    Potential persons and the welfare of the (potential) child test

    This paper considers the theoretical basis of ‘the welfare of the child’ as it exists in the Human Fertilisation and Embryology Act 1990 (as amended by the 2008 Act of the same name). It will be argued that potential persons, that is persons who do not yet exist, have no claims, interests or standing that can restrict the actions of actual persons. This claim will be based upon the necessity of existence before things can be said to affect a person. As persons are the subject for whom good and bad apply, actions which establish the pre-conditions for their existence cannot be subjected to considerations of the effect on the potential person. This is because potential persons are not affected by actions, but are the consequence of actions. Prospective parents, for example, should not be prohibited from having disabled offspring on the basis of the effect on the child, as different decisions relating to that child will change which persons exist, and thus the necessary pre-conditions for value will change. Based upon this logical framework it will be argued that only the interests of actual persons can constrain the actions of those involved in reproduction. Thus, the Human Fertilisation and Embryology Act’s formulation of the welfare test must be repealed and only the interests of prospective parents and other actually existing people should be capable of constraining reproduction

    Applying the actual/potential person distinction to reproductive torts

    As technology has advanced, the level of control that can be exercised over the reproductive process has increased. These advances have resulted in a number of claims in tort law relating to pregnancy and birth. The three reproductive torts considered here are ‘wrongful conception’, ‘wrongful birth’ and ‘wrongful life’. This article will consider the theoretical underpinnings upon which these torts rest and will suggest that the potential/actual person distinction is crucial to these reproductive torts because potential persons should not be able to make claims in tort based on alternative conditions that could never have been. This is because actions (or omissions) prior to birth determine the preconditions for existence. Thus, only actual persons (i.e. those who exist at the time of the action or omission) should be able to bring claims in tort. The analysis will conclude by arguing that no child should be permitted to bring a claim under any form of reproductive tort. The term reproductive torts originates with Nicolette Priaulx's work and encompasses all three terms: wrongful life, wrongful birth and wrongful conception. While these are distinct terms and all fall within negligence for the purposes of this analysis ‘reproductive torts’ is a useful term to identify these particular claims

    R v BM: Errors in the Judicial Interpretation of Body Modification

    R v BM is the latest case to consider the exceptions to Offences Against the Person Act 1861 (OAPA). The exceptions allow an action causing injury that would be a criminal offence to become lawful if the person injured consents to the action. The outcome of this judgement is that body modifications are categorised as medical procedures (and therefore subject to the medical exception only) and new exceptions should not be developed on a case by case basis, instead allocating development of the exceptions to Parliament. Two implications follow from the BM judgement. First, it provided a limited definition of body modifications which are now categorised as medical procedures. Second, their Lordships have restricted further development of the lawful exceptions to offences against the person. This is a lost opportuni-ty for developing the common law exceptions to the OAPA through an autonomy-based lib-eral judicial interpretation

    Bosonic Excitations in Random Media

    We consider classical normal modes and non-interacting bosonic excitations in disordered systems. We emphasise generic aspects of such problems and parallels with disordered, non-interacting systems of fermions, and discuss in particular the relevance for bosonic excitations of symmetry classes known in the fermionic context. We also stress important differences between bosonic and fermionic problems. One of these follows from the fact that ground state stability of a system requires all bosonic excitation energy levels to be positive, while stability in systems of non-interacting fermions is ensured by the exclusion principle, whatever the single-particle energies. As a consequence, simple models of uncorrelated disorder are less useful for bosonic systems than for fermionic ones, and it is generally important to study the excitation spectrum in conjunction with the problem of constructing a disorder-dependent ground state: we show how a mapping to an operator with chiral symmetry provides a useful tool for doing this. A second difference involves the distinction for bosonic systems between excitations which are Goldstone modes and those which are not. In the case of Goldstone modes we review established results illustrating the fact that disorder decouples from excitations in the low frequency limit, above a critical dimension dcd_c, which in different circumstances takes the values dc=2d_c=2 and dc=0d_c=0. For bosonic excitations which are not Goldstone modes, we argue that an excitation density varying with frequency as ρ(ω)ω4\rho(\omega) \propto \omega^4 is a universal feature in systems with ground states that depend on the disorder realisation. We illustrate our conclusions with extensive analytical and some numerical calculations for a variety of models in one dimension

    Furthering alternative cultures of valuation in higher education research

    The value of higher education is often implicit or assumed in educational research. The underlying and antecedent premises that shape and influence debates about value remain unchallenged which perpetuates the dominant, but limiting, terms of the debate and fosters reductionism. I proceed on the premise that analyses of value are not self–supporting or self-referential but are embedded within prevailing cultures of valuation. I contend that challenging, and providing alternatives to, dominant narratives of higher education requires an appreciation of those cultures. I therefore highlight some of the existing cultures of valuation and their influence. I then propose Sayer’s concept of lay normativity as a culture of valuation and discuss how it translates into the practices of research into higher education, specifically the practice of analysis. I animate the discussion by detecting the presence of lay normativity in the evaluative space of the capability approach

