La responsabilidad civil extracontractual del médico en la sanidad privada = The non-contractual liability of the doctor in the private health
A través de la realización del presente trabajo se ha abordado la cuestión compleja, tanto teórica como práctica, de la responsabilidad civil del médico en sede extracontractual y desde la perspectiva de la sanidad privada.
Se ha analizado la normativa reguladora y la doctrina jurisprudencial aplicable a esta materia; fundamentalmente, a la luz del art.1902 CC, al no haberse elaborado y aprobado una ley específica sobre la cuestión de la responsabilidad civil del médico.
Asimismo se ha estudiado la diligencia exigible al médico, sintetizada en la lex artis ad hoc, así como la naturaleza de la obligación asumida por el facultativo en función del tipo de medicina de que se trate, voluntaria o necesaria.
El eje o grueso del trabajo lo constituye el análisis detenido de los presupuestos y requisitos necesarios para que pueda prosperar una acción de responsabilidad civil dirigida al médico, atendiendo al carácter subjetivo de dicha responsabilidad, tal como se deriva del propio artículo 1902 CC.
De igual forma, se ha desarrollado la ardua cuestión de la determinación del quantum indemnizatorio y la variada problemática de la carga de la prueba.
Finalmente, de forma sucinta, se ha tratado de las vías posibles de resarcimiento de los daños sufridos

Regulatory developments in bank solvency, recovery and resolvability
Most of the amendments to prudential and resolution legislation introduced in the
European Union (EU) in 2019 have already been implemented for credit institutions
over the course of 2021. These include a broad set of measures aimed at reducing
risks in the banking sector, boosting its strength and progressing towards the
completion of the Banking Union. These risk mitigation measures give continuity to
the substantial change in prudential rules carried out in 2013 in response to the
shortcomings identified in the financial sector in the wake of the financial crisis and
which prompted the adoption of the Basel III framework in the EU. They also give
continuity to the resolution framework introduced in 2014 to ensure the orderly
resolution of non-viable banks, minimising the repercussions of banking crises on
the real economy, taxpayers and depositors. The fresh revision of European rules
here at hand aims to make progress in the pass-through to European regulations of
the internationally agreed reforms. It also aims to change certain aspects in light of
the experience accumulated and the inefficiencies detected in the years during
which the previous regulations were applied. This article reviews the most salient
prudential and resolution measures introduced, presents some reforms that have
already been rolled out and describes certain aspects that have not yet been
addressed
Análisis de la prescripción potencialmente inapropiada en el paciente anciano
Se estima que la principal causa de reacciones adversas a medicamentos en el paciente anciano es la prescripción inapropiada de fármacos y la insuficiente monitorización de tratamientos prescritos. Además, el riesgo en ellos se incrementa de forma lineal con el número de fármacos prescritos. El objetivo del estudio es identificar la presencia de prescripción potencialmente inapropiada en el paciente anciano. Para llevarlo a cabo, se realizó el análisis de los tratamientos en dos ámbitos distintos de asistencia sanitaria. Los resultados obtenidos han demostrado una baja prevalencia de prescripción potencialmente inapropiada en el paciente anciano, tanto en Atención Primaria como al ingreso hospitalari
Precipitation over Northern South America and Its Seasonal Variability as Simulated by the CMIP5 Models
RESUMEN: Northern South America is identified as one of the most vulnerable regions to be affected by climate change. Furthermore, recent extreme wet seasons over the region have induced socioeconomic impacts of wide proportions. Hence, the evaluation of rainfall simulations at seasonal and interannual time scales by the CMIP5 models is urgently required.Here,we evaluated the ability of seven CMIP5models (selected based on literature review) to represent the seasonalmean precipitation and its interannual variability over northern SouthAmerica.Our results suggest that it is easier formodels to reproduce rainfall distribution during boreal summer and fall over both oceans and land. This is probably due to the fact that during these seasons, incoming radiation and ocean-atmosphere feedbacks over Atlantic and Pacific oceans locate the ITCZ on the Northern Hemisphere, as suggested by previous studies.Models exhibit the worse simulations during boreal winter and spring, when these processes have opposite effects locating the ITCZ. Our results suggest that the models with a better representation of the oceanic ITCZ and the local low-level jets over northern South America, such as the Choco low-level jet, are able to realistically simulate the main features of seasonal precipitation pattern over northern South America

Coaching o mentoring como métodos a utilizar en el Departamento de Recursos Humanos.
Implementa el coaching o mentoring como métodos a utilizar en el Departamento de Recursos Humanos. Se observó el ambiente que se daba en la organización entre los compañeros, por lo que notamos conflictos de diversa índole, en este caso se trata de un conflicto funcional, ya que se requirió de un cambio dentro de la organización. El problema se abordó de una forma práctica, es decir, se logró que el encargado del Departamento de Recursos Humanos implementara los Métodos de Coaching o Mentoring para mejorar el ambiente dentro de la empresa y asimismo mejorar el rendimiento laboral. Coaching es una técnica que ayuda a cumplir con los objetivos planteados por los empresarios, guiándolos por el camino adecuado para encontrar la mejor forma de realizarlos; Mentoring consiste en que una persona que tiene ideas y habilidades para optar a una organización las trasmite, para hacer crecerla y desarrollar sus competencias
Do Stakeholders Modulate Philanthropic Strategy? Corporate Philanthropy as Stakeholders’ Engagement
Corporate philanthropy, as an expression of commitment to the common good, can
contribute to the creation of social value in companies. This corporate philanthropy can be managed
in various ways. The choice of how to channel corporate philanthropy could be, in accordance with
stakeholder theory, the result of companies’ interactions with key stakeholders and, in accordance
with the theory of signaling, a signal that companies use to respond to their demands. This approach
contributes to the literature on bottom-up initiatives (stakeholder–managers) as opposed to top-down
strategies (board–stakeholders) in relation to corporate social responsibility, which is becoming
increasingly important in a society where networks of communication, cooperation and interaction
are established. To this end, a study was conducted on 221 European companies indexed in the
Dow Jones Sustainability Indices in the year 2018. The findings have several practical implications:
The management of corporate philanthropy should take into account the stakeholders’ requirements,
and stakeholders show greater affinity and trust with the company when philanthropy is channeled
through foundations. By contrast, donations are not associated with stakeholder attitudes. As a
theoretical implication, this paper supports the theories of stakeholders and signaling by explaining
