    Attorney-Client Privilege—Admission in Legislative Hears

    Get PDF
Joseph Lanza, while in the Westchester County New York jail, had an interview in the counsel room with his attorney. This interview was secretly “bugged” by state officers and a tape recording of the communication was made. A New York State Joint Legislative Committee, with a view towards investigating the operation of state government, investigated the parole violation of Lanza. The Committee announced that it was planning to make public the recording of the interview between Lanza and his attorney. Lanza and the attorney brought suit to enjoin the disclosure. The Supreme Court at Special Term denied a motion to dismiss the complaint and granted a temporary injunction. The Appellate Division reversed the temporary injunction and dismissed the complaint. Appellants appealed to the Court of Appeals of New York. Under these facts the only issue was whether the complaint stated sufficient grounds for relief. The Court of Appeals held that there was no violation of the attorney-client privilege in the proposed use of the recording and found no grounds to enjoin the Committee action. Appellants claimed that the use and divulgence of the recording would violate the attorney-client privilege under the New York Civil Practice Act, sections 353 and 354

    Radial honeycomb core

    Get PDF
Core alleviates many limitations of conventional nacelle construction methods. Radical core, made of metals or nonmetals, is fabricated either by joining nodes and then expanding, or by performing each layer and then joining nodes. Core may also be produced from ribbons or strips with joined nodes or ribbons oriented in longitudinal planes

Using Kappenman\u27s Model to Compare the Relative Fishing Power of 42-Foot Shrimp Trawls and 65-Foot Fish Trawls During Summer and Fall in the Western and North-Central Gulf of Mexico

    Get PDF
Kappenman’s fishing power correction (FPC) model was used to compare the fishing efficiency between a 42-ft shrimp trawl and a 65-ft fish trawl towed simultaneously at 985 stations by the National Oceanic and Atmospheric Administration ship Oregon II in the western and north-central Gulf of Mexico. The shrimp trawl was consistently more efficient, both summer and fall, and regardless of whether using no./hr or kg/hr to calculate the FPC factors, for four species of fish, three species of crustaceans, and paper scallops. During summer, the shrimp trawl was more efficient, when using FPC factors calculated using no./hr as the catch per unit of effort (CPUE), at catching 13 of the 42 species of fish, 11 of the 12 species of crustaceans, and paper scallops. It was more efficient at catching 18 of the 42 species of fish, 10 of the 12 species of crustaceans, and paper scallops when FPC factors were calculated using kg/hr as the CPUE. In the fall, the shrimp trawl was more efficient, when using no./hr or kg/hr as the CPUE, at catching five species of fish, three species of crustaceans, and paper scallops. Fishing power correction factors were then compared between summer and fall seasons for 42 species of fish and 16 species of invertebrates. During summer, FPC values ranged from a low of 0.15 for Gulf menhaden to 4.94 for shoal flounder; fall FPC values ranged from 0.05 for yellow box crab to 2.52 for broad-striped anchovy. With the exception of three species, when using number of individuals caught per hour as the CPUE, all FPC factors were significantly different between summer and fall catches

Dan River, Inc. v. Icahn: Disclosure Violations - Relief for Subject Management?

    Get PDF
The heightened level of takeover activity during recent years has provoked many innovative responses from the management of subject companies that wish to remain independent. Since successful acquisition of a company usually involves the termination of its existing management, that management will often seek to mobilize the resources of the subject corporation to oppose the takeover attempt. As a result, litigation initiated by management now plays a part in virtually every takeover contest. The case of Dan River, Inc. v. Icahn, a recent Fourth Circuit decision, illustrates the use of litigation to forestall a takeover attempt

    SEGMENTING NICHE GOAT-MEAT MARKETS

    Get PDF
This research report provides an examination of the ratings of an important sensory attribute of chevon (goat meat) with that of beef and pork. Results from an analysis of variance of comparative ratings of the flavor of chevon and that of beef and pork suggest that selected demographic characteristics of U.S. consumers influenced the ratings of chevon'Â’s flavor with that of beef and pork. The findings indicate that Hispanics, blacks, and females should not be treated as homogenous niche markets. The results suggest that there are distinct subdivision preferences within and between these consumer partitions.Agribusiness,

Results of Two Free-fall Experiments on Flutter of Thin Unswept Wings in the Transonic Speed Range

    Get PDF
Results of four thin, unswept, flutter airfoils attached to two freely falling bodies are reported. Two airfoils fluttered at a Mach number of 0.85, a third airfoil fluttered at a Mach number of 1.03, and a fourth fluttered at a Mach number of 1.07. Results of calculations of flutter speed using incompressible and compressible air-force coefficients, including a Mach number of 1.0, are presented

Bioclimatic Chambers for Poultry Research: Design and Preliminary Results of Testing

    Get PDF
The 12 new environmental chambers for poultry research recently completed at the University of Arkansas feature solid state electronic systems to control dry bulb temperature and dew point of the chamber air. Dry bulb temperature is controlled by reheating previously cooled and dehumidified air by an electric heater installed in each supply air duct. Solid state controls proportion the flow of electricity to the heater to match the demand. The system is arranged to maintain constant temperature on a diurnal temperature cycle. A solid state time-proportioning control maintains a preselected dew point in each chamber. The control operates a solenoid valve to admit steam in regular pulses of varying duration to add moisture to the supply of air as needed. Automatic systems to control drinking water temperature and air flowrate also are included. The use of electronic controls, with electric heat, has resulted in environmental control systems of high precision with minimal mechanical complexity. The chambers are being used to study the response of broilers to different brooding temperature schedules and drinking water temperatures
