    Controle judicial do ato administrativo discricionário à luz da juridicidade dos princípios constitucionais

    A Atividade Administrativa,enquanto exercício da função pública atribuída ao Estado,está sujeita a controle. Esse controle,quando efetuado pelo Judiciário, deverá se restringir a análise da legalidade do ato. Esse,pois, não pode invadir o seu mérito,que se pauta por critérios de conveniência e oportunidade do administrador,sob pena de o Magistrado estar invadindo a esfera da competência do poder Executivo. Todavia,o principio da legalidade ,que pauta e controla a administração pública,teve seu conteúdo jurídico ampliado. Esse principio,que antes entendido como sujeição à lei no sentido formal,passou a ser entendido como obediência à lei,aos princípios e a todo o ordenamento jurídico. Essa alteração do princípio da legalidade,deve-se ao fato de que os princípios passaram a ter força e coercitividade,passando a integrar o ordenamento jurídico com verdadeiro status de norma. Em razão disso,o controle do ato discricionário,que embora não se possa adentrar no mérito,deverá ser controlado no aspecto da legalidade entendida em sentido amplo. Dessa forma,atos desproporcionais,desarrazoados ou de qualquer outra natureza que ofenda algum principio,será considerado ilegal. Podendo portanto,ser anulado pelo Poder Judiciário

    ESTIMATION OF OPTICALLY ACTIVE CONSTITUENTS OF WATER BY REMOTE ORBITAL SENSING

    The objective of this study was to evaluate the potential use of LISS-III / Resourcesat-1 images in the estimation of optically active constituents of water in the Passo Real reservoir. With the satellite images used for the analysis of the water reflectance, it was possible to extract information in pixels with spatial resolution of 23.5 meters. The selection of images was made from the availability of scenes without clouds at the closers days to the field work. The processing of the images to correct the atmospheric effects and the transformation of the digital numbers into reflectance values were performed in the software ENVI 5.0 limnological data spatialization obtained in situ were carried out by interpolation in the software Spring 4.3.3 and the spatializations of the data estimated by satellite were generated by slicing the image generated by the insertion of equations obtained in the models. From the available data set it was possible to produce models capable of estimating total suspended solids, turbidity and water transparency with only a single spectral band, band 3 (620 to 680 nm) of the LISS-III / Resourcesat-1. With the application of the spectral band ratio technique, it was possible to generate a model to estimate the chlorophyll-a concentration

    ESCOLHAS CONTÁBEIS NO MERCADO SEGURADOR: UM ESTUDO SOBRE A CLASSIFICAÇÃO CONTÁBIL DO CUSTO DE COMERCIALIZAÇÃO DIFERIDO

    O presente estudo avalia o gerenciamento da informação contábil no mercado segurador brasileiro. Mais especificamente, analisa os determinantes da escolha do registro contábil do Custo de Comercialização Diferido, buscando responder a seguinte pergunta: as seguradoras fazem escolhas contábeis na classificação dos Custos de Aquisição Diferidos (CAD) para atingirem níveis mínimos de solvência. Tal classificação, está diretamente relacionada ao cálculo de indicadores de insolvência do setor. Desta forma, as seguradoras com baixos níveis de solvência teriam incentivo de fazer escolhas contábeis que influenciasse na manutenção dos seus indicadores, pelo menos, nos níveis mínimos exigidos pelo órgão regulador. Para realização da pesquisa foram utilizados dados do sistema de estatísticas do órgão regulador, e demonstrações financeiras das empresas do mercado de seguros nacional, no período de 2013 a 2015. Os resultados são consistentes com o fato de as seguradoras fazerem escolhas contábeis com objetivo de atingir indicadores mínimos de solvência

