La responsabilidad civil de los padres en la familia de acogimiento, por los daños causados por los hijos acogidos en el sistema jurídico mexicano

Derived from the constant transformation in Family Law institutions in Mexico; it is fundamental strengthening figures such as foster care family with the intention of achieving certainty and legal protection for a vulnerable sector in our country, such as that of Mexican children. For that reason, it is not enough that its recognition in the General Law of the Rights of Girls, Boys and Adolescents; that although it becomes an important precedent, it is necessary that there be a comprehensive, clear and harmonized reform through family and / or civil coding. For the purposes of correct regulation of institutions such as parental authority and civil liability to parents for the effects of damages caused to their children under 18 years of age.  Derivado de la transformación constante en las instituciones del Derecho de Familia en  México; es de fundamental importancia que figuras como el de familia por acogimiento se fortalezcan con la intención de lograr certidumbre y protección jurídica a una sector vulnerable en nuestro país, como el de la niñez mexicana. Por ello no solo basta que exista en primer momento su reconocimiento en la Ley General de los Derechos de Niñas, Niños y Adolescentes; que si bien se convierte en un precedente importante, es necesario que exista una reforma integral, clara y armonizada a través de la codificación de carácter familiar y/o civil. Para efectos de una correcta regulación en figuras como el de la patria potestad y de la responsabilidad civil a padres por efectos de daños causados a sus hijos menores de 18 años

La aplicación del interés superior de niñas, niños y adolescentes en el caso del divorcio de sus progenitores.

Cuando en la relación matrimonial surgen las desavenencias entre la pareja, la discusión, la intolerancia, la falta de interés de continuar la vida en común, la terminación de los sentimientos y afectos que mantenían vigente la unión matrimonial, aparece la figura jurídica del divorcio como una solución efectiva y cierta frente a la problemática que vive la pareja. En estas condiciones, el divorcio disuelve la unión matrimonial, sin embargo, la terminación del matrimonio no pone fin a las relaciones familiares, la familia subsiste más allá del divorcio; la disolución no debe afectar las relaciones entre madre y padre con relación a sus hijos ?niñas, niños y adolescentes-, por ello, el divorcio no viene solo, le acompañan una serie de efectos y consecuencias jurídicas. En el presente trabajo se hace la revisión y estudio de las consecuencias jurídicas que provoca el divorcio en relación con los hijos del matrimonio disuelto, en lo específico, en los temas relacionados con la guarda y custodia. Indudablemente el tema es complejo puesto que la disolución del vínculo matrimonial provoca una serie de consecuencias en las relaciones personales entre padres e hijos, la convivencia diaria se fractura y los hijos ?niñas, niños y adolescentes- pueden llegar a sufrir un grave distanciamiento con alguno de sus padres y con ello, daños psicoemocionales y sociales. La reglamentación jurídica de la guarda y custodia debe ser atendida siempre bajo una visión de reconocimiento, respeto y protección total a los derechos de niñas, niños y adolescentes; el interés superior de ellos debe ser entendido y aplicado como el principio rector para que sus derechos se mantengan en la mejor de las condiciones ante la separación de sus padres, procurando en todo momento evitar cualquier tipo de afectaciones en su sano desarrollo físico, psicoemocional y social

Towards an interdisciplinary concept of family in globalization

La familia como grupo social, ha cambiado en cuanto a su estructura, formas y modelos, ha incorporado nuevas costumbres como consecuencia de la dinámica transferencia social propia de la globalización, en este artículo, se pretende conducir al Derecho y a las disciplinas en general, hacia una reflexión amplia e incluyente de muchos aspectos que modifican el concepto de esta institución en tiempos de posmodernidad. Para efectos de realizar un estudio más incluyente de las diferentes tendencias, a la luz de los principios propios de los conceptos posmodernos y con la plena observancia de las formas históricas que de ella han existido, se iniciará este análisis partiendo de la observancia de las formas históricas que de ella han existido, se iniciara este análisis partiendo de la base sintáctica del termino familia, para posteriormente abordar su estudio desde las perspectivas de la biología, sociología, psicología, economía y del derecho, y concluir con una nueva conceptualización interdisciplinaria e incluyente de sus actuales tendencias de desarrollo.Abstract: Family, as a social group, ha changed in terms of structure, shapes and patterns. It has incorporated new habits as a result of the transfer of social dynamics of globalization. This article is intended to analyze a broad and inclusive reflection of many aspects that modify the concept of this institution in postmoderm times from a law and other disciplines perspectives. For purposes of a more inclusive study of the different trends in the light of the principles inherent in postmodern concepts and with full respect for the historical forms of it have existed, this analysis will begin starting from the syntact basic of the term family and then to address their study from the perspectives of biology, sociology, economics and law, and conclude with a new interdisciplinary and inclusive conceptualization of their curret development trends

Malestar psicológico y actividad física en adultos de Puerto Vallarta, México: Análisis local 2021

