    Juvenile Life Without Parole in North Carolina

    Life without parole (LWOP) is “an especially harsh punishment for a juvenile,” as the U.S. Supreme Court noted in Graham v. Florida. The United States is the only country in the world that imposes juvenile life without parole (JLWOP) sentences. Many of these individuals were sentenced during a surge in LWOP sentencing in the 1990s. In the past decade, following several Supreme Court rulings eliminating mandatory sentences of LWOP for juvenile offenders, such sentencing has declined. This Article aims to empirically assess the rise and then the fall in JLWOP sentencing in a leading sentencing state, North Carolina, to better understand these trends and their implications. We examine the cases of ninety-four North Carolina juveniles, aged thirteen to seventeen at the time of their offenses, who were sentenced to JLWOP. Of those, forty-nine are currently serving LWOP sentences. In North Carolina, JLWOP sentencing has markedly declined. Since 2011, there have been only five of such sentences. Of the group of ninety-four juvenile offenders, forty-four have so far been resentenced to non-LWOP sentences—largely pursuant to the post-Miller v. Alabama legislation passed in North Carolina. These JLWOP sentences are primarily concentrated in a small group of counties. A total of 61% (fifty-seven of the ninety-four) JLWOP sentences in North Carolina were entered in one of the eleven counties that have imposed more than three JLWOP sentences. We find a path dependency to these sentences: once a county has imposed a JLWOP sentence, it has a higher probability of imposing a JLWOP sentence again in the future. In contrast, homicide rates are not predictive of JLWOP sentences. We question what goals JLWOP serves, given what an inconsistently used, uncommon, geographically limited, and costly sentence it has been in practice. In conclusion, we describe alternatives to JLWOP, including the model adopted in states such as California and Wyoming, in which there is periodic review of lengthy sentences imposed on juvenile offenders

    What explains the puzzle of life without parole (LWOP) sentencing in the United States? In the past two decades, LWOP sentences have reached record highs, with over 50,000 prisoners serving LWOP. Yet during this same period, homicide rates have steadily declined. The U.S. Supreme Court has limited the use of juvenile LWOP in Eighth Amendment rulings. Further, death sentences have steeply declined, reaching record lows. Although research has examined drivers of incarceration patterns for certain sentences, there has been little research on LWOP imposition. To shed light on what might explain the sudden rise of LWOP, we examine characteristics of the more than 1,627 cases in which LWOP was imposed from 1995 to 2017, in North Carolina, one of the states that imposes the largest numbers of these sentences. We begin by analyzing defendant race, crime, and sentence patterns by county. We associate LWOP with homicide rates, and examine interactions between homicide, victim race, and prior LWOP sentencing. This first empirical analysis of adult LWOP sentences finds important local variations in its imposition. We find that as the homicide rate increases within a county, we observe fewer LWOP sentences. We find that fewer LWOP sentences are predicted to occur as the number of black victim homicides increase in a county, but no such relationship is found when considering the number of white victim homicides. Finally, we find a strong path dependency and concentration of LWOP sentences in counties, where counties that have imposed LWOP sentences in the past are more likely to continue to do so. These findings have implications for efforts to reconsider the most severe sentences in the U.S., and they suggest that prosecutorial discretion in seeking long sentences will be important subjects for future research and policy

    Nucleon-induced reactions at intermediate energies: New data at 96 MeV and theoretical status

    Double-differential cross sections for light charged particle production (up to A=4) were measured in 96 MeV neutron-induced reactions, at TSL laboratory cyclotron in Uppsala (Sweden). Measurements for three targets, Fe, Pb, and U, were performed using two independent devices, SCANDAL and MEDLEY. The data were recorded with low energy thresholds and for a wide angular range (20-160 degrees). The normalization procedure used to extract the cross sections is based on the np elastic scattering reaction that we measured and for which we present experimental results. A good control of the systematic uncertainties affecting the results is achieved. Calculations using the exciton model are reported. Two different theoretical approches proposed to improve its predictive power regarding the complex particle emission are tested. The capabilities of each approach is illustrated by comparison with the 96 MeV data that we measured, and with other experimental results available in the literature.Comment: 21 pages, 28 figure