    USO E COBERTURA DA TERRA EM FUNÇÃO DAS DECLIVIDADES DO TERRENO DA ÁREA DE CAPTAÇÃO DO RESERVATÓRIO ERNESTINA-RS

    O objetivo do presente trabalho foi avaliar os usos e cobertura da terra em função das declividades do terreno na área de captação do reservatório Ernestina - RS. De forma complementar avaliou-se as Áreas de Preservação Permanente nas margens dos principais canais fluviais e nas encostas de morros, conforme o Código Florestal vigente. A área de estudo foi subdividida em setores que englobam os principais tributários do reservatório Ernestina para fins de avaliações comparativas entre os mesmos. Para as avaliações dos usos e cobertura da terra em função das declividades do terreno foi realizada a Álgebra de mapas, sendo as declividades associadas a classificações de escoamento superficial das águas pluviais e de formas de relevo. As áreas de preservação permanente nas margens dos rios e do reservatório Ernestina foram avaliadas em buffers seguindo as designações do Código Florestal. Os resultados demonstraram que o uso da terra na área de estudo é predominantemente agrícola sobre terrenos com declividades que caracterizam relevos suaves/ondulados a ondulados, sujeitos a escoamentos superficiais de lentos a rápidos. No entanto, entre nos setores avaliados ocorrem variações de declividades, que provavelmente influenciaram para maior ou menor exploração das terras pela agricultura temporária, inclusive em áreas de preservação permanente

    Association between tumor-infiltrating limphocytes and sentinel lymph node positivity in thin melanoma

    Abstract: Background: Sentinel lymph node biopsy in thin invasive primary cutaneous melanoma (up to 1mm thick) is a controversial subject. The presence of tumor-infiltrating lymphocytes could be a factor to be considered in the decision to perform this procedure. Objective: To evaluate the association between the presence of tumor-infiltrating lymphocytes and lymph node metastases caused by thin primary cutaneous melanoma. Methods: Cross-sectional study with 137 records of thin invasive primary cutaneous melanoma submitted to sentinel lymph node biopsy from 2003 to 2015. The clinical variables considered were age, sex and topography of the lesion. The histopathological variables assessed were: tumor-infiltrating lymphocytes, melanoma subtype, Breslow thickness, Clark levels, number of mitoses per mm², ulceration, regression and satellitosis. Univariate analyzes and logistic regression tests were performed as well the odds ratio and statistical relevance was considered when p <0.05. Results: Among the 137 cases of thin primary cutaneous melanoma submitted to sentinel lymph node biopsy, 10 (7.3%) had metastatic involvement. Ulceration on histopathology was positively associated with the presence of metastatic lymph node, with odds ratio =12.8 (2.77-59.4 95% CI, p=0.001). The presence of moderate/marked tumor-infiltrating lymphocytes was shown to be a protective factor for the presence of metastatic lymph node, with OR=0.20 (0.05-0.72 95% CI, p=0.014). The other variables - clinical and histopathological - were not associated with the outcome. Study limitations: The relatively small number of positive sentinel lymph node biopsy may explain such an expressive association of ulceration with metastatization. Conclusions: In patients with thin invasive primary cutaneous melanoma, few or absent tumor-infiltrating lymphocytes, as well as ulceration, represent independent risk factors for lymph node metastasis

    Adolescentes en la escuela: grupos de reflexión para pensar en la práctica de la ciudadanía

