    Childhood Abuse as a Mitigating Factor in Federal sentencing: The Ninth Circuit Versus the United States Sentencing Commission

    Prior to the enactment of the Federal Sentencing Guidelines in 1987, sentencing courts routinely considered an offender\u27s background and personal characteristics when imposing a sentence.\u27 Today, how- ever, judges strain to exercise their discretion in a sentencing structure that focuses primarily on the offense committed and discourages consideration of a defendant\u27s personal history. Although judicial departures from the formal sentencing structure are permissible in certain circumstances, discretionary departures based on a defendant\u27s background and personal characteristics consistently have met opposition by the United States Sentencing Commission. This opposition has led to the Commission\u27s adoption of more restrictive policies governing the relevance of offender characteristics in federal sentencing. Despite these policies, however, district and circuit judges continue to find ways to circumvent the guidelines in cases warranting special consideration.\u27 On October 6, 1992, the Ninth Circuit in United States v. Roe\u27 vacated and remanded a district court ruling that refused to grant a downward departure from the sentencing guidelines to a defendant with a shocking history of family violence-an offender characteristic that the Commission has not addressed specifically. Although other circuits have held that childhood abuse of the defendant may be relevant in certain circumstances, the Ninth Circuit in Roe was the first to recommend a departure based solely on a finding of extraordinary abuse

    Megaloblastic anaemia, diabetes and deafness in a two-year old child

    Megaloblastic anaemia in childhood usually occurs as a result of dietary folate deficiency or, rarely, congenital disorders of vitamin B12 metabolism. We present a 2-year-old girl with megaloblastic anaemia and insulin-dependent diabetes mellitus, both of which proved responsive to pharmacological doses of thiamine. She was also found to have sensorineural hearing loss. Also known as Rogersā€™ syndrome, thiamine-responsive megaloblastic anaemia is the result of inactivating mutations in a gene encoding a thiamine transporter. A clinical diagnosis is supported by characteristic bone marrow findings and can be confirmed by demonstrating apoptosis in skin fibroblasts cultured in thiamine-depleted medium. Where available, DNA sequencing is definitive. There is rapid reticulocytosis after thiamine administration. We recommend a trial of therapy for megaloblastic anaemia not responding to folate and vitamin B12, especially in a deaf and/or diabetic child

    Identification of high performance solvents for the sustainable processing of graphene

    Nanomaterials have many advanced applications, from bio-medicine to flexible electronics to energy storage, and the broad interest in graphene-based materials and devices means that high annual tonnages will be required to meet this demand. However, manufacturing at the required scale remains unfeasible until economic and environmental obstacles are resolved. Liquid exfoliation of graphite is the preferred scalable method to prepare large quantities of good quality graphene, but only low concentrations are achieved and the solvents habitually employed are toxic. Furthermore, good dispersions of nanomaterials in organic solvents are crucial for the synthesis of many types of nanocomposites. To address the performance and safety issues of solvent use, a bespoke approach to solvent selection was developed and the renewable solvent Cyrene was identified as having excellent properties. Graphene dispersions in Cyrene were found to be an order of magnitude more concentrated than those achieved in N-methylpyrrolidinone (NMP). Key attributes to this success are optimum solvent polarity, and importantly a high viscosity. We report the role of viscosity as crucial for the creation of larger and less defective graphene flakes. These findings can equally be applied to the dispersion of other layered bi-dimensional materials, where alternative solvent options could be used as drop-in replacements for established processes without disruption or the need to use specialized equipment. Thus, the discovery of a benign yet high performance graphene processing solvent enhances the efficiency, sustainability and commercial potential of this ever-growing field, particularly in the area of bulk material processing for large volume applications