    Delta degrees of freedom in antisymmetrized molecular dynamics and (p,p') reactions in the delta region

    Delta degrees of freedom are introduced into antisymmetrized molecular dynamics (AMD). This is done by increasing the number of basic states in the AMD wave function, introducing a Skyrme-type delta-nucleon potential, and including NNNΔNN\leftrightarrow N\Delta reactions in the collision description. As a test of the delta dynamics, the extended AMD is applied to (p,p') recations at Elab=800E_{\rm lab}=800 MeV for a 12^{12}C target. It is found that the ratio and the absolute values for delta peak and quasielastic peak (QEP) in the 12^{12}C(p,p') reaction are reproduced for angles \Theta_{\rm lab} \agt 40^\circ, pointing to a correct treatment of the delta dynamics in the extended AMD. For forward angles the QEP is overestimated. The results of the AMD calculations are compared to one-step Monte Carlo (OSMC) calculations and a detailed analysis of multi-step and delta potential effects is given. As important side results we present a way to apply a Gallilei invariant theory for (N,N') reactions up to Elab800E_{\rm lab} \approx 800 MeV which ensures approximate Lorentz invariance and we discuss how to fix the width parameter ν\nu of the single particle momentum distribution for outgoing nucleons in the AMD calculation.Comment: 28 pages, revtex, 12 figures included, figures are also available upon request as postscript files from the authors (e-mail: [email protected]), submitted to Phys.     Self-Consistent Relativistic Calculation of Nucleon Mean Free Path

    We present a fully self-consistent and relativistic calculation of the nucleon mean free path in nuclear matter and finite nuclei. Starting from the Bonn potential, the Dirac-Brueckner-Hartree-Fock results for nuclear matter are parametrized in terms of an effective σ\sigma-ω\omega Lagrangian suitable for the relativistic density-dependent Hartree-Fock (RDHF) approximation. The nucleon mean free path in nuclear matter is derived from this effective Lagrangian taking diagrams up to fourth-order into account. For the nucleon mean free path in finite nuclei, we make use of the density determined by the RDHF calculation in the local density approximation.     Labrador retrievers under primary veterinary care in the UK: demography, mortality and disorders

    Abstract Background Labrador retrievers are reportedly predisposed to many disorders but accurate prevalence information relating to the general population are lacking. This study aimed to describe demography, mortality and commonly recorded diseases in Labrador retrievers under UK veterinary care. Methods The VetCompass™ programme collects electronic patient record data on dogs attending UK primary-care veterinary practices. Demographic analysis covered all33,320 Labrador retrievers in the VetCompass™ database under veterinary care during 2013 while disorder and mortality data were extracted from a random sample of 2074 (6.2%) of these dogs. Results Of the Labrador retrievers with information available, 15,427 (46.4%) were female and 15,252 (53.6%) were male. Females were more likely to be neutered than males (59.7% versus 54.8%, P <  0.001). The overall mean adult bodyweight was 33.0 kg (SD 6.1). Adult males were heavier (35.2 kg, SD 5.9 kg) than adult females (30.4 kg, SD 5.2 kg) (P <  0.001). The median longevity of Labrador retrievers overall was 12.0 years (IQR 9.9–13.8, range 0.0–16.0). The most common recorded colours were black (44.6%), yellow (27.8%) and liver/chocolate (reported from hereon as chocolate) (23.8%). The median longevity of non-chocolate coloured dogs (n = 139, 12.1 years, IQR 10.2–13.9, range 0.0–16.0) was longer than for chocolate coloured animals (n = 34, 10.7 years, IQR 9.0–12.4, range 3.8–15.5) (P = 0.028). Of a random sample of 2074 (6.2%) Labrador retrievers under care in 2013 that had full disorder data extracted, 1277 (61.6%) had at least one disorder recorded. The total number of dogs who died at any date during the study was 176. The most prevalent disorders recorded were otitis externa (n = 215, prevalence 10.4%, 95% CI: 9.1–11.8), overweight/obesity (183, 8.8%, 95% CI: 7.6–10.1) and degenerative joint disease (115, 5.5%, 95% CI: 4.6–6.6). Overweight/obesity was not statistically significantly associated with neutering in females (8.3% of entire versus 12.5% of neutered, P = 0.065) but was associated with neutering in males (4.1% of entire versus 11.4% of neutered, P < 0.001). The prevalence of otitis externa in black dogs was 12.8%, in yellow dogs it was 17.0% but, in chocolate dogs, it rose to 23.4% (P < 0.001). Similarly, the prevalence of pyo-traumatic dermatitis in black dogs was 1.1%, in yellow dogs it was 1.6% but in chocolate dogs it rose to 4.0% (P = 0.011). Conclusions The current study assists prioritisation of health issues within Labrador retrievers. The most common disorders were overweight/obesity, otitis externa and degenerative joint disease. Males were significantly heavier females. These results can alert prospective owners to potential health issues and inform breed-specific wellness checks

