    Police powers and human rights in the context of terrorism

    Purpose – The object of the paper is to analyse the justifications for the modification of police powers in response to terrorist threats, placing this issue in a European context. Design/methodology/approach – The paper consists of a critical examination of provisions relating to terrorism emanating from the European Union and the Council of Europe (European Convention on Human Rights (ECHR)), and the relevant English law on police powers of stop and search, arrest, and detention. Findings – Nothing in European law requires the amendments to police powers contained in English law; European law requires respect for human rights, even in dealing with terrorism; a shoot-to-kill policy is prohibited by the ECHR; and balance is an unsatisfactory method of resolving conflicts in this area. Research limitations/implications – The research was limited in its scope to certain areas of police powers, and to certain fundamental European documents. Future research should consider the issue in relation to wider areas. Originality/value – It challenges the idea of balance between liberty and security, proposing a test based on necessity instead

    Technology adoption into teaching and learning by mainstream university faculty: a mixed methodology study revealing the \u27how, when, why, and why not\u27

    The field of educational technology has been and continues to be an influential component within the vast array of educational strategies, pedagogies, plans, and processes designed to enhance student learning. Faculties are realizing the relevance and potential of educational technologies in their teaching and professional and personal growth. However, the distance between envisioning technological use and actual implementation is often a long, winding road for many educators. University faculty members are in the midst of a strong emphasis by various stakeholders to travel that road and to travel it with speed and accuracy. The mainstream members of tertiary level faculties encounter both obstacles and support along the road in varying degrees and proportions. The purpose of this exploratory mixed methodology study was designed to reveal the voice of those often hesitant travelers and to determine the how, when, why, and why not of their choosing to integrate technology into their teaching and learning. Data were collected through a survey administered to faculty from three academic colleges and interviews of selected survey respondents. Data were analyzed descriptively, by way of path analysis, and with the constant comparative method. This study attempted to provide insight into the processes of the adoption of innovation by mainstream faculty members, thus resulting in a Technology Integration Process Model. The results suggest that faculty members recognize potential benefits of technology in teaching and learning and that peer interactions and collegiality are significant in helping them learn new innovations and strategies. This fundamental knowledge is expected to inform the design of professional development relevant to those continuing on the journey and those who have not yet chosen to travel

    Population dynamics of introduced rodents in Hawai'i Volcanoes National Park 1986-1990

    Reports were scanned in black and white at a resolution of 600 dots per inch and were converted to text using Adobe Paper Capture Plug-in.We determined seasonal and geographical distribution patterns for four species of introduced rodents in Hawai‘i Volcanoes National Park from 1986-1990. We surveyed black rats (Rattus rattus), Polynesian rats (R. exulans), Norway rats (R. norvegicus) and house mice (Mus musculus) along an elevation gradient ranging from 90–1,820 m above sea level in five different sites using baited snap traps. Rodent community structure differed by elevation: there were more mice at montane sites and more Polynesian rats in the lowlands. We found that breeding occurred throughout the year for all species at all sites but that seasonal peaks in reproductive activity were common. Reproduction tended to be more common in the summer months at higher elevation sites and in the winter months at lower elevations. Rodents of all species were more abundant in our study in the winter than in the summer, but the differences were not significant. The overall sex ratio did not vary from a 1:1 ratio, but seasonally there were differences in sex ratio which varied with species and site. We calculated the minimum distance traveled from an assessment line and found that larger-bodied species traveled longer average distances. Pelage color in black rats was darkest in wet forest which may have adaptive value. Black and Polynesian rats were widespread in almost all habitat types, whereas mice were limited to dry and mesic sites; Norway rats were the rarest component of our sampling and found only in wet montane forest (‘ƌla‘a Forest).This analysis of historical data was made possible in part thanks to support from the National Park Service Inventory and Monitoring Program and the U.S. Geological Survey Invasive Species Program. The transmission cycle includes mammalian reservoirs of the parasite and triatomine species, such as Triatoma dimidiata and Triatoma infestans, which colonize domestic and peridomestic environments. Traditional house construction styles have been considered risk factors for the presence of triatomines by vector control personnel. Persistent house infestation is related to eco-bio-social factors associated with dogs, chickens and rodents. Integrated disease control should include the role of animals in the transmission process, and community members’ knowledge, attitudes and practices

    Global public policy, transnational policy communities, and their networks

    Public policy has been a prisoner of the word "state." Yet, the state is reconfigured by globalization. Through "global public–private partnerships" and "transnational executive networks," new forms of authority are emerging through global and regional policy processes that coexist alongside nation-state policy processes. Accordingly, this article asks what is "global public policy"? The first part of the article identifies new public spaces where global policies occur. These spaces are multiple in character and variety and will be collectively referred to as the "global agora." The second section adapts the conventional policy cycle heuristic by conceptually stretching it to the global and regional levels to reveal the higher degree of pluralization of actors and multiple-authority structures than is the case at national levels. The third section asks: who is involved in the delivery of global public policy? The focus is on transnational policy communities. The global agora is a public space of policymaking and administration, although it is one where authority is more diffuse, decision making is dispersed and sovereignty muddled. Trapped by methodological nationalism and an intellectual agoraphobia of globalization, public policy scholars have yet to examine fully global policy processes and new managerial modes of transnational public administration

