    State compliance with EU Law is crucial to the very existence of the Union. Traditionally, it has been secured through a combination of strong "private" and of weak "centralized" enforcement. However, this arrangement is no longer perceived to be sufficient. By endowing the Union with new tools vis-Ă -vis its Member States - penalties, conditionality, and the like - current reforms try to complement symbolic sanctioning with real "consequences". The goal is to reinforce the authority of EU Law. In this article, we question whether the new toolbox is fit for the purpose, or whether it risks to produce adverse effects which might even go as far as upsetting the Union's constitutional template

    Comparison of performance and fitness traits in German Angler, Swedish Red and Swedish Polled with Holstein dairy cattle breeds under organic production

    Although the use of local breeds is recommended by organic regulations, breed comparisons performed under organic production conditions with similar production intensities are scarce. Therefore, we compared data of local and widely used Holstein dairy cattle breeds from 2011 to 2015 regarding production, fertility and health from German and Swedish organic farms with similar management intensities within country. In Germany, the energy-corrected total milk yield tended to be lower in the local breed Original Angler Cattle (AAZ, 5193 kg) compared to the modern German Holstein Friesian breed (HO, 5620 kg), but AAZ showed higher milk fat and protein contents (AAZ v. HO: 5.09% v. 4.18% and 3.61% v. 3.31%, respectively). In Sweden, the widely used modern Swedish Holstein (SH) breed had the highest milk yield (9209 kg, fat: 4.10%, protein: 3.31%), while the local Swedish Polled (SKB) showed highest milk yield, fat and protein contents (6169 kg, 4.47%, 3.50%, respectively), followed by the local breed Swedish Red (SRB, 8283 kg, 4.33%, 3.46%, respectively). With regard to fertility characteristics, the German breeds showed no differences, but AAZ tended to have less days open compared to HO (−17 days). In Sweden, breeds did not differ with regard to calving interval, but both local breeds showed a lower number of days open (−10.4 in SRB and −24.1 in SKB compared to SH), and SKB needed fewer inseminations until conception (−0.5 inseminations) compared to SH. Proportion of test day records with a somatic cell count content of ≄100 000 cells per ml milk did not reveal breed differences in any of the two countries. German breeds did not differ regarding the proportion of cows with veterinary treatments. In Sweden, SRB showed the lowest proportion of cows with general veterinary treatment as well as specific treatment due to udder problems (22.8 ± 6.42 and 8.05 ± 2.18, respectively), but the local breed SKB did not differ from SH in either of the two traits. In Sweden, we found no breed differences regarding veterinary treatments due to fertility problems or diagnosis of claw or leg problems during claw trimming. Our results indicate a stronger expression of the antagonism between production and functional traits with increasing production intensity. Future breed comparisons, therefore, need to consider different production intensities within organic farming in order to derive practical recommendations as to how to implement European organic regulations with regard to a suitable choice of breeds

    Diffusion of energetic particles in turbulent MHD plasmas

    In this paper we investigate the transport of energetic particles in turbulent plasmas. A numerical approach is used to simulate the effect of the background plasma on the motion of energetic protons. The background plasma is in a dynamically turbulent state found from numerical MHD simulations, where we use parameters typical for the heliosphere. The implications for the transport parameters (i.e. pitch-angle diffusion coefficients and mean free path) are calculated and deviations from the quasi-linear theory are discussed.Comment: Accepted for publication in Ap

    Early-time velocity autocorrelation for charged particles diffusion and drift in static magnetic turbulence

    Using test-particle simulations, we investigate the temporal dependence of the two-point velocity correlation function for charged particles scattering in a time-independent spatially fluctuating magnetic field derived from a three-dimensional isotropic turbulence power spectrum. Such a correlation function allowed us to compute the spatial coefficients of diffusion both parallel and perpendicular to the average magnetic field. Our simulations confirm the dependence of the perpendicular diffusion coefficient on turbulence energy density and particle energy predicted previously by a model for early-time charged particle transport. Using the computed diffusion coefficients, we exploit the particle velocity autocorrelation to investigate the time-scale over which the particles "decorrelate" from the solution to the unperturbed equation of motion. Decorrelation time-scales are evaluated for parallel and perpendicular motions, including the drift of the particles from the local magnetic field line. The regimes of strong and weak magnetic turbulence are compared for various values of the ratio of the particle gyroradius to the correlation length of the magnetic turbulence.     Measurement of the electric fluctuation spectrum of magnetohydrodynamic turbulence

