Novel Neutrality Claims against Internet Platforms: A Reasonable Framework for Initial Scrutiny

    Get PDF
This Article examines a recent trend in which the Federal Trade Commission and other enforcement agencies investigate Internet platforms for behavior that is insufficiently “neutral” towards users or third parties that interact with the platform. For example, Google faces a formal FTC investigation based on allegations that it has tinkered with search results rather than presenting users with a “neutral” result. Twitter faces a formal investigation after the social media service restricted the ways in which third party developers could interact with Twitter through its application programming interface (“API”). These investigations represent a new attempt to shift the network neutrality debate to higher-level Internet platforms. Rather than focusing on providing basic Internet access neutrally, these novel neutrality claims look to platforms that are built upon the Internet, and seek to ensure that they, too, behave “neutrally.” Unfortunately, network neutrality principles do not transition well from Internet service providers to search engines and social media sites. Ultimately, the network neutrality debate serves as a poor tool for scrutiny of higher-level Internet platforms. This Article demonstrates that network neutrality cannot be applied to higher-level Internet platforms and then examines another possible method of analyzing novel neutrality claims using antitrust law. It re-frames novel neutrality claims as tying arrangements, the subject of extensive antitrust law and scholarship. In applying tying doctrine to novel neutrality claims, this Article demonstrates that it, too, is insufficient for examining novel neutrality claims on Internet platforms. The Article closes by proposing a different analysis to examine these novel neutrality claims, an analysis based on Justice O\u27Connor\u27s attempt to reform tying doctrine

A Regional Socio-Economic Life Cycle Assessment of a Bioeconomy Value Chain

    Get PDF
A bioeconomy tackles sustainable development at both the global and regional levels, as it relies on the optimized use of renewable bio-based resources for the provisioning of food, materials, and energy to meet societal demands. The effects of the bioeconomy can be best observed at a regional level, as it supports regional development and affects the social dimension of sustainability. In order to assess the social impacts of wood-based production chains with regional differentiation, the social life cycle assessment framework “RESPONSA” was established in 2018. We present an initial study, in which this method is applied to an exemplary production chain in a case study of laminated veneer lumber produced in central Germany. The results show a relatively better social performance compared to the reference economic sector, reflecting a relatively low rate of female employees as a major social hotspot. Several social opportunities are identified, in terms of health and safety, equal opportunities, and adequate remuneration, for the organization taking part in the value chain. Finally, considering the UN’s Sustainable Development Goals (SDGs) as a global normative framework, a number of additional indicators for RESPONSA, as well as further developments and recommendations regarding its application in other regions and the upcoming social life cycle assessment (S-LCA) guidelines, are identified

The Different Muscle-Energetics during Shortening and Stretch

    Get PDF
The helical shape of the thin filaments causes their passive counterclockwise rotation during muscle stretch that increases tensile stress and torque at first by unwinding and then by winding up the four anchoring Z-filaments. This means storage of energy in the series elastic Z-filaments and a considerable decrease of the liberated energy of heat and work to (h—wap), where h is the heat energy and wap the stretch energy induced from outside by an apparatus. The steep thin filament helix with an inclination angle of 70° promotes the passive rotation during stretch, but impedes the smooth sliding of shortening by increased friction and production of frictional heat. The frictional heat may be produced by the contact with the myosin cross-bridges: (1) when they passively snap on drilling thin filaments from cleft to cleft over a distance 2 × 2.7 nm = 5.4 nm between the globular actin monomers in one groove, causing stepwise motion; or (2) when they passively cycle from one helical groove to the next (distance 36 nm). The latter causes more heat and may take place on rotating thin filaments without an effective forward drilling (“idle rotation”), e.g., when they produce “unexplained heat” at the beginning of an isometric tetanus. In an Appendix to this paper the different states of muscle are defined. The function of its most important components is described and rotation model and power-stroke model of muscular contraction is compared

Rsp5/Nedd4 clears cells of heat-damaged proteins

    Get PDF
Protein quality control systems protect cells from proteotoxicity caused by the accumulation of aberrantly folded polypeptides. The Rsp5 ubiquitin ligase (mammalian homologue Nedd4) is now identified as a major constituent of a clearance pathway that degrades misfolded cytosolic proteins after exposure to heat

A Hierarchical Spatio-Temporal Statistical Model Motivated by Glaciology

    Get PDF
In this paper, we extend and analyze a Bayesian hierarchical spatio-temporal model for physical systems. A novelty is to model the discrepancy between the output of a computer simulator for a physical process and the actual process values with a multivariate random walk. For computational efficiency, linear algebra for bandwidth limited matrices is utilized, and first-order emulator inference allows for the fast emulation of a numerical partial differential equation (PDE) solver. A test scenario from a physical system motivated by glaciology is used to examine the speed and accuracy of the computational methods used, in addition to the viability of modeling assumptions. We conclude by discussing how the model and associated methodology can be applied in other physical contexts besides glaciology.Comment: Revision accepted for publication by the Journal of Agricultural, Biological, and Environmental Statistic