    Systematic review of wastewater surveillance of antimicrobial resistance in human populations

    Objectives: We systematically reviewed studies using wastewater for AMR surveillance in human populations, to determine: (i) evidence of concordance between wastewater-human AMR prevalence estimates, and (ii) methodological approaches which optimised identifying such an association, and which could be recommended as standard. We used Lin’s concordance correlation coefficient (CCC) to quantify concordance between AMR prevalence estimates in wastewater and human compartments (where CCC = 1 reflects perfect concordance), and logistic regression to identify study features (e.g. sampling methods) associated with high agreement studies (defined as >70% of within-study wastewater-human AMR prevalence comparisons within ±10%). Results: Of 8,867 records and 441 full-text methods reviewed, 33 studies were included. AMR prevalence data was extractable from 24 studies conducting phenotypic-only (n = 7), genotypic-only (n = 1) or combined (n = 16) AMR detection. Overall concordance of wastewater-human AMR prevalence estimates was reasonably high for both phenotypic (CCC = 0.85 [95% CI 0.8–0.89]) and genotypic approaches (CCC = 0.88 (95% CI 0.84–0.9)) despite diverse study designs, bacterial species investigated and phenotypic/genotypic targets. No significant relationships between methodological approaches and high agreement studies were identified using logistic regression; however, this was limited by inconsistent reporting of study features, significant heterogeneity in approaches and limited sample size. Based on a secondary, descriptive synthesis, studies conducting composite sampling of wastewater influent, longitudinal sampling >12 months, and time-/location-matched sampling of wastewater and human compartments generally had higher agreement. Conclusion: Wastewater-based surveillance of AMR appears promising, with high overall concordance between wastewater and human AMR prevalence estimates in studies irrespective of heterogenous approaches. However, our review suggests future work would benefit from: time-/location-matched sampling of wastewater and human populations, composite sampling of influent, and sampling >12 months for longitudinal studies. Further research and clear and consistent reporting of study methods is required to identify optimal practice

    Longitudinal double-spin asymmetry and cross section for inclusive neutral pion production at midrapidity in polarized proton collisions at sqrt(s) = 200 GeV

    We report a measurement of the longitudinal double-spin asymmetry A_LL and the differential cross section for inclusive Pi0 production at midrapidity in polarized proton collisions at sqrt(s) = 200 GeV. The cross section was measured over a transverse momentum range of 1 < p_T < 17 GeV/c and found to be in good agreement with a next-to-leading order perturbative QCD calculation. The longitudinal double-spin asymmetry was measured in the range of 3.7 < p_T < 11 GeV/c and excludes a maximal positive gluon polarization in the proton.     High pTp_{T} non-photonic electron production in pp+pp collisions at s\sqrt{s} = 200 GeV

    We present the measurement of non-photonic electron production at high transverse momentum (pT>p_T > 2.5 GeV/cc) in pp + pp collisions at s\sqrt{s} = 200 GeV using data recorded during 2005 and 2008 by the STAR experiment at the Relativistic Heavy Ion Collider (RHIC). The measured cross-sections from the two runs are consistent with each other despite a large difference in photonic background levels due to different detector configurations. We compare the measured non-photonic electron cross-sections with previously published RHIC data and pQCD calculations. Using the relative contributions of B and D mesons to non-photonic electrons, we determine the integrated cross sections of electrons (e++e2\frac{e^++e^-}{2}) at 3 GeV/c<pT< c < p_T <~10 GeV/cc from bottom and charm meson decays to be dσ(Be)+(BDe)dyeye=0{d\sigma_{(B\to e)+(B\to D \to e)} \over dy_e}|_{y_e=0} = 4.0±0.5\pm0.5({\rm stat.})±1.1\pm1.1({\rm syst.}) nb and dσDedyeye=0{d\sigma_{D\to e} \over dy_e}|_{y_e=0} = 6.2±0.7\pm0.7({\rm stat.})±1.5\pm1.5({\rm syst.}) nb, respectively.Comment: 17 pages, 17 figure

    Evolution of the differential transverse momentum correlation function with centrality in Au+Au collisions at sNN=200\sqrt{s_{NN}} = 200 GeV

    We present first measurements of the evolution of the differential transverse momentum correlation function, {\it C}, with collision centrality in Au+Au interactions at sNN=200\sqrt{s_{NN}} = 200 GeV. {\it C} exhibits a strong dependence on collision centrality that is qualitatively similar to that of number correlations previously reported. We use the observed longitudinal broadening of the near-side peak of {\it C} with increasing centrality to estimate the ratio of the shear viscosity to entropy density, η/s\eta/s, of the matter formed in central Au+Au interactions. We obtain an upper limit estimate of η/s\eta/s that suggests that the produced medium has a small viscosity per unit entropy.Comment: 7 pages, 4 figures, STAR paper published in Phys. Lett.