    Magnetohydrodynamic (MHD) turbulence in the solar wind is observed to show the spectral behavior of classical Kolmogorov fluid turbulence over an inertial subrange and departures from this at short wavelengths, where energy should be dissipated. Here we present the first measurements of the electric field fluctuation spectrum over the inertial and dissipative wavenumber ranges in a ÎČ≳1\beta \gtrsim 1 plasma. The k−5/3k^{-5/3} inertial subrange is observed and agrees strikingly with the magnetic fluctuation spectrum; the wave phase speed in this regime is shown to be consistent with the Alfv\'en speed. At smaller wavelengths kρi≄1k \rho_i \geq 1 the electric spectrum is softer and is consistent with the expected dispersion relation of short-wavelength kinetic Alfv\'en waves. Kinetic Alfv\'en waves damp on the solar wind ions and electrons and may act to isotropize them. This effect may explain the fluid-like nature of the solar wind.Comment: submitted; 4 pages + 3 figure

    Spin-polarization-induced structural selectivity in Pd3X_3X and Pt3X_3X (X=3dX=3d) compounds

    Spin-polarization is known to lead to important {\it magnetic} and {\it optical} effects in open-shell atoms and elemental solids, but has rarely been implicated in controlling {\it structural} selectivity in compounds and alloys. Here we show that spin-polarized electronic structure calculations are crucial for predicting the correct T=0T=0 crystal structures for Pd3X_3X and Pt3X_3X compounds. Spin-polarization leads to (i) stabilization of the L12L1_2 structure over the DO22DO_{22} structure in Pt3_3Cr, Pd3_3Cr, and Pd3_3Mn, (ii) to the stabilization of the DO22DO_{22} structure over the L12L1_2 structure in Pd3_3Co and to (iii) ordering (rather than phase-separation) in Pt3_3Co and Pd3_3Cr.     Assessing the impact of deforestation of the atlantic rainforest on ant-fruit interactions: a field experiment using synthetic fruits

    Ants frequently interact with fleshy fruits on the ground of tropical forests. This interaction is regarded as mutualistic because seeds benefit from enhanced germination and dispersal to nutrient-rich microsites, whereas ants benefit from consuming the nutritious pulp/aril. Considering that the process of deforestation affects many attributes of the ecosystem such as species abundance and composition, and interspecific interactions, we asked whether the interaction between ants and fallen fleshy fruits in the Brazilian Atlantic forest differs between human-created fragments and undisturbed forests. We controlled diaspore type and quantity by using synthetic fruits (a plastic 'seed' covered by a lipid-rich 'pulp'), which were comparable to lipid-rich fruits. Eight independent areas (four undisturbed forests, and four disturbed forest fragments) were used in the field experiment, in which we recorded the attracted ant species, ant behaviour, and fruit removal distance. Fruits in undisturbed forest sites attracted a higher number of species than those in disturbed forests. Moreover, the occurrence of large, fruit-carrying ponerine ants (Pachycondyla, Odontomachus; 1.1 to 1.4 cm) was higher in undisturbed forests. Large species (>= 3 mm) of Pheidole (Myrmicinae), also able to remove fruits, did not differ between forest types. Following these changes in species occurrence, fruit displacement was more frequent in undisturbed than in disturbed forests. Moreover, displacement distances were also greater in the undisturbed forests. Our data suggest that fallen fleshy fruits interacting with ants face different fates depending on the conservation status of the forest. Together with the severe loss of their primary dispersers in human-disturbed tropical forest sites, vertebrate-dispersed fruits may also be deprived of potential ant-derived benefits in these habitats due to shifts in the composition of interacting ant species.
