Labor Law - Labor Management Relations Act - Linking Employer Free Speech to No-Solicitation Rule

During an organizational campaign the employer prohibited any dissemination of literature on company property and soliciting or campaigning on company time by employees while itself distributing within the plant non-threatening, anti-union literature. General Counsel for the NLRB contended that by this conduct the employer interfered with, restrained or coerced employees in their exercise of the right to self-organization. This contention was rejected by the NLRB, but on appeal was accepted by the Court of Appeals for the District of Columbia. On certiorari to the United States Supreme Court, held, reversed, two justices dissenting. Even if an employer could commit an unfair labor practice by enforcing an otherwise valid no-solicitation rule while itself engaging in solicitation activities that would violate the rule if engaged in by employees, there is no basis in the record for such a finding here. An unusual reason for an inguinal swelling: De Garengeot's hernia

We present the case of a 71-year-old female with an inguinal swelling. Intra-abdominally the appendix was found in a femoral hernia sac (De Garengeot’s hernia). A laparoscopic transabdominal preperitoneal hernia repair procedure was performed with uneventful post-operative course. Clinical presentation of this type of hernia is unspecific and often not to be distinguished from a common incarcerated hernia. Computed tomography can be helpful in obtaining a diagnosis, although the definite diagnosis is mostly found intraoperatively. As surgical options are numerous, there is no consensus on the most suitable one. A laparoscopic approach incorporates the benefit of a total abdominal overview and the possibility of standard procedures. If the appendix appears normal, the use of synthetic mesh is considered safe and an incidental appendectomy is not necessarily required

Conference Report - 2004 National Diversity in Libraries Conference: “Diversity in Libraries: Making It Real”

“Diversity in Libraries: Making It Real” was the topic and the objective of the 2004 National Diversity in Libraries Conference. Intentionally designed to focus on pragmatic, real-world approaches to fostering diversity, the gathering took place May 4-5 at the brand new Georgia Tech Hotel and Conference Center in Atlanta, Georgia. A record 300 librarians from across the country – and a few from other nations – responded to the call and came together for two days of learning and sharing experiences about this important issue. This Open Textbook for Public Speaking was first created under a Round Three ALG Textbook Transformation Grant. Since then, the book has undergone three new editions. Authors\u27 Description: 4th Edition: Changes to be added here soon. 3rd Edition: Exploring Public Speaking: The Free College Public Speaking Textbook began as the brainchild of Dr. Kris Barton, Chair of the Department of Communication at Dalton State College. It also was made possible through a generous Textbook Transformation Grant in 2015 from Affordable Learning Georgia, a highly successful program of the University System of Georgia. Dr. Barton asked me to help him author/compile the text. The goal was to provide a high-quality, usable, accessible, and low-cost textbook for the hundreds of students who take COMM 1110 at Dalton State College every year. This course is required of all degree-seeking students. We have been able to save students hundreds of thousands of dollars already with this text. Unexpectedly and happily, the text has also been downloaded close to 14,000 times (as of August 2018) all over the world and has been adopted at many other institutions. Dr. Barton and I worked on creating the textbook from July 2015 until May 2016, with the goal of going live with the text in Summer of 2016. Tragically Dr. Barton passed away in early May, a reality that still does not seem real. He has been greatly missed as a friend, colleague, father, scholar, teacher, and mentor. The launch of the book proceeded; however, due to the loss of Dr. Barton, the ancillaries were not finished. In Summer 2017 I took on a significant revision and updating which I named the Second Edition. I included in that edition information on college student success in the appendices. In January 2018, a colleague, Matthew LeHew, and I won a grant from the University System to create the ancillaries and improve the format for more accessibility. I decided to remove the “Dalton State” from the title and most examples for wider appeal. An appendix on library research retains the information for specific use of Roberts Library on our campus. Over 90% of the book is original with Dr. Barton, me, or other colleagues at Dalton State College. Some parts, specifically from Chapters 9, 10, and 15, are adapted from another open resource public speaking text whose author prefers not to be cited. This Third Edition, along with including necessary updates and being formatted with different software, includes four more appendices: one on online speaking, one on APA, one on humor and storytelling in public speaking, and one on Dalton State’s Library. I have also tried to clarify concepts, to provide “case studies” to show the rhetorical process, and include more outlines and examples. We think this book is especially useful in coverage of PowerPoint, audience responsiveness, ethics in public speaking, special occasion speeches, and structure of speeches. Three ancillaries are available: electronic “flash cards” for study, Powerpoints on the 15 main chapters, and test banks for the 15 main chapters. The HIV-1 late domain-2 S40A polymorphism in antiretroviral (or ART)-exposed individuals influences protease inhibitor susceptibility.

BackgroundThe p6 region of the HIV-1 structural precursor polyprotein, Gag, contains two motifs, P7TAP11 and L35YPLXSL41, designated as late (L) domain-1 and -2, respectively. These motifs bind the ESCRT-I factor Tsg101 and the ESCRT adaptor Alix, respectively, and are critical for efficient budding of virus particles from the plasma membrane. L domain-2 is thought to be functionally redundant to PTAP. To identify possible other functions of L domain-2, we examined this motif in dominant viruses that emerged in a group of 14 women who had detectable levels of HIV-1 in both plasma and genital tract despite a history of current or previous antiretroviral therapy.ResultsRemarkably, variants possessing mutations or rare polymorphisms in the highly conserved L domain-2 were identified in seven of these women. A mutation in a conserved residue (S40A) that does not reduce Gag interaction with Alix and therefore did not reduce budding efficiency was further investigated. This mutation causes a simultaneous change in the Pol reading frame but exhibits little deficiency in Gag processing and virion maturation. Whether introduced into the HIV-1 NL4-3 strain genome or a model protease (PR) precursor, S40A reduced production of mature PR. This same mutation also led to high level detection of two extended forms of PR that were fairly stable compared to the WT in the presence of IDV at various concentrations; one of the extended forms was effective in trans processing even at micromolar IDV.ConclusionsOur results indicate that L domain-2, considered redundant in vitro, can undergo mutations in vivo that significantly alter PR function. These may contribute fitness benefits in both the absence and presence of PR inhibitor

Understanding the science of portion control and the art of downsizing

Offering large portions of high-energy-dense (HED) foods increases overall intake in children and adults. This is known as the portion size effect (PSE). It is robust, reliable and enduring. Over time, the PSE may facilitate overeating and ultimately positive energy balance. Therefore, it is important to understand what drives the PSE and what might be done to counter the effects of an environment promoting large portions, especially in children. Explanations for the PSE are many and diverse, ranging from consumer error in estimating portion size to simple heuristics such as cleaning the plate or eating in accordance with consumption norms. However, individual characteristics and hedonic processes influence the PSE, suggesting a more complex explanation than error or heuristics. Here PSE studies are reviewed to identify interventions that can be used to downsize portions of HED foods, with a focus on children who are still learning about social norms for portion size. Although the scientific evidence for the PSE is robust, there is still a need for creative downsizing solutions to facilitate portion control as children and adolescents establish their eating habits