    Evaluation Research and Institutional Pressures: Challenges in Public-Nonprofit Contracting

    This article examines the connection between program evaluation research and decision-making by public managers. Drawing on neo-institutional theory, a framework is presented for diagnosing the pressures and conditions that lead alternatively toward or away the rational use of evaluation research. Three cases of public-nonprofit contracting for the delivery of major programs are presented to clarify the way coercive, mimetic, and normative pressures interfere with a sound connection being made between research and implementation. The article concludes by considering how public managers can respond to the isomorphic pressures in their environment that make it hard to act on data relating to program performance.This publication is Hauser Center Working Paper No. 23.     Zebrafish dou yan mutation causes patterning defects and extensive cell death in the retina

    The size of an organ is largely determined by the number of cells it contains, which in turn is regulated by two opposing processes, cell proliferation and cell death, however, it is generally not clear how cell proliferation and cell death are coordinated during development. Here, we characterize the zebrafish dou yan mi234 mutation that results in a dramatic reduction of retinal size and a disruption of retinal differentiation and lamination. The retinal size reduction is caused by increased retinal cell death in a non–cell-autonomous manner during early development. The phenotypic defect in dou yan mi234 arises coincident with the onset of retinal neurogenesis and differentiation. Interestingly, unlike many other small eye mutations, the mutation does not increase the level of cell death in the brain, suggesting that the brain and retina use different mechanisms to maintain cell survival. Identification and further study of the dou yan gene will enhance our understanding of the molecular mechanisms regulating retinal cellular homeostasis, i.e., the balance between cell proliferation and cell death.     Treatment of IgG4-related disease-associated hypertrophic pachymeningitis with intrathecal rituximab: a case report

    IgG4-related disease-associated hypertrophic pachymeningitis (IgG4RD-HP) is a fibroinflammatory autoimmune disorder in which diagnosis is difficult without biopsy. Guidance on management of disease refractory to glucocorticoids and intravenous rituximab is limited. We present the case of a 68-year-old woman with IgG4RD-HP who developed sensorineural hearing loss with associated bulky basilar pachymeningeal enhancement. Her cerebrospinal fluid was inflammatory and had an elevated IgG4 concentration, strongly suggestive of IgG4RD-HP. Biopsy of involved meninges was not possible due to surgical risk. Over years she developed bilateral optic neuropathies and hydrocephalus, requiring intravenous rituximab and ventriculoperitoneal shunt. Her disease was refractory to glucocorticoids. Despite maintenance intravenous rituximab, she developed slowly progressive symptoms of intracranial hypertension and hydrocephalus with persistently inflammatory spinal fluid. Switching to intrathecal rituximab therapy led to dramatic improvement in gait and headache and reduced pachymeningeal bulk and metabolic activity. In patients with IgG4RD-HP refractory to glucocorticoids and intravenous rituximab, intrathecal rituximab may be an efficacious therapy

    Drug-Eluting Stents in Patients with Chronic Kidney Disease: A Prospective Registry Study

    BACKGROUND: Chronic kidney disease (CKD) is strongly associated with adverse outcomes after percutaneous coronary intervention (PCI). There are limited data on the effectiveness of drug-eluting stents (DES) in patients with CKD. METHODOLOGY/PRINCIPAL FINDINGS: Of 3,752 consecutive patients enrolled in the Guthrie PCI Registry between 2001 and 2006, 436 patients with CKD - defined as a creatinine clearance <60 mL/min - were included in this study. Patients who received DES were compared to those who received bare metal stents (BMS). Patients were followed for a mean duration of 3 years after the index PCI to determine the prognostic impact of stent type. Study end-points were all-cause death, myocardial infarction (MI), target vessel revascularization (TVR), stent thrombosis (ST) and the composite of major adverse cardiovascular events (MACE), defined as death, MI or TVR. Patients receiving DES in our study, by virtue of physician selection, had more stable coronary artery disease and had lower baseline risk of thrombotic or restenotic events. Kaplan-Meier estimates of proportions of patients reaching the end-points were significantly lower for DES vs. BMS for all-cause death (p = 0.0008), TVR (p = 0.029) and MACE (p = 0.0015), but not MI (p = 0.945) or ST (p = 0.88). Multivariable analysis with propensity adjustment demonstrated that DES implantation was an independent predictor of lower rates of all-cause death (hazard ratio [HR] 0.48, 95% confidence interval [CI] 0.25-0.92), TVR (HR 0.50, 95% CI 0.27-0.94) and MACE (HR 0.62, 95% CI 0.41-0.94). CONCLUSIONS: In a contemporary PCI registry, selective use of DES in patients with CKD was safe and effective in the long term, with lower risk of all-cause death, TVR and MACE and similar risk of MI and ST as compared with BMS. The mortality benefit may be a result of selection bias and residual confounding, or represent a true finding; a hypothesis that warrants clarification by randomized clinical trials
