REDESIGN THE PATTERN OF MAHRAM RELATION AMONG FAMILY MEMBER OF COASTAL POOR COMMUNITY; The Protection Measures of the intensively of Incest Behavior in Indonesia

This study describes the incest situation in three coastal Cities of Indonesia; Tanjung Balai, North Sumatra, Batam city Riau Archipelago, and North Jakarta, DKI Jakarta. The study background is since the high frequency of incest marriage in Indonesia. Instead of father, mother, uncle or brother take care of their biological family, they become the actors who want to marry their own blood family. The protection to the family is interpreted wrongly by marrying. On the other hand, Islam has regulated marriage rule in detail. The marriage is forbidden if the actors have blood relationship “Mahram relation”. The research method is a qualitative method in which the subject of the research is from various different background of organizations, data collecting technique and analysis are discussed. Marriage theories in Islam included in Alquran and hadist are also discussed. The finding of the research shows that the incest can be happen in the family because of wrong intensive communication factors, mis-interpretation of loyalty and protection, relationship domination, and economic factors. The design of the house is also as one determinant factors of incest, as the impact of poverty of the family. This study recommends government, family, and community to conduct reproductive education, religious education, re-design family relation and to increase income generating of the family in order they can have appropriate home to prevent the potency of incest. Keywords: Incest, coastal community, Mahram relation, povert

CONSIDERATION OF JUDGES OF THE PANDAN RELIGIOUS COURT IN DETERMINING THE STATUS OF THE DEFENDANT / INVISIBLE APPLICANT: MAQASHID AL-USRAH PERSPECTIVE

This article aims to find out what the judge considers in determining the status of the defendant/respondent in absentia. Then, the consideration is analyzed using the maqashid al-usrah theory which is part of the maqashid al-syariah study. The judge's consideration referred to here is the consideration of the judge of the Pandan Religious Court, which is limited to occult divorce cases, to be precise Decision Number 33/Pdt.G/2020/PA.Pdn and Decision Number 24/Pdt.G/2020/PA.Pdn. This decision is interesting to discuss, because the entire determination of the invisibility limit in the Pandan Religious Court does not have a definite time limit, including these two decisions. The methodological flow of this research uses a normative legal research format, with primary legal materials (secondary data), Law Number 1 of 1974 concerning Marriage, the Compilation of Islamic Law, and copies of Decision Number 33/Pdt.G/2020/PA.Pdn and Decision Number 24/Pdt.G/2020/PA.Pdn. The results of the study show that in the two decisions, it must be distinguished between the judge's consideration in determining the status of the defendant/respondent in occultation and the judge's consideration in breaking the marriage bond between the litigants. Regarding the determination of the status of the respondent/applicant as invisible, it turned out that the judge was not guided by Islamic law (fiqh mazhab), but rather the general civil procedural law. As for the reason for dissolving the marriage, the judge saw that the marriage of the litigants no longer fulfilled the elements to achieve the purpose of marriage; if the family is maintained, it will bring mafsadah. It can be concluded that the judge's consideration in each decision is in accordance with maqashid al-usrah

Violation of The Law in The Case of Divorce Verstek

The research aims to answer the problem of legal violations in verstek divorce cases. This research is an empirical legal research with a qualitative approach, and data collection in this research uses observation, interview, and data analysis techniques. This research found that in verstek divorce cases, violations of the law can occur if there are violations of procedures or rights guaranteed by law in the divorce process. The following are some examples of legal violations that may occur in verstek divorce cases, namely violation of the rights of absent parties, non-compliance with procedural requirements, violation of the rights of absent parties in the decision, fraud or manipulation in the divorce process. Forms of violation of taklik talak which are used as reasons for filing for divorce, among others, leaving the wife for 2 consecutive years, not providing mandatory maintenance for 3 months, hurting the wife's body / body or, neglecting or not caring for the wife for 6 months or more. Dari hasil penelitian tersebut dapat disimpulkan bahwa terdapat perbedaan yang signifikan hasil belajar fisika antara peserta didik yang menggunakan metode inkuiri terbimbing dengan media powerpoint berbasis teknik pictorial riddle dengan peserta didik yang menggunakan metode ceramah dengan media powerpoint berbasis teknik pictorial riddle. Kajian Etnobotani Tumbuhan Obat Tradisional di Kecamatan Tinggimoncong Kabupaten Gowa

Hasil penelitian menunjukkan bahwa terdapat 44 jenis tumbuhan yang digunakan dalam pengobatan tradisional. Tumbuhan obat dikelompokkan menjadi tiga berdasarkan cara memperolehnya yaitu tumbuhan liar sebanyak 17 tumbuhan (38,63 %), tumbuhan yang sengaja dipelihara sebanyak 23 tumbuhan (52,27 %) dan yang dibeli sebanyak 4 tumbuhan (9,09 %). Cara yang digunakan untuk mengolah tumbuhan dalam pengobatan terbagi atas tiga bagian yaitu: a) obat yang dimakan: bahan dimakan secara mentah: b) obat yang diminum diremas lalu diminum atau direbus lalu diminim: c) penggunaan luar: ditempel, dioleskan atau dilulurkan pada bagian yabg sakit

URGENSI ZAKAT DAN DAMPAKNYA TERHADAP PEMERATAAN PENDAPATAN MASYARAKAT

Zakat dan sistim pewarisan dalam Islam cenderung berperan sebagai sistem distribusi harta yang egaliter sehingga harta akan selalu berputar dan beredar kepada seluruh lapisan rakyat. Selain itu zakat juga merupakan ibadah maliyah ijtima’iyah (ibadah yang berkaitan  dengan ekonomi keuangan dan kemasyarakatan)  dan merupakan salah satu   dari lima rukun Islam yang mempunyai status dan punsi  yang penting dalam syari’at Islam , sehingga Al-Qur’an menegaskan kewajiban zakat bersama dengan kewajiban solat di delapan puluh dua tempat. Meskipun penanganan zakat sudah dikelola oleh pemerintah namun masih ada saja di dalam pelaksanaan pembayaran zakat dilakukan oleh pribadi-pribadi wajib zakat yang tanpa campur tangan dari pemerintah hal ini mengakibatkan zakat tidak bisa tersalur secara  merata kepada para mustahiqqin. Bahkan ada yang enggan untuk mengeluarkan zakatnya kalaupun dikeluarkan jumlahnya tidak sesuai dengan ketentuan zakat yang sebenarnya. Apabila pemerintah kita dengan aparatnya yang bersih dan berwibawa sudah dapat menangani pengolaan zakat dengan manajemen yang baik dan sesuai dengan tujuan dan saran zakat yang telah digariskan oleh Islam,  maka pengeloaannya akan jauh lebih efektif dan efisien, di samping hasilnya juga dampak positifnya akan jauh lebih baik
