    This study aimed to analyze the setting of childfriendly schools to prevent child violence and the standardsetting model for child-friendly schools to protect children’s rights. This study used normative legal research with statutory regulations, concept approaches, and analytical approaches. Collection of secondary legal materials used document study techniques. The data that had been obtained was analyzed using an interpretation technique, namely legal hermeneutics. The study results showed that child-friendly schools were indicators of child-friendly district or city development by the Regulation of the Minister of Women’s Empowerment and Child Protection Number 11 of 2011 to protect children’s rights from violence in the educational environment. The standardization of child-friendly school development based on the Minister of Women’s Empowerment and Child Protection Regulation Number 8 of 2014 required essential components, including policies, curriculum implementation, educators and education personnel trained in children’s rights, child-friendly learning processes, child-friendly facilities and infrastructure, child participation, as well as the involvement of parents, alumni, community organizations, and the business world

    Indonesia merupakan negara yang sangat kaya dengan sumber daya laut. Potensi ini tentu dapat  dimanfaatkan bagi peningkatan dan percepatan pembangunan ekonomi nasional.  Pemanfaatan sumber daya laut secara optimal dan proporsional juga niscaya dapat membantu masyarakat pesisir untuk lepas dari jeratan taraf hidup kemiskinan. Pengelolaan pesisir telah diatur dalam UU 1 Tahun 2014 Tentang Perubahan Atas UU 27 Tahun 2007  tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil, Peraturan Menteri Kelautan dan Perikanan No 40/PERMEN-KP/2014 tentang Peran serta dan Pemberdayaan Masyarakat Dalam Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil. Pengaturan ini memberi arah bagi masyarakat pesisir dalam mengembangkan dan mengelola wilayah pesisir sesuai dengan kearifan lokal masyarakat setempat. Sepanjang penelusuran peneliti, model pengelolaan wilayah pesisir berbasis masyarakat yang tepat dalam mewujudkan kesejahteraan masyarakat pesisir belum terformulasikan dengan baik. Penelitian ini didesain sebagai penelitian hukum empiris yang bertujuan untuk menganalisis model pengelolaan wilayah pesisir berbasis masyarakat.   Hasil pembahasan menjelaskan bahwa model yang ideal pengelolaan wilayah pesisir berbasis masyarakat dilakukan dengan adanya sinergi dan interaksi yang tepat antara pemerintah, masyarakat dan nilai kearifan lokal. Pemberdayaan masyarakat pesisir dalam membangun model pengelolaan wilayah pesisir juga sangat penting dilakukan dengan maksud untuk mendorong kemandirian mereka. Penggunaan model ini memiliki keunggulan karena peran serta aktif masyarakat pesisir dapat meningkatkan pendapatan, menjaga kelestarian lingkungan pesisir, dan memberi keleluasaan bagi masyarakat pesisir dalam mengembangkan dan mengelola sumber daya kelautan sesuai dengan potensi, karakteristik dan sosial budaya masyarakatnya. Peran serta aktif masyarakat pesisir juga memberi harapan bagi pengentasan masalah kemiskinan yang berujung pada terwujudnya keadilan dan kesejahteraan masyarakat pesisir

    PENJABARAN PRINSIP DEMOKRASI DALAM PEMBENTUKAN KEBIJAKAN DAERAH

    Prinsip demokrasi yang dianut oleh Indonesia menuntut adanya transparansi dan keterbukaan dalam pembentukan kebijakan daerah. Secara legal formal prinsip demokrasi diatur dalam UU 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan. Dalam konteks ini, perlu dikaji dan dipahami apakah dalam pembentukan kebijakan daerah sudah berasaskan prinsip demokrasi serta perlu dikaji makna demokrasi dalam pembentukan kebijakan daerah. Metode penelitian yang digunakan adalah metode penelitian normatif dengan pendekatan  peraturan perundang-undangan dan pendekatan filsafat.  Hasil pembahasan adalah 1) bahwa makna dari penjabaran prinsip demokrasi dalam pembentukan kebijakan daerah dipahami pelibatan masyarakat dalam pembentukan kebijakan daerah. Pelibatan masyarakat dalam konteks legal formal disebut partisipasi masyarakat yang wajib terlibat dalam setiap tahapan pembentukan kebijakan daerah. 2) Penjabaran prinsip demokrasi  yang dimaknai sebagai partisipasi masyarakat dalam pembentukan kebijakan daerah dilakukan pada setiap proses pembentukan kebijakan daerah. Mulai dari tahap perencanaan, penyusunan, pembahasan, penetapan dan pengundangan kebijakan hukum daerah serta penjabaran prinsip demokrasi juga dituangkan dalam subtansi kebijakan hukum daerah.Kata Kunci : Demokrasi, Pembentukan Kebijakan Daerah The principles of democracy adopted by transparency and openness in the formation of regional policies. Legally formal democratic principles are regulated in Law 12 of 2011 concerning the Establishment of Legislation. In this context, it is necessary to study and understand about the formation of regional policies based on democratic principles and the meaning of democracy. The research method used is a normative research with statue approach and philosophical approach. The results of discussion are 1) the meaning of the elaboration of the democracy principles in the formation of regional policies is understood as involve the community in the formation of regional policies. Community involvement is called community participation which must be involved in every stage of regional policy formation. 2) The descriptions of principle of democracy to described in every process when forming regional policies, starting from the planning, drafting, discussion, determination and promulgation of regional legal policies.     The Role of Human Rights and Customary Law to Prevent Early Childhood Marriage in Indonesia

