The Effect of Any Willing Provider and Freedom of Choice Laws on Prescription Drug Expenditures
Any Willing Provider and Freedom of Choice laws restrict the ability of managed care entities, including pharmacy benefit managers, to selectively contract with providers. The managed care entities argue this limits their ability to generate cost savings, while proponents of the laws suggest that such selective contracts limit competition, leading to an increase in aggregate costs. We examine the effect of state adoption of such laws on total state healthcare spending, finding that any willing provider/freedom of choice laws are associated with cost increases of at least 3 percent. These results suggest that these laws are harmful from a spending perspective
Requiem for a Paradox: The Dubious Rise and Inevitable Fall of Hipster Antitrust
For antitrust practitioners, scholars, and economists—those who work with antitrust in agencies, courts, or law firms—the development of the antitrust laws over the past half century has been a remarkable and positive development for the American economy and consumers. Over the last fifty years, antitrust has developed into a coherent, principled, and workable body of law that contributes positively not only to American competitiveness and societal well-being, but also helps to export the culture of market competition around the world. Although a healthy diversity of views governs the intellectual landscape in antitrust, and there is no shortage of ideas on how to improve its performance around the margins and within the paradigm of existing doctrine, there is consensus that modern antitrust laws have the core concepts right. Most fundamentally, there is agreement that the goal of protecting consumer welfare is and should be the lodestar of modern antitrust enforcement

Experimental cross-correlation Nitrogen Q-branch CARS Thermometry in a Spark Ignition Engine
A purely experimental technique was employed to derive temperatures from nitrogen Q-branch Coherent Anti-Stokes Raman Scattering (CARS) spectra, obtained in a high pressure, high temperature environment (spark ignition Otto engine). This was in order to obviate any errors arising from deficiencies in the spectral scaling laws which are commonly used to represent nitrogen Q-branch CARS spectra at high pressure. The spectra obtained in the engine were compared with spectra obtained in a calibrated high pressure, high temperature cell, using direct cross-correlation in place of the minimisation of sums of squares of residuals. The technique is demonstrated through the measurement of air temperature as a function of crankshaft angle inside the cylinder of a motored single-cylinder Ricardo E6 research engine, followed by the measurement of fuel-air mixture temperatures obtained during the compression stroke in a knocking Ricardo E6 engine. A standard CARS program (SANDIA’s CARSFIT) was employed to calibrate the altered non-resonant background contribution to the CARS spectra that was caused by the alteration to the mole fraction of nitrogen in the unburned fuel-air mixture. The compression temperature profiles were extrapolated in order to predict the auto-ignition temperatures
Doing what others do: norms, science, and collective action on global warming
Does rhetoric highlighting social norms or mentioning science in a communication affect individuals’ beliefs about global warming and/or willingness to take action? We draw from framing theory and collective-interest models of action to motivate hypotheses that are tested in two large web-based survey-experiments using convenience samples. Our results show that attitudes about global warming, support for policies that would reduce carbon emissions, and behavioral intentions to take voluntary action are strongly affected by norm- and science-based interventions. This has implications for information campaigns targeting voluntary efforts to promote lifestyle changes that would reduce greenhouse gas emissions
Quantum-Classical Transition of the Escape Rate of a Uniaxial Spin System in an Arbitrarily Directed Field
The escape rate \Gamma of the large-spin model described by the Hamiltonian H
= -DS_z^2 - H_zS_z - H_xS_x is investigated with the help of the mapping onto a
particle moving in a double-well potential U(x). The transition-state method
yields in the moderate-damping case as a Boltzmann average of the
quantum transition probabilities. We have shown that the transition from the
classical to quantum regimes with lowering temperature is of the first order
(d\Gamma/dT discontinuous at the transition temperature T_0) for h_x below the
phase boundary line h_x=h_{xc}(h_z), where h_{x,z}\equiv H_{x,z}/(2SD), and of
the second order above this line. In the unbiased case (H_z=0) the result is
h_{xc}(0)=1/4, i.e., one fourth of the metastability boundary h_{xm}=1, at
which the barrier disappears. In the strongly biased limit \delta\equiv 1-h_z
<< 1, one has h_{xc} \cong (2/3)^{3/4}(\sqrt{3}-\sqrt{2})\delta^{3/2}\cong

The limits to libertarian paternalism: two new critiques, and seven best practice imperatives

