A HARMONIA ENTRE OS PODERES DA REPÚBLICA FEDERATIVA DO BRASIL E O ATIVISMO JUDICIAL BRASILEIRO

O presente artigo estuda a relação entre os poderes da República e o papel do ativismo judicial no Brasil. Em especial, busca apontar, por meio de levantamento bibliográfico, as características negativas acerca deste denominado protagonismo judicial, que por sua vez, ofenderia, em tese, um dos pilares da democracia, a tripartição dos poderes. Diante de tal estudo, chega-se à conclusão de que todo e qualquer excesso deve ser repudiado, uma vez que, isso ofenderia e comprometeria a democracia do País. O Poder Judiciário não deve esvaziar as ações que competem primordialmente ao parlamento ou ao executivo

DIREITO E DESENVOLVIMENTO SOB A ÓTICA DA TUTELA DO DIREITO FUNDAMENTAL À MORADIA

Após anos de estudos e vida acadêmica, o professor e jurista americano David Max Trubek elaborou a “Teoria da Concepção Central”, englobada no tema “Direito e Desenvolvimento”, posteriormente transformada em uma série de publicações em artigos e livros, nos quais debruçou-se sobre a necessidade de inserção de um direito moderno em países de Terceiro Mundo, de modo que estes abandonassem a ordem consuetudinária então vigente e adotassem novas concepções de educação jurídica, em prol de sua evolução no campo cultural, econômico e político. Por meio da metodologia da revisão bibliográfica especializada, objetiva-se abordar uma parcela do pensamento de David Trubek aplicado à efetivação do direito fundamental à moradia. Utilizando-se o Direito como meio para o desenvolvimento, garantir-se-ia à sociedade metas sociais visando uma coletividade igualitária, livre de indiferenças que reduzissem as possibilidades de sobrevivência no Mundo moderno, sendo um destes desafios a consagração de um direito à moradia digna a todos.

CREATIVE COMMONS: AVANÇOS E CRÍTICAS SOB A PERSPECTIVA DA SOCIEDADE DA INFORMAÇÃO

RESUMO Analisa-se o advento das licenças “creative commons” no cenário cotidiano da sociedade da informação, diante da dificuldade de proteção de direitos autorais frente ao crescimento do mercado ilícito de obras. Dentro desta realidade, a “creative commons” surge como alternativa válida, tendo em vista a possibilidade de flexibilizar a tutela de alguns direitos de autor e por suscitar indagações acerca da efetivação e perspectivas trazidas por estas licenças gerais públicas. PALAVRAS-CHAVE: Sociedade da Informação; Direito Autoral; Creative Commons. ABSTRACT Analyzes the advent of licenses "creative commons" in the daily setting of the information society, on the copyright protection of difficulty against the growth of illicit market works. Within this reality, the "creative commons" appears as a valid alternative, in view of the possibility of easing the tutelage of some copyright and raise questions about the effectiveness and perspectives brought by these public general licenses. As relações de troca em região de fronteira: uma proposta metodológica sob a ótica convencionalista

The studies about the economical, social and cultural reality of the outlying border zones are constituted in challenges of difficult articulation and consensus. For the economical coordination analysis, the exchange rate mechanism becomes insufficient - if it is treated as the only mean of coordination – faced with the plurality of articulation and interaction processes that involve the characters, the territories and the institutions culturally distinguished. This theoretical contextualization of the economic conventions is revealed in a significant instrument to treat aspects involving the degree of trust, reciprocity, the tacit approvals and the value judgments in a clear approach among the economical, social and political sciences. The objective of the present work is proposing a theoretical reflection based on the conventional approach on the characters coordination mechanisms of different border territories

A hybrid sender and receiver-based routing protocol for Wireless Sensor Networks

In Wireless Sensor Networks (WSNs), sensor nodes detect environment events and send them to sink nodes, which are responsible for processing these events. Due to the reduced of the nodes, the biggest restriction in a WSN is related to power consumption. Sender-based and receiver-based communication protocols each have their own advantages and disadvantages in certain scenarios. Since a WSN can undergo alterations in time, a protocol that is able to adapt to environmental conditions can increase network lifetime. This paper presents a hybrid routing protocol that operates according to sender-based and receiver-based approaches. The protocol was implemented using the NS-2 simulator and compared to sender-based and receiver-based approaches operating on their own. The results showed that the hybrid protocol, compared to sender and receiver-based approaches, achieves delivery rates close to 100%, performing 2.9 times less transmissions for each packet delivered. These gains demonstrate the contribution of the proposed algorithm, which reduces the number of transmissions, allowing the WSN to have a longer survival time.Keywords: hybrid sender and receiver protocol, Wireless Sensor Networks, routing protocol, simulations

