Las relaciones entre el Tribunal Constitucional y el Tribunal Supremo: ¿un conflicto permanente?

El presente trabajo tiene por objeto dar cuenta de los problemas que genera la dualidad de jurisdicciones. Concretamente y por lo que respecta al caso español, se repasan los episodios conflictivos que han tenido lugar entre el Tribunal Constitucional y el Tribunal Supremo. Asimismo, se analizan las causas generadoras de esta situación y se ve en la reforma del amparo llevada a cabo por la Ley Orgánica 6/2007, de 24 de mayo, una posible salida a esta situación de conflicto, normalizando las relaciones entre TS y TC.The present work aims to account for the problems generated by the existence of two jurisdictions. Specifically and as regards the Spanish case, the conflicting episodes that have taken place between the Supreme Court and Constitutional Court are reviewed. Likewise, the causes generating this situation are analyzed and it is seen in the reform of the amparo carried out by the Organic Law 6/2007, of May 24, a possible solution to this situation of conflict, normalizing the relations between TS and TC

A judicialização das políticas públicas de saúde fornecimento de medicamentos

Trata-se de monografia que tem por objetivo examinar a questão do fornecimento de medicamentos pela via judiciária, tendo em vista a relevância e o impacto desse posicionamento ante o planejamento financeiro, e conseqüente execução orçamentária, ao qual o Estado brasileiro se submete, conforme prevê a legislação econômico-financeira vigente. Para tanto, inicia-se o trabalho com uma elucidação acerca do Estado Democrático de Direito, vivido pela República Federativa do Brasil, direitos, princípios e objetivos são elencados e esclarecidos de modo a formarem o pano de fundo que permeará os capítulos subseqüentes. Por conseguinte, necessário se faz voltar as atenções para o planejamento da ação governamental, meio pelo qual o Estado coloca, ao menos tenta colocar, em prática os preceitos constantes na Constituição. Em seguida, identifica-se como as políticas públicas de saúde, especificamente quanto ao fornecimento de medicamentos, foram concebidas, como se encaixam nesse contexto político-social, como têm superado, ou não, os problemas oriundos da escassez de recursos por parte da União, Estados, Municípios e Distrito Federal, e quais os impactos das condenações nas políticas de medicamentos. Por fim, faz-se uma análise do que efetivamente vem a ser a judicialização das políticas públicas, abordando aspectos de justiça dentro do contexto da saúde

Manometria esofàgica amb microtransductors. Experiència en 817 exploracions

El sistema dels microtransductors intraluminals per estudi de la motilitat esofàgica no és gaire popular en el nostre medi; les crítiques més freqüents són la seva fragilitat i l'elevat valor econòmic. L'objectiu d'aquest treball és revisar l'experiència en manometria esofàgica amb microtransductors del nostre hospital durant 10 anys. S'han realitzat 817 exploracions. La indicació més freqüent ha estat el reflux en 312 casos. Altres indicacions son la disfàgia i el control post-terapèutic. En 22 casos es va confirmar la sospita d'afectació esofàgica per malaltia neuromuscular. Pensem que la manometria esofàgica és poc rendible en el reflux gastro-esofàgic si la clínica és clara ja que hi ha una forta correspondència. La indicació prínceps és la disfàgia. Degut a la seva elevada sensibilitat de resposta és el mètode més adequat per estudiar la zona faringo-esofàgica i els estudis del dolor toràcic

Marrow aplasia during high dose mebendazole treatment

A patient with chronic liver disease was treated with large doses of mebendazole for a hepatic hydatid cyst. Eighteen days after beginning treatment he developed marrow aplasia which reverted to normal after the drug was stopped. This is the sixth patient described as developing marrow aplasia when treated with large doses of mebendazole. We suggest that the aplasia is related to the dose of the drug, and that the patient's chronic liver disease was an important factor in its genesis. Patients treated with large doses of mebendazole should have their blood counts monitored during treatment

X chromosome inactivation does not necessarily determine the severity of the phenotype in Rett syndrome patients

Since the MECP2 gene is located on the X chromosome, X chromosome inactivation (XCI) could play a role in the wide range of phenotypic variation of RTT patients; however, classical methylation-based protocols to evaluate XCI could not determine whether the preferentially inactivated X chromosome carried the mutant or the wild-type allele. Therefore, we developed an allele-specific methylation-based assay to evaluate methylation at the loci of several recurrent MECP2 mutations. We analyzed the XCI patterns in the blood of 174 RTT patients, but we did not find a clear correlation between XCI and the clinical presentation. We also compared XCI in blood and brain cortex samples of two patients and found differences between XCI patterns in these tissues. However, RTT mainly being a neurological disease complicates the establishment of a correlation between the XCI in blood and the clinical presentation of the patients. Furthermore, we analyzed MECP2 transcript levels and found differences from the expected levels according to XCI.
