    Processo administrativo e globalização: um diálogo entre os direitos brasileiro e norte-americano

    This article aims to carry out a comparative analysis between the main legislative innovations in the matter of administrative process in the last 21 years in Brazil in relation to the discipline of this topic by the United States legal system. Therefore, the Federal Administrative Procedure Law, the reform of the LINDB and the General Law of Regulatory Agencies will be analyzed and compared to some American rules and principles of administrative process. With such comparative analysis, we intend to investigate the existence of a global trend of recognition of the administrative process as a way of rationalizing and democratizing the decision-making process of Public Administration under the leadership of American law.O presente artigo objetiva proceder a uma análise comparativa entre as principais inovações legislativas na matéria de processo administrativo nos últimos 21 anos no Brasil em relação à disciplina desse tema no sistema jurídico norte-americano. Para tanto, serão analisadas a Lei de Processo Administrativo Federal, a reforma à Lei de Introdução às Normas do Direito Brasileiro e a Lei Geral de Agências Reguladoras e postas em comparação com o processo administrativo norte-americanas. Com tal análise comparativa, se pretende investigar a existência de uma tendência global de reconhecimento do processo administrativo como forma de racionalização e democratização do processo decisório da Administração Pública sob a liderança do direito norte-americano

    A Framework to tackling the synchrony between Social and Ecological phases of the annual cyclic movement of transhumant pastoralism

    Transhumant pastoralism is mobile livelihood strategy in which families and their herds move seasonally from lowlands, where they settle during the winter, towards the highlands, located in mountainous areas, during the summer. We propose a framework, rooted in a socio-environmental coevolutionary perspective, for the transhumant annual cycle as comprised by the winter-phase, the summer-phase, and movement transitions between them. The aim was to assess the level of synchrony between ecological phases and social phases and the benefit of moving between pasturelands in selected study cases from Patagonia, Argentina. Ecological phases were addressed by the diference between vegetation productivity of winter- and summer-lands, with Fourier transform applied to data series of the Normalized Difference Vegetation Index (NDVI). Social phases were estimated by the proportion of annual time spent by pastoralists and their herds in each site and during transitions, respectively, obtained from interviews. The framework was sensitive to capturing diferences across study cases. There was an observed tendency towards more synchronisation in the cases with closer distances and asynchrony in the cases with longer distances and longer movement transitions between pasturelands. Results are encouraging as a step towards the development of a monitoring system of both transhumant pastoralism activity and environmental changes.Estación Experimental Agropecuaria BarilocheFil: Perez Leon, Natalia.     Guía para la identificación de las especies de cumala colorada (Iryanthera Warb., Myristicaceae) de la Amazonía peruana

    Las especies de Iryanthera (Myristicaceae) son importantes ecológica y económicamente; y las claves para su identificación están elaboradas solamente con caracteres reproductivos (flores y frutos); por lo cual, los objetivos de la presente investigación fueron: elaborar una clave para la identificación de las 14 especies de Iryanthera de la Amazonía peruana sin características reproductivas y confeccionar un catalogado fotográficamente a nueve especies de Iryanthera. La fuente de datos está basada 809 especímenes, 241 muestreos en 100 parcelas de (76 de 0,1 ha y 24 de 0,05 ha); 543 en muestras de Herbarios (AMAZ, HH, MOL y USM) y 25 muestras de árboles independientes de los títulos habilitantes. Se midió 31 características de las hojas. Se ha logrado realizar una clave para la identificación de las especies de Iryanthera de la Amazonía peruana y además se incluyen fotografías para una mejor ayuda en la identificación. Casi todas las especies de Iryanthera se pueden identificar sin flores o frutos, pero al menos existen las siguientes especies que no es factible identificar con características foliares: Iryanthera paraensis e Iryanthera hostmannii; e Iryanthera lancifolia e Iryanthera paradoxa; falta mayor investigación para la identificación de estas especies de Iryanthera

    The risk of unintended deforestation from scaling sustainable livestock production systems

    Silvopastoral systems (SPS)-production systems integrating trees, forages, and livestock within the same land area-are recognized as critical for reducing tropical deforestation and improving livelihoods, ecosystem services, and carbon sinks. Yet, research on how scaling SPS influences forest cover changes at large geographical scales is scant. Our study delves deeper into the interlinkages between scaling SPS and deforestation. In two surveys conducted among 144 Colombian Amazon livestock producers with traditional or SPS farms, we assessed changes in herd composition between 2016 and 2020. Results showed a change in herd composition, with fewer males and more cows/heifers, suggesting a shift toward specializing in milk production, which, with the appropriate environmental incentives and safeguards, would unlikely broaden deforestation. However, interlinkages between the dairy and beef value chains suggest that extra male cattle from SPS intensification would be moved for fattening as a source of beef to new pastures at the forest border. If SPS scaling interventions in the Colombian Amazon are to be truly deforestation-free, they need to be designed based on a clear understanding of the interlinkages between food and land systems. Therefore, policies advancing the livestock and land-use agenda must create mechanisms that support deforestation-free livestock intensification, based on biophysical and socioeconomic evaluations