    Palaeolimnological evidence for recent climatic change in lakes from the northern Urals, arctic Russia

    The recent sediments from two deep arctic lakes, Mitrofanovskoe and Vanuk-ty, situated in the permafrost belt within the Bol'shezemel'skaya Tundra in the northern Ural region, were studied for diatoms, chironomids, spheroidal carbonaceous particles and stable lead isotopes. The magnitudes and rates-of-change in diatom and chironomid assemblages were numerically estimated. Instrumental climate records were used to assess statistically the amount of variance in diatom and chironomid data explained by temperature. August and September air temperatures have a statistically significant effect on diatom composition at both lakes. At Mitrofanovskoe Lake, major compositional changes in diatom and chironomid assemblages occurred at the turn of the 20th century and might be related to the regional increase in temperature. Chironomid-inferred air temperature also increased by approximately 1°C since the early 1900s. At both lakes diatom compositional changes, coincident with the increase in June and September temperatures, also occurred in the late 1960s. These compositional changes are correlated with the increase in diatom production, sediment organic content and diatom species richness, and are likely to be a diatom response to the lengthening of the growing season. These changes are also correlated with the circum-Arctic temperature increase from the 1960s. A chironomid response to the late 1960s temperature increase was less pronounced at both lakes. Pollution levels are relatively low and pollution history is unrelated to ecological changes. Both lead isotopes and spheroidal carbonaceous particles show a clear atmospheric pollution signal, peaking in the 1980s. © Springer 2005

    Revealing the last 13,500 years of environmental history from the multiproxy record of a mountain lake (Lago Enol, northern Iberian Peninsula)

The final publication is available at Springer via http://dx.doi.org/10.1007/s10933-009-9387-7.We present the Holocene sequence from Lago Enol (43°16′N, 4°59′W, 1,070 m a.s.l.), Cantabrian Mountains, northern Spain. A multiproxy analysis provided comprehensive information about regional humidity and temperature changes. The analysis included sedimentological descriptions, physical properties, organic carbon and carbonate content, mineralogy and geochemical composition together with biological proxies including diatom and ostracod assemblages. A detailed pollen study enabled reconstruction of variations in vegetation cover, which were interpreted in the context of climate changes and human impact. Four distinct stages were recognized for the last 13,500 years: (1) a cold and dry episode that includes the Younger Dryas event (13,500–11,600 cal. year BP); (2) a humid and warmer period characterizing the onset of the Holocene (11,600–8,700 cal. year BP); (3) a tendency toward a drier climate during the middle Holocene (8,700–4,650 cal. year BP); and (4) a return to humid conditions following landscape modification by human activity (pastoral activities, deforestation) in the late Holocene (4,650–2,200 cal. year BP).