    Preventing early childhood marriage (ECM) can protect children’s rights from the perspective of human rights. There are several rules regarding the age limit for marriage. In Indonesia, the minimum age for marriage is nineteen years. However, in fact, early child marriage is still relatively high, with the seventh highest ranking in the world. This study aims to elaborate on the rights of children, which ECM potentially violates, and to identify who is responsible for minimizing and/or combating this phenomenon. This normative legal research with a human rights approach occurs in the childhood protection context. The results show that ECM has implications for violations against the right to life, the right to education, the right to develop, and the right to health. Thus, more stringently applying international and national law and combining with local wisdom (Balinese Customary Law) in protecting children's rights in the context of preventing ECM can prevent ECM effectively and minimize violations of other children's rights.     The specific purpose and target of this research is to determine the role of family welfare empowerment organizations (PKK) in the prevention and early handling of women and children victims of violence. The reason for researching this topic is the increase in the number of victims of violence against women and children every year. Based on data from the Ministry of Women's Empowerment and Child Protection, it is shown that since 2012 it has increased from 18,718 to 54,041 cases in June 2017 and until February 2018 it has shown 374 cases of violence against women and children. In this case, the Government is responsible for providing optimal services needed by victims, both medical, psychological, and legal assistance in an effort to recover their condition. The government in providing services to victims should cooperate and partner with the community, especially in the prevention and early handling of victims of violence. Prevention and early handling of victims of violence at the village level can empower family welfare empowerment organizations (PKK) which are government partners that are considered effective in the prevention and early handling of women and children victims of violence in their areas. Based on these reasons, it is necessary to study in depth the role of the PKK organization in preventing and early handling of women and children victims of violence. To achieve specific goals and targets in this study, the research method used is a normative research method with a statue approach and a conceptual approach.The results of the study provide an overview 1) there is a clear regulation in the laws and regulations related to the participation of the PKK in preventing and early handling of victims of violence, what needs to be further regulated is regulation in the form of Village Regulations and customary law (awig-awig) related to the participation of PKK and indigenous women in the prevention and early handling of victims of violence. 2) the procedures for preventing and early handling of victims of violence need to be stated in the operational standards in the village and the traditional village paparem

    Indonesian adat village is an autonomous traditional community under the Constitution of the Republic of Indonesia. In conformity with the Constitution, the State may not intervene in the community's internal affairs. They may freely enjoy their historical and traditional rights within the State of Indonesia, including their conventional customary rights, cultural rights, historical rights, and self-governing authority. However, this status has produced an injustice with regard to the use of their culture. Adat community is an actual inheritance of the traditional Balinese culture. They own and maintain the culture at their own expense. But, when the culture produces tourism and tourism produces economic benefit, none of the benefits directly flows to the adat community. Most of them flow to the government and private sectors. Under McDougal’s policy-oriented approach and taking the case of Bali, this article would explore the nature of such injustice, its causes, the formulation of needs, the administrative law policy schemes, and the administrative rules formulation model for fixing the problem

    <em>The purpose of this research is to discover the existence of autonomy of Desa Pakraman in legal pluralism perspective. Related with that purpose, there are two issues that will be discussed, first, how does the existence of the autonomy of Desa Pakraman in Indonesia’s legal system?,Second, how does the existence of the autonomy of Desa Pakraman in legal pluralism perspective?. The research method is normative legal research using statue approach, concept approach and analytical approach and law analysis by using legal interpretation. Based on the problems, the results of discussion are : first, the existence of the autonomy of Desa Pakraman within the Indonesia’s legal system has regulated in the 1945 Constitution of the Republic of Indonesia, national and local Regulations. In the Constitution, specifically Article 18 B of paragraph (2), declare that the states recognizes Desa Pakraman and their traditional rights. In regulation of Law No.5 of 1960 concerning basic Agrarian Law (UUPA), regulation of Human Rights, and regulation of Desa (Village) are clearly recognize Desa Pakraman as traditional institution has traditional rights, one of it is the autonomy of Desa Pakraman. At the local regulation, autonomy Desa Pakraman has regulated in Local Regulation about Desa Pakraman. Second, that existence of autonomy Desa Pakraman in perspective legal pluralism is that the existence autonomy Desa Pakraman is a weak legal pluralism. In perspective weak legal pluralism the state law as a superior and the customary law as an inferior, its position in the hierarchy under State law. As a theory, the semi-autonomous social field from Sally Falk Moore perspectives that Desa Pakraman is semi-autonomous. Desa Pakraman has capacity to hold their village based on the customary law and outomaticly Desa Pakraman to be in framework of state law.</em

    Children’s problems lately are very complex. Many cases occur in the community that ignore the fulfillment of children’s rights. One is the lack of fulfillment of children’s rights on birth certificates. In connection with this matter, it is important to do research to find out 2 (two) things, namely; first, to find out about children’s rights in obtaining birth certificates to Balinese indigenous people. Second, to find out whether a child can get a birth certificate if the birth registration goes beyond the deadline. In accordance with the research objectives, the research method used is a normative research method with a statue approach. The results of this study are legal protection of children’s rights in obtaining birth certificates in the community has been regulated starting from the 1945 Constitution of the Republic of Indonesia, Law of the Republic of Indonesia Number 23 of 2002 concerning Child Protection, Law of the Republic of Indonesia Number 23 The year 2006 was amended by the Republic of Indonesia Law Number 24 of 2013 concerning the Implementation of Population, Badung Regency Regional Regulation Number 10 of 2010 which was amended by Badung District Regulation Number 9 of 2016 concerning Amendment to Badung Regency Regional Regulation Number 10 of 2010 concerning Implementation Population Administration, Regional Regulation of Denpasar City Number 5 of 2014. Birth Registration that exceeds the fixed time limit can be done by requesting approval from the Head of the Population and Civil Registration Office. The advice can be given 1) socialization is needed regarding the procedures for registering births including procedures for registering online and needing to improve services by the Regional Government.