    Cluster detection analyses for temporal-spatial characterization of bovine tuberculosis in Bahia, Brazil

    A tuberculose bovina (BTB) é uma enfermidade causada pela infecção pelo Mycobacterium bovis que acomete o homem e diversas espécies de mamíferos. A BTB tem grande importância por causar prejuízos econômicos nas regiões infectadas e por seu impacto na saúde pública. Foi realizado inquérito epidemiológico no Estado da Bahia, entre 2008 e 2010, com o objetivo de estimar a prevalência e conhecer a distribuição espaço temporal da enfermidade. O Estado foi estratificado em quatro regiões, cada uma com características epidemiológicas e demográficas homogêneas representativas de formas de produção pecuária. Um total de 18.810 cabeças com idade superior a 2 anos foi amostrado em 1350 propriedades. O teste cervical comparativo foi aplicado em cada animal selecionado, sendo considerados positivos os animais reagentes positivos ou duas vezes inconclusivos. Latitude e Longitude foram tomadas para cada propriedade amostrada com o auxilio do aparelho de Global Positioning System (GPS). O teste de Cuzick-and-Edwards e a análise de rastreio espacial (spatial scan statistic) foram utilizados para identificar qualquer agrupamento espacial de BTB. A prevalência de rebanho na Bahia, indicando a proporção de propriedades foco, foi de 1,6% (IC 95%: 1,0% - 2,69% por região). Nenhuma evidência significativa (P<0.05) de aglomeração espacial ou clustering foi detectada, possivelmente devido à baixa prevalência da doença. Estes resultados sugerem que a BTB tem baixa prevalência no estado da Bahia e que, nestas condições epidemiológicas, os focos encontrados não podem ser explicados por fatores espacialmente estruturados.Bovine tuberculosis (BTB) is a disease caused by the infection with Mycobacterium bovis that affects humans and several mammalian species. BTB is important, because it inflicts far-reaching economic losses to infected regions, and due to its impact on public health. Epidemiological surveys were conducted in the State of Bahia between 2008 and 2010 with the objective to estimate the prevalence and to assess the spatial distribution of the disease. The State of Bahia has been stratified into four regions, each of them representing a set of homogeneous epidemiological and demographic characteristics, referred to as Production Circuits. A total of 18,810 more than 2-year-old cattle in 1,305 herds, ranging from 320 to 370 ones per region, and 20 to 40 cattle per herd were randomly selected. A cervical comparative test was applied to each selected animal; reactive cattle and cattle with two consecutive inconclusive tests were considered BTB-positive, whereas non-reactive cattle were considered BTB-negative. Positive herds were classified as those with <20 sampled cattle and at least one BTB-positive, as well as those with 40 cattle sampled with <2 BTB-positive animals. Latitude and longitude were recorded for each sampled herd with a generic Global Positioning System (GPS). The Cuzick-and-Edwards' test and the spatial scan statistic were used to assess whether BTB was spatially clustered. Herd-level prevalence, as indicated by the proportion of case-herds, was 1.6% (range 0.3 to 2.9% per region). No significant evidence (P<0.05) of spatial clustering was detected, most likely due to the low disease prevalence in the region. Results here suggest that BTB is low prevalent in the State of Bahia and that under these conditions epidemiological outbreaks found cannot be explained by spatially-structured factors

    Combined fit to the spectrum and composition data measured by the Pierre Auger Observatory including magnetic horizon effects

    The measurements by the Pierre Auger Observatory of the energy spectrum and mass composition of cosmic rays can be interpreted assuming the presence of two extragalactic source populations, one dominating the flux at energies above a few EeV and the other below. To fit the data ignoring magnetic field effects, the high-energy population needs to accelerate a mixture of nuclei with very hard spectra, at odds with the approximate E2^{-2} shape expected from diffusive shock acceleration. The presence of turbulent extragalactic magnetic fields in the region between the closest sources and the Earth can significantly modify the observed CR spectrum with respect to that emitted by the sources, reducing the flux of low-rigidity particles that reach the Earth. We here take into account this magnetic horizon effect in the combined fit of the spectrum and shower depth distributions, exploring the possibility that a spectrum for the high-energy population sources with a shape closer to E2^{-2} be able to explain the observations
