Ο θεσμός της συλλογικής αγωγής ως μέσο αποκατάστασης της ζημίας από παραβιάσεις της νομοθεσίας για την προστασία του ελευθέρου ανταγωνισμού

Το θέμα της εργασίας είναι ο θεσμός της συλλογικής αγωγής στο δίκαιο του ελεύθερου ανταγωνισμού. Αρχικά αναλύεται η σχέση της δημόσιας με την ιδιωτική επιβολή καθώς και η ιστορία του θεσμού της αγωγής αποζημίωσης για παραβάσεις του δικαίου του ελεύθερου ανταγωνισμού στον ευρωπαϊκό χώρο. Έπειτα γίνεται σύγκριση των συλλογικών και των ατομικών αγωγών και εξάγεται το συμπέρασμα ότι μόνες οι ατομικές αγωγές για παραβάσεις του δικαίου του ελεύθερου ανταγωνισμού δεν αρκούν για την εξασφάλιση ανεμπόδιστης πρόσβασης των κοινωνών του δικαίου στη δικαιοσύνη. Έπειτα αναλύονται οι ισχύοντες θεσμοί συλλογικής αγωγής στις Η.Π.Α., στην Ελλάδα και σε ορισμένα κράτη μέλη της Ε.Ε., ενώ στη συνέχεια συγκρίνονται οι δύο κυρίαρχες μορφές συλλογικής αγωγής (opt - in και opt - out). Η εργασία καταλήγει στο συμπέρασμα ότι μόνο οι συλλογικές αγωγές με τη μορφή opt - out μπορούν να εξασφαλίσουν την ανεμπόδιστη πρόσβαση των εμμέσων (κυρίως) καταναλωτών στη δικαιοσύνη και ταυτόχρονα να αποτελέσουν αποτρεπτικό παράγοντα για περεταίρω παραβιάσεις του δικαίου του ελεύθερου ανταγωνισμού από τις επιχειρήσεις. Τέλος γίνεται δικαιοπολιτική πρόταση θέσπισης συλλογικών αγωγών με τη μορφή opt - out στην ελληνική έννομη τάξη.The topic of the paper is the institution of collective action in the field of antitrust law. Firstly, the relationship between public enforcement and private enforcement is analyzed, as well as the history of the institution of action for damages concerning infringements of competition law. Collective and individual actions are then compared and it is concluded that individual damages actions for infringements of free competition law alone, are not sufficient to ensure that citizens have free access to justice. The current collective redress institutions in the US, Greece and some EU Member States are then analyzed, and then the two dominant forms of collective redress (opt - in and opt - out) are compared. The work concludes that only collective actions in the form of opt - out can ensure that indirect consumers have free access to justice and at the same time be a deterrent to further infringements of antitrust law by businesses. Finally, there is a legal proposal to introduce collective actions in the form of opt - out in the Greek legal system

Exempting agreements from the prohibition of Article 101(1) TFEU : affirmative and negative requirements

Σκοπός της παρούσας διπλωματικής εργασίας είναι να επικεντρωθεί στις θετικές και αρνητικές προϋποθέσεις για την εξαίρεση των συμφωνιών μεταξύ δύο εταιρειών από τον κανόνα του άρθρου 101(1) της ΣΛΕΕ από μια δυαδική προσέγγιση που βασίζεται στο εάν η εξαίρεση προβλέπεται απευθείας από τη Συνθήκη (η « νόμιμη» εξαίρεση) ή εάν προβλέπεται σε άλλα κείμενα (κανονισμοί, ανακοινώσεις, κατευθυντήριες γραμμές) της έννομης τάξης της Ε.Ε. Η πρώτη βάση αναλύεται στο κεφάλαιο 2 σχετικά με το άρθρο 101 παράγραφος 3 της ΣΛΕΕ και η δεύτερη βάση στο κεφάλαιο 3 σχετικά με τους κανονισμούς ομαδικών απαλλαγών, το δόγμα De Minimis και τις συλλογικές συμβάσεις.The purpose of this dissertation is to focus on the positive and negative requirements for the exemption of agreements between two companies from the rule of Article 101(1) TFEU from a binary approach based on whether the exemption is provided directly by the Treaty (the “legal” exception) or if it is provided in other texts (regulations, notices, guidelines) of the EU legal order. The first basis is analyzed on Chapter 2 regarding the Article 101(3) TFEU and the second basis on Chapter 3 regarding Block Exemptions, the De Minimis doctrine and Collective agreements

Immunological backbone of uveal melanoma: is there a rationale for immunotherapy?

No standard treatment has been established for metastatic uveal melanoma (mUM). Immunotherapy is commonly used for this disease even though UM has not been included in phase III clinical trials with checkpoint inhibitors. Unfortunately, only a minority of patients obtain a clinical benefit with immunotherapy. The immunological features of mUM were reviewed in order to understand if immunotherapy could still play a role for this disease

Biology of advanced uveal melanoma and next steps for clinical therapeutics.

Uveal melanoma is the most common intraocular malignancy although it is a rare subset of all melanomas. Uveal melanoma has distinct biology relative to cutaneous melanoma, with widely divergent patient outcomes. Patients diagnosed with a primary uveal melanoma can be stratified for risk of metastasis by cytogenetics or gene expression profiling, with approximately half of patients developing metastatic disease, predominately hepatic in location, over a 15-yr period. Historically, no systemic therapy has been associated with a clear clinical benefit for patients with advanced disease, and median survival remains poor. Here, as a joint effort between the Melanoma Research Foundation\u27s ocular melanoma initiative, CURE OM and the National Cancer Institute, the current understanding of the molecular and immunobiology of uveal melanoma is reviewed, and on-going laboratory research into the disease is highlighted. Finally, recent investigations relevant to clinical management via targeted and immunotherapies are reviewed, and next steps in the development of clinical therapeutics are discussed

The Orbit and Optic Nerves

Magnetic Resonance Imaging (MRI) of the orbits and optic nerves has developed into the “gold standard” of imaging modalities for the evaluation of many soft tissue abnormalities of the orbit. Computed tomography (CT) remains the modality of choice for evaluation of the bony structures of the orbit. MRI is also more flexible, allowing for multiplanar imaging that is not possible with CT. This unit presents a basic protocol for imaging of the orbit.
