na última década: qual o grau de participação e mobilização dos/as jovens portugueses/as para as temáticas da Cooperação Internacional? Qual o seu papel enquanto Agentes na mobilização e na advocacia junto dos/as nossos/as decisores/as políticos/as?. Sabemos que, ao longo dos anos, a distância entre as intenções e os Tratados Internacionais e Declarações globais de princípios colide com as prioridades nacionais e a vontade dos Estados. A retórica política está muitas vezes a milhas da ação política real e de interesses privados. Por isso, procurámos envolver nesta pesquisa aqueles/as jovens que, já tendo responsabilidades representativas no sistema partidário, terão provavelmente no futuro responsabilidades governativas ou legislativas. Kinesiology tape increases muscle tone, stiffness, and elasticity: Effects of the direction of tape application
The claim that the effects of kinesiology tape are different depending on the direction of tape application needs to be clearly ascertained. This study aimed to determine the immediate effects of two forearm kinesiology tape applications on muscle tone, stiffness, and elasticity of young individuals. Thirty-nine participants (15 men and 24 women) were randomized (1:1:1) to: the facilitatory group, receiving kinesiology tape applied from origin to insertion; the inhibitory group, receiving kinesiology tape applied from insertion to origin; or, a control group, without any intervention. The mechanical properties – tone, elasticity, and stiffness – of the forearm muscles were measured with a handheld mechanical impulse-based myotonometric device before and 30 min after the kinesiology tape application. Only the application of kinesiology tape from origin to insertion significantly increased muscle tone [16.6 (2.5) to 17.4 (3.5) Hz, p = 0.036], stiffness [318.3 (52) to 355.0 (87) N/m, p = 0.004], and elasticity [0.98 (0.1) to 1.10 (0.1), p = 0.023]. No changes were observed in both inhibitory kinesiology tape and the control group. In conclusion, kinesiology tape application has different effects depending on the direction of the taping application. Evaluating the environmental impact of two beef production systems using life cycle assessment
Beef production has been identified as an important source of environmental impacts. Life Cycle Assessment (LCA) has been applied worldwide to identify key processes/phases for environmental improvement in beef production. In this study, LCA is used to assess the environmental impacts of beef produced in two different production systems, namely extensive and intensive fattening. A “cradle-to-gate” approach is adopted and the functional unit is 1 kg of beef carcass weight at the farm gate. The results show that the environmental “hot spots” are related with feed production and on-farm related emissions in both systems. The results also suggest that the use of extensive production during the fattening stage has lower environmental impacts per kg of carcass. Efeito do peso para membros inferiores no equilíbrio estático e dinâmico nos portadores de ataxia
The object of this research was to evaluate the effect of ataxia sufferers using weights on the lower members while walking. It is believed that weights on lower members benefits the gait quality of ataxia patients, altering the motor programming and neural connections in the cerebellum that are alterable in motor learning. Twentyone individuals were randomly divided into two groups: with weights (GP n=10) and without weights (SP n=11). Everyone did 20 sessions of physiotherapy and were evaluated before (first evaluation), after treatment (second evaluation), and after 30 days (third evaluation), by means of the Berg Balance, Dynamic Gait Index, Equiscale, Inter-national Cooperative Ataxia Rating Scale, Functional Independence Measure. The ANOVA analysis was used for repeated measurements to compare the evolution of variables over time, with a significance the GP individuals managed better results with balance, coordination, and functional independence than those without weights. The GP group managed to maintain the benefit from the first through third evaluations on all scales except the DGI. The study proved the effectiveness of weights in improving the static and dynamic balance, the gait coordination, and functional independence.O objetivo da pesquisa foi avaliar o efeito do uso do peso em membros inferiores durante a marcha, nos indivíduos com ataxia. Acredita-se que o peso em membros inferiores traz benefícios na qualidade da marcha nos pacientes atáxicos, alterando a programação motora e conexões neurais cerebelares que são possíveis de alterações na aprendizagem motora. Divididos aleatoriamente, 21 indivíduos em 2 grupos: com peso (GP n=10) e sem peso (SP n=11). Todos realizaram 20 sessões de fisioterapia, avaliados antes (primeira avaliação), depois do tratamento (segunda) e após 30 dias (terceira), através das escalas de Equilíbrio de Berg, Dynamic Gait Index, Equiscale, International Cooperative Ataxia Rating Scale e Medida de Independência Funcional. Foi utilizada a análise ANOVA para medidas repetidas para comparar a evolução das variáveis ao longo do tempo, com nível de significância p≤ 0.05. Os indivíduos do GP conseguiram melhores resultados após o tratamento quanto ao equilíbrio, coordenação e independência funcional comparados ao SP, sendo estatisticamente significantes. O GP conseguiu manter o ganho da primeira para a terceira avaliação demonstrada por quase todas as escalas, exceto a DGI. Análise de Textura de Dados Orbitais Spot 5 para Produção de Cartografia de Ocupação do Solo sobre a Área Metropolitana de Lisboa
Neste trabalho defende-se que a integração da análise de textura na classificação de imagens poderá contribuir para o aumento da precisão temática, diminuindo a problemática da variabilidade espectral, característica de áreas muito heterogéneas como as áreas metropolitanas. A metodologia desenvolvida foi aplicada a duas cenas SPOT 5 de 2004 da Grande Área Metropolitana de Lisboa (GAML).