    Este informe de experiencia titulado “Adolescentes en la escuela: grupos de reflexión para pensar en la práctica de la ciudadanía” se caracterizó como una investigación-acción y busca mostrar y discutir el proceso de un grupo de reflexión con adolescentes, como una alternativa de intervención, destinada a estimular el ejercicio de la ciudadanía activa en la escuela y en otros ámbitos de la vida cotidiana. El estudio se realizó en 2019, con alumnos y alumnas de secundaria cuyas edades oscilaban entre los 14 y 17 años, en una escuela pública de una ciudad situada en el interior del Estado de São Paulo/ Brasil. Se estructuraron cinco grupos con un máximo de 20 alumnos/alumnas, que se inscribieron voluntariamente, y fueron dirigidos por dos facilitadores del área de la psicología. Los encuentros tuvieron lugar en el espacio y horario escolar, una vez a la semana, sumando un total de 14 encuentros a lo largo del segundo semestre. En este informe se describe la experiencia de un único grupo en el que se debatieron temas sobre las humanidades y sus retos como el autoconocimiento, el papel de la escuela en la sociedad, las relaciones familiares, la salud, las relaciones de género, la desigualdad, el racismo y la injusticia. Los temas, propuestos por el propio alumnado, provocaron y favorecieron la articulación de nuevos conocimientos sobre las dificultades diarias permitiendo la aplicación del aprendizaje en la escuela y en otros contextos.// This experience report titled as “Teenagers at school: reflection groups upon the practice of citizenship” was characterized by a research-action and it seeks to demonstrate and to discuss the process of a think tank with adolescents as an interventionist alternative. This work is presented with the goal to encourage the exercise of an active citizenship at school and in other fields of the daily life. The study was carried out in 2019, with high school students of both sexes and with ages between 14 and 17 years, and took place in a public school in a city located in the interior of the State of São Paulo/Brazil. Five groups were structured and composed by a maximum of twenty students, who signed up voluntarily and were mediated by two facilitators that derived from the Psychology field. In this report we will describe the experience of a single group which topics about humanities and its challenges were discussed, such as self-knowledge, the role of school in society, family relations, health, gender relations, inequality, racism, injustice. The themes proposed by the students themselves provoked and favored the articulation of new knowledge about daily difficulties, enabling the application of learning at school and in another context

    Modal Analysis of Surface Plasmon Resonance Sensor Coupled to Periodic Array of Core-Shell Metallic Nanoparticles

    The influence of a dielectric shell on metallic spherical nanoparticles [core-shell nanoparticles (CSNps)] in the resonant modal response of a surface plasmon resonance (SPR)-type sensor is presented. The planar multilayer sensor structure, based on the Kretschmann and surface plasmon coupled emission (SPCE) configurations, is coupled to a periodic array of these nanoparticles. In the first configuration, the CSNps are considered as a homogeneous layer with effective permittivity given by the Clausius-Mossotti mixing formula and polarizability of a core shell for a quasi-static scattering regime. In the second configuration, it performed an evaluation via the discrete complex image method (DCIM). Electromagnetic wave propagation is evaluated by the generalized reflection coefficient for multilayer structures. The analytical results are validated by numerical simulations performed via finite element method and also by experimental data. We observed that the dielectric shell thickness affects considerably the sensibility of the sensor when analyzing the change in other parameters of the CSNps array

    Is the total mixed ration the best option for feeding crossbred dairy cows using diets based on cactus cladodes on family farms?

    The study aimed to evaluate the effects on the performance of lactating cows of different strategies for supplying diets based on cactus cladodes. Eight Girolando cows at 97 ?? 7.6 days into lactation, producing 12.2 ?? 0.26 kg milk/day, were assigned to 4 treatments in two 4 ?? 4 Latin squares. The feeding strategies were: total mixed ration (TMR) based on a mixture of concentrates, cactus cladodes [Opuntia stricta (Haw.) Haw.] and sugarcane (Saccharum officinarum L.) fed after milking; concentrate fed during milking with cactus cladodes and sugarcane offered later (Con/CC+SC); cactus cladodes combined with concentrate fed after milking with sugarcane offered later (CC+Con/SC); and sugarcane combined with concentrate fed after milking with cactus cladodes offered later (SC+Con/CC). Intakes of neutral detergent fiber (NDF; 4.54 ?? 0.09 kg/d) and total digestible nutrients (TDN; 9.30 ?? 0.50 kg/d) were similar (P>0.05) for all feeding strategies and there was no effect of feeding strategy on milk yield (12.2 ?? 0.26 kg/d). The different feeding strategies did not change the ingestive behavior or performance of lactating Girolando cows. Since the shortage of labor prohibits the feeding of TMRs on family farms because of labor required for preparation, these rations would be appropriate only on large farms where the costs of machines to prepare diets efficiently might be available. Cows fed concentrate during milking spent longer to consume the concentrate than the time to milk, resulting in inefficient usage of scarce labor. Appropriate feeding strategies for family farms appear to be SC+Con/CC and CC+Con/SC, i.e. partial separation of dietary ingredients, and all feeding should be done after milking