R.G. and A.B. were supported by NERC grant NE/M004619/1 awarded to A.B.Atmospheric dust is a primary source of iron (Fe) to the open ocean, and its flux is particularly important in the high nutrient, low chlorophyll (HNLC) Southern Ocean where Fe currently limits productivity. Alleviation of this Fe limitation in the Subantarctic Zone of the Atlantic by increased dust-borne Fe supply during glacial periods has been shown to increase primary productivity. However, previous work has found no such increase in productivity in the Pacific sector. In order to constrain the relative importance of Southern Ocean Fe fertilization on glacial-interglacial carbon cycles, records of dust fluxes outside of the Atlantic sector of the Southern Ocean at the Last Glacial Maximum (LGM) are required. Here we use grain size and U-series analyses to reconstruct lithogenic and CaCO3 fluxes, and Nd, Sr and Pb isotopes to ascertain the provenance of terrigenous material delivered to four deep-water cores in the SW Pacific Ocean over the last ~30kyr. We find evidence for an increase in the relative proportion of fine-grained (0.5-12 ?m) terrigenous sediment and higher detrital fluxes during the LGM compared to the Holocene. The provenance of the LGM dust varied spatially, with an older, more "continental" signature (low ĪµNd, high 87Sr/86Sr) sourced from Australia in the northern cores, and a younger, more volcanogenic source in the southern cores (high ĪµNd, low 87Sr/86Sr), likely sourced locally from New Zealand. Given this increase in lithogenic flux to the HNLC subantarctic Pacific Southern Ocean during the LGM, factors besides Fe-supply must have regulated the biological productivity here.Publisher PDFPeer reviewe

    Simple Preparation of Novel Metal-Containing Mesoporous Starches

    Metal-containing mesoporous starches have been synthesized using a simple and efficient microwave-assisted methodology followed by metal impregnation in the porous gel network. Final materials exhibited surface areas >60 m2 gāˆ’1, being essentially mesoporous with pore sizes in the 10ā€“15 nm range with some developed inter-particular mesoporosity. These materials characterized by several techniques including XRD, SEM, TG/DTA and DRIFTs may find promising catalytic applications due to the presence of (hydr)oxides in their composition

    Inhibition of calcium-independent phospholipase A impairs agonist-induced calcium entry in keratinocytes

    BACKGROUND: In many cells, depletion of intracellular calcium (Ca2+) reservoirs triggers Ca2+ entry through store-operated Ca2+ channels in the plasma membrane. However, the mechanisms of agonist-induced calcium entry (ACE) in keratinocytes are not fully understood. OBJECTIVES: This study was designed to determine if pharmacological inhibition of calcium-independent phospholipase A (iPLA(2)) impairs ACE in normal human epidermal keratinocytes. METHODS: Confocal laser scanning microscopy was used to monitor the dynamics of Ca2+ signalling in keratinocytes loaded with the calcium-sensitive dye Fluo-4. Cells were stimulated with extracellular nucleotides [adenosine triphosphate (ATP) or uridine triphosphate (UTP)] or with lysophosphatidic acid (LPA), a bioactive lipid that regulates keratinocyte proliferation and differentiation. RESULTS: Both ATP and UTP induced Ca2+ release in primary human keratinocytes. This was not followed by robust Ca2+ influx when the experiments were performed in low Ca2+ (70 micromol L(-1)) medium. Upon elevation of extracellular Ca2+ to 1.2 mmol L(-1), however, a biphasic response consisting of an initial Ca2+ peak followed by an elevated plateau was observed. The plateau phase was inhibited when cells were treated with bromoenol lactone, a specific pharmacological inhibitor of iPLA(2). These findings indicate that iPLA(2) activity is required for ACE in keratinocytes. LPA also evoked Ca2+ release in keratinocytes but failed to induce sustained Ca2+ entry even when extracellular Ca2+ was elevated to 1.2 mmol L(-1). CONCLUSION: Our results demonstrate for the first time an important role for iPLA(2) in regulating ACE in primary human keratinocytes

    Results of the First Coincident Observations by Two Laser-Interferometric Gravitational Wave Detectors

    We report an upper bound on the strain amplitude of gravitational wave bursts in a waveband from around 800Hz to 1.25kHz. In an effective coincident observing period of 62 hours, the prototype laser interferometric gravitational wave detectors of the University of Glasgow and Max Planck Institute for Quantum Optics, have set a limit of 4.9E-16, averaging over wave polarizations and incident directions. This is roughly a factor of 2 worse than the theoretical best limit that the detectors could have set, the excess being due to unmodelled non-Gaussian noise. The experiment has demonstrated the viability of the kind of observations planned for the large-scale interferometers that should be on-line in a few years time.Comment: 11 pages, 2 postscript figure