Psychological discomfort are cognitive, emotional and behavioral manifestations of fast and short transit evolution. Objective: to analyze the prevalence of psychological discomfort in adults of Puerto Vallarta, Mexico and physical activity as a moderating factor of the discomfort. Method: Cross-sectional study with 678 cases. Kessler’s K-10 psychological distress scale and WHO physical activity recommendations were used for this population group. We performed statistical analyses of sample characterization, prevalence frequencies and levels of psychological discomfort and physical activity, as well as analyzed the possible relationships between psychological discomfort and physical activity. Results: 46.1% of the population presented a high or very high level of psychological discomfort and 64.8% were active or very physically active, no correlation was found between psychological discomfort and physical activity. Conclusions: Physical activity can act as a moderating factor of psychological discomfort, in the case of this study no. El malestar psicológico son manifestaciones cognitivas, emocionales y conductuales de tránsito breve y rápida evolución. Objetivo: analizar la prevalencia de malestar psicológico en adultos de Puerto Vallarta, México, y la actividad física como factor moderador del malestar. Método: estudio transversal con 678 casos. Se utilizó la escala de malestar psicológico K-10 de Kessler y las recomendaciones de actividad física de la OMS para este grupo poblacional. Se realizaron análisis estadísticos de caracterización de la muestra, frecuencias en la prevalencia y niveles de malestar psicológico y de actividad física, así como, se analizaron las posibles relaciones entre malestar psicológico y actividad física. Resultados: 46.1% de la población presenta un nivel alto o muy alto de malestar psicológico y 64.8% se ubicó como activa o muy activa físicamente, no se encontró correlación entre el malestar psicológico y actividad física. Net Efficacy Adjusted for Risk (NEAR): A Simple Procedure for Measuring Risk:Benefit Balance

BACKGROUND: Although several mathematical models have been proposed to assess the risk:benefit of drugs in one measure, their use in practice has been rather limited. Our objective was to design a simple, easily applicable model. In this respect, measuring the proportion of patients who respond favorably to treatment without being affected by adverse drug reactions (ADR) could be a suitable endpoint. However, remarkably few published clinical trials report the data required to calculate this proportion. As an approach to the problem, we calculated the expected proportion of this type of patients. METHODOLOGY/PRINCIPAL FINDINGS: Theoretically, responders without ADR may be obtained by multiplying the total number of responders by the total number of subjects that did not suffer ADR, and dividing the product by the total number of subjects studied. When two drugs are studied, the same calculation may be repeated for the second drug. Then, by constructing a 2 x 2 table with the expected frequencies of responders with and without ADR, and non-responders with and without ADR, the odds ratio and relative risk with their confidence intervals may be easily calculated and graphically represented on a logarithmic scale. Such measures represent "net efficacy adjusted for risk" (NEAR). We assayed the model with results extracted from several published clinical trials or meta-analyses. On comparing our results with those originally reported by the authors, marked differences were found in some cases, with ADR arising as a relevant factor to balance the clinical benefit obtained. The particular features of the adverse reaction that must be weighed against benefit is discussed in the paper. CONCLUSION: NEAR representing overall risk-benefit may contribute to improving knowledge of drug clinical usefulness. As most published clinical trials tend to overestimate benefits and underestimate toxicity, our measure represents an effort to change this trend

Informe preliminar. Propuesta de protección para la sierra de la mosca. Cáceres - Sierra de Fuentes

Presentamos este INFORME PRELIMINAR con el objetivo de impulsar una figura de protección para LA SIERRA DE LA MOSCA de Cáceres, para su justa valoración como espacio natural bien conservado, como forma de mantener a los ciudadanos cacereños concienciados con la importancia de sus recursos naturales y culturales, complementada con una serie de propuestas de usos y promoción social que la hagan más atractiva y eviten la amenaza del progresivo deterioro ecológico al que se encuentra hoy sometida esta zona periurbana.We present this PRELIMINARY REPORT with the aim of promoting a protection figure for LA SIERRA DE LA MOSCA of Cáceres, for its fair valuation as a well-conserved natural space, as a way of keeping the citizens of Cáceres aware of the importance of its natural and cultural resources, complemented with a series of proposals of uses and social promotion that make it more attractive and avoid the threat of the progressive ecological deterioration to which this periurban area is subjected today

Sexual Selection Halts the Relaxation of Protamine 2 among Rodents

Sexual selection has been proposed as the driving force promoting the rapid evolutionary changes observed in some reproductive genes including protamines. We test this hypothesis in a group of rodents which show marked differences in the intensity of sexual selection. Levels of sperm competition were not associated with the evolutionary rates of protamine 1 but, contrary to expectations, were negatively related to the evolutionary rate of cleaved- and mature-protamine 2. Since both domains were found to be under relaxation, our findings reveal an unforeseen role of sexual selection: to halt the degree of degeneration that proteins within families may experience due to functional redundancy. The degree of relaxation of protamine 2 in this group of rodents is such that in some species it has become dysfunctional and it is not expressed in mature spermatozoa. In contrast, protamine 1 is functionally conserved but shows directed positive selection on specific sites which are functionally relevant such as DNA-anchoring domains and phosphorylation sites. We conclude that in rodents protamine 2 is under relaxation and that sexual selection removes deleterious mutations among species with high levels of sperm competition to maintain the protein functional and the spermatozoa competitive