We offer a sympathetic critique of this so-called ‘libertarian paternalist’ approach. As well as reviewing existing critiques, we present two new arguments. First, we question the use of libertarian paternalism in situations where the social good is invoked to justify policies that are not beneficial to the individuals directly affected. Second, we highlight the potentially adverse consequences of poorly targeted libertarian paternalist techniques. The penultimate section then brings together the existing critiques and the new arguments to offer seven best practice imperatives for the reflective application of these powerful, but easily misused, tools of government. We conclude with some brief reflections on what freedom might mean in the context of libertarian paternalist governance
The Impact of Political Leaders' Profession and Education on Reforms
This paper analyzes whether the educational and professional background of a head of government matters for the implementation of market-liberalizing reforms. Employing panel data over the period 1970-2002, we present empirical evidence based on a novel data set covering profession and education of more than 500 political leaders from 73 countries. Our results show that entrepreneurs, professional scientists, and trained economists are significantly more reform oriented. Contrary, union executives tend to impede reforms. We also highlight interactions between profession and education with time in office and the political leaning of the ruling party
Identification and functional characterization of cDNAs coding for hydroxybenzoate/hydroxycinnamate glucosyltransferases co-expressed with genes related to proanthocyanidin biosynthesis
Grape proanthocyanidins (PAs) play a major role in the organoleptic properties of wine. They are accumulated mainly in grape skin and seeds during the early stages of berry development. Despite the recent progress in the identification of genes involved in PA biosynthesis, the mechanisms involved in subunit condensation, galloylation, or fine regulation of the spatio-temporal composition of grape berries in PAs are still not elucidated. Two Myb transcription factors, VvMybPA1 and VvMybPA2, controlling the PA pathway have recently been identified and ectopically over-expressed in an homologous system. In addition to already known PA genes, three genes coding for glucosyltransferases were significantly differentially expressed between hairy roots over-expressing VvMybPA1 or VvMybPA2 and control lines. The involvement of these genes in PA biosynthesis metabolism is unclear. The three glucosyltransferases display high sequence similarities with other plant glucosyltransferases able to catalyse the formation of glucose esters, which are important intermediate actors for the synthesis of different phenolic compounds. Studies of the in vitro properties of these three enzymes (Km, Vmax, substrate specificity, pH sensitivity) were performed through production of recombinant proteins in E. coli and demonstrated that they are able to catalyse the formation of 1-O-acyl-Glc esters of phenolic acids but are not active on flavonoids and stilbenes. The transcripts are expressed in the early stages of grape berry development, mainly in the berry skins and seeds. The results presented here suggest that these enzymes could be involved in vivo in PA galloylation or in the synthesis of hydroxycinnamic esters
Oceanic bromoform sources for the tropical atmosphere
Oceanic bromoform (CHBr3) is the major source of organic Br to the atmosphere and may be significant for ozone depletion through the contribution of reactive bromine to the upper troposphere and lower stratosphere of the midlatitudes and tropics. We report the first analyses of boundary layer air, surface and deep ocean waters from the tropical Atlantic. The data provide evidence of a source of CHBr3 throughout the tropical open ocean associated with the deep chlorophyll maximum within the tropical thermocline. Equatorial upwelling carries the CHBr3 to the surface, adding to increased concentrations in the equatorial mixed layer and driving oceanic emissions that support locally elevated atmospheric concentrations. In air masses that had crossed the coastal upwelling region off NW Africa even higher atmospheric mixing ratios were measured. The observations suggest a link between climate, wind-driven upwelling, and the supply of Br to the upper atmosphere of the tropics
Combining autocracy and majority voting: the canonical succession rules of the Latin Church
The autocratic turn of the Latin Church in the XI-XIII century, a reaction to the secular power interferences, concentrated the decision-making power in the hands of the top hierarchy, and finally in the hands of the pope. A fundamental step was the change and the constitutionalisation of the procedures for leadership replacement, which were open successions where the contest for power was governed by elections. The autocratic reform limited the active electorate to the clergy only and gradually substituted the episcopal elections by the pope’s direct appointment. Besides, the voting rules changed from unanimity to the dual principle of maioritas et sanioritas (where the majority was identified with the greater part by number and wisdom) and finally to the numerical rule of qualified majority. This evolution aimed at preserving the elections from external interferences and at eliminating the elements of arbitrariness. The most important succession, the papal election, was protected by institutionalising a selectorate and its decision-making rules. The selectorate and the elections did not insert accountability and representation mechanisms but only protected the quality of the autocratic leadership and its autonomy