AVALIAÇÃO DE MUDAS DO TOMATEIRO SOBINFLUÊNCIA DE BIOESTIMULADORES

Tomato occupies important position both in fruit consumption in its natural state, as in processed being considered a vegetable of extensive use. Seedlings are essential for the production system, since they are going to the field production. There are substances not widespread in horticulture, which are already used in most major crops, such asphytohormones with morphological and physiological effects, can generate qualitative and quantitative gains. This study aimed to evaluate the application of plant growth regulators (GA3, AIB) to contribute to the further development of tomato seedlings. Two applications of AIB and GA3 at concentrations of 0.05 g.L-1 were made at 10 and 20 days after germination. At 36 days after sowing, the characteristics were evaluated: seedling height, stem diameter, mass of dry matter and fresh, obtained by removal of seedling tray, washed in running water to remove excess substrate adhered to the roots, and after weighing the fresh matter. Gibberellic acid is more efficient in increasing height when applied at a concentration of 0.05 / l. The application of gibberellic acid and indolbutyricresulted in a more balanced effect on the development of air changes and greater dry mass gain. Keywords: gibberellic acid, indolbutyric acid, Solanum lycopersicum L.O tomate ocupa posição de grande importância tanto no consumo do fruto no seu estado natural, quanto no processado, sendo, considerada uma hortaliça de ampla utilização. As mudas são essências para o sistema produtivo, já que são elas que vão para o campo de produção. Existem substancias não muito difundida na olericultura, que já são mais utilizadas nas grandes culturas, como os fitormônios com efeitos morfológicos e fisiológicos, podendo gerarganhos qualitativos e quantitativos. Objetivou-se avaliar a aplicação de fitormônios (GA3, AIB) que contribua para um maior desenvolvimento de mudas do tomateiro. Foram feitas duas aplicações de AIB e GA3 nas concentrações de 0,05 g.L-1 com 10 e 20 dias após a germinação. Aos 36 dias após a semeadura, foram avaliadas as características: altura de plântula, diâmetro do caule, massas da matéria seca e fresca, obtidas por retirada das plântulas da bandeja, lavadas em água corrente para retirada do excesso de substrato aderido as raízes, e posterior pesagem da matéria fresca. Oácido giberélico se mostrou mais eficiente no aumento da altura quando aplicado na concentração de 0,05/L. A duplaaplicação de ácido giberélico e indolbutírico resultaram em um efeito mais equilibrado no desenvolvimento aéreo das muda e maior ganho de massa seca. A proteção de dados pessoais com o advento da lei geral de proteção de dados (LGPD): Boas práticas no tratamento e na proteção de dados pessoais em empresas nacionais

O presente trabalho tem como objetivo geral apresentar os principais princípios e temas relacionados à privacidade, abarcando os aspectos fundamentais da lei de proteção de dados, passando pela corrupção e responsabilidade dos administradores, apresentando alguns exemplos a respeito de vazamento de dados. O objetivo específico consiste em analisar a aplicabilidade do Programa de Compliance que as empresas devem seguir para atendimento dos requisitos impostos na Lei Geral de Proteção de Dados, Lei 13.709/2018 (“LGPD”). A metodologia utilizada foi a pesquisa bibliográfica sobre o tema, por meio de artigos científicos, doutrinas, revistas jurídicas, manuais e periódicos, além de legislação específica e jurisprudências

Gamification into the design of the e-3D online course

Research in the fields of Education and Applied Linguistics points to the growth of studies on digital games and gamification in Brazil. On the other hand, studies that discuss digital teaching material do not provide guidelines on how to implement gamification into the design of digital teaching materials, mainly in language studies. Thus, this work presents practical guidelines for how to explore gamification in the design of language teaching materials based on the experience developed in the outreach project laboratory of online language teaching and learning at the Federal University of Santa Maria. This research reports a case study carried out in the English online 3D course offered in the modality of distance education. To exemplify how the gamification strategies have been implemented, we provide examples from the course’s material as well as bring the user’s evaluation about participating in a gamified online course. Results indicate that gamification strategies were underpinned by exploring mainly intrinsic and extrinsic gamification strategies included in the digital material design, as well as by tools used on Moodle Platform to get the students engaged in the language learning process. On the other hand, this empirical study has shown the necessity of including more narrative strategies into the content proposed in the online course as an alternative to getting the students to explore meaningful learning by problem-solving in branching scenarios proposed inside the Moodle platform

Film art and conversation circle as an learning strategies in bioethics for collective subjects

Films are important tools of communication, expression, and perception of the world and important tools in the teaching and learning process. The present article aimed to analyze the discourses that emerged from the cinematographic work, having the conversation circle as a strategy for problematizing bioethics in the work process of teachers, students, and health workers. This is a descriptive study with a qualitative approach, with data collected from an interview guided by a semi-structured script. Faculty, students, and health workers participated in the study. Data analysis based on the content analysis technique, supported by the Atlas.ti version 9.0 software, enables the identification of two thematic categories: film art as a strategy for bioethical reflection and bioethical implications in teachers’ daily practices, students, and health professionals. The results revealed that the use of cinematography engenders a new formulation of the teaching-learning process, allowing participants to reflect on everyday ethical dilemmas. It’s concluded that it’s imperative to broaden debates with bioethical approaches, anchored to cinematographic art, as an effective method to stimulate reflective thinking