Numa primeira fase, classificaram-se as imagens com base nos seguintes algoritmos: Parallelepiped, Minimum Distance, Mahalanobis Distance, Maximum Likelihood, Spectral Angle Mapper, Binary Encoding e Neural Net. Retirando de cada classificador o melhor resultado em cada classe foi possível construir dois mapas pré-finais, nomeadamente: não urbano e urbano. A este último foi ainda aplicada a análise de textura na correcção de erros na classe residencial. Numa segunda fase aplicaram-se as seguintes transformações às quatro bandas do sensor HRG: Minimum Noise Transform, Spectral Unmixing, Mixture Tuned Matched e Filtering. Esta etapa permitiu a construção de máscaras para as diferentes classes das áreas edificadas..
A análise de textura produziu, entre a primeira e a segunda fases, um aumento global da exactidão temática das classificações, nomeadamente no classificador Maximum Likelihood (imagem Norte = 73%, imagem Sul = 76%), para cerca de 80% na cartografia final. Cancer cells’ metabolism dynamics in renal cell carcinoma patients’ outcome: influence of GLUT-1-Related hsa-miR-144 and hsa-miR-186
The cancer cells’ metabolism is altered due to deregulation of key proteins, including glucose transporter 1 (GLUT-1), whose mRNA levels are influenced by microRNAs (miRNAs). Renal cell carcinoma (RCC) is the most common and lethal neoplasia in the adult kidney, mostly due to the lack of accurate diagnosis and follow-up biomarkers. Being a metabolic associated cancer, this study aimed to understand the hsa-miR-144-5p and hsa-miR-186-3p’s potential as biomarkers of clear cell RCC (ccRCC), establishing their role in its glycolysis status. Using three ccRCC lines, the intra- and extracellular levels of both miRNAs, GLUT-1’s mRNA expression and protein levels were assessed. Glucose consumption and lactate production were evaluated as glycolysis markers. A decrease of intracellular levels of these miRNAs and increase of their excretion was observed, associated with an increase of GLUT-1’s levels and glycolysis’ markers. Through a liquid biopsy approach, we found that RCC patients present higher plasmatic levels of hsa-miR-186-3p than healthy individuals. The Hsa-miR144-5p’s higher levels were associated with early clinical stages. When patients were stratified according to miRNAs plasmatic levels, low plasmatic levels of hsa-miR-144-5p and high plasmatic levels of hsa-miR-186-3p (high-risk group) showed the worst overall survival. HERA - Environmental Risk Assessment of a contaminated estuarine environment: a case study
Sado River estuary is located in the west coast of Portugal. Previous environmental studies identified industrial contamination, non-point anthropogenic sources and contamination coming from the river, all promoting accumulation of polluted sediments with known impacts on the ecological system. Surrounding human populations have intense economic fishery activities. Together with agriculture, estuary fishing products are available to local residents. Food usage previously characterized through ethnographic studies suggests exposure to estuarine products, farming products, and water in daily activities, as potential routes of contamination.
