Kedudukan Hukum PERMA Nomor 2 Tahun 2012 dalam Perspektif Sistem Peradilan Pidana (Studi di Pengadilan Negeri Kelas I Kupang)

This study aims to determine the position and the application of criminal penalties in accordance with the Supreme Court Decree Number 2 of 2012 concerning Adjustment of Limitation of Minor Crime and Amount of Fine in the Penal Code from the Perspective of the Criminal Justice System. The nature of research is normative legal research. Data in the form of court decision was take from the Kupang District Court. Study was made against the theft case involving an accused named Yohamir Amtiran Alias Hamir Amtiran which is registered in the mentioned court numbered 205/ Pen.Pid / 2015 / PN.KPG. The accused person has been alleged for having stolen two watches, one with Giotana brand, silver-colored boxy, and another one with SEIKO brand, spherical gold. The theft was committed at night in a house owned by Indriani Listya Purwanti Indri alias Indri located in BSB Housing Complex, Puri Lontar Street, Oebufu Village, Oebobo Subdistrict, in Kupang. The economic value of the stolen properties is approximately Rp 1,500,000.00 (one million and five hundred thousand rupiahs). The accused was tried with the ordinary criminal proceedings and put under detention. It is clear that the judges have not yet implemented the above mentioned Supreme Court Decree

Mirror Sinkhorn: Fast Online Optimization on Transport Polytopes

Optimal transport is an important tool in machine learning, allowing to capture geometric properties of the data through a linear program on transport polytopes. We present a single-loop optimization algorithm for minimizing general convex objectives on these domains, utilizing the principles of Sinkhorn matrix scaling and mirror descent. The proposed algorithm is robust to noise, and can be used in an online setting. We provide theoretical guarantees for convex objectives and experimental results showcasing it effectiveness on both synthetic and real-world data.Comment: ICML 202

A review of biochar influences on crop outputs and soil assets

Biochar used in soils aims at intensifying the properties of soil and the transfer of amounts of conservative remnant energy centred fertilizers as well as the restoration of rich carbons. Biochar steadiness is vital to reckoning the effect of biochar modifications on atmospheric green gas (GHG) which remains unsatisfactory. The making and mixture of biochar in soils has a vital role in the mitigation of climate change. The objective of this paper was to review the influences of biochar on crop outputs and soil assets. It is needful for additional clarification on the improvement of biochar application to several crop yields to advance general recognition as a soil modification. The biochar feedstock used for production and pyrolysis condition and the application rate of biochar for crop productivity is described in the discussion. Furthermore, agronomic benefits and the strategies as well as the recommendations for the use of biochar is discussed. It is concluded that the use of biochar increases the physical assets and crop output. Tolerance Analysis by Polytopes

To determine the relative position of any two surfaces in a system, one approach is to useoperations (Minkowski sum and intersection) on sets of constraints. These constraints aremade compliant with half-spaces of R^n where each set of half-spaces defines an operandpolyhedron. These operands are generally unbounded due to the inclusion of degrees ofinvariance for surfaces and degrees of freedom for joints defining theoretically unlimiteddisplacements. To solve operations on operands, Minkowski sums in particular, "cap" halfspacesare added to each polyhedron to make it compliant with a polytope which is bydefinition a bounded polyhedron. The difficulty of this method lies in controlling the influenceof these additional half-spaces on the topology of polytopes calculated by sum or intersection.This is necessary to validate the geometric tolerances that ensure the compliance of amechanical system in terms of functional requirements

Analytical study on indications of primary cesarean section in tertiary care hospital

Background: Cesarean delivery is a commonest obstetric surgical procedure performed. WHO stated that regional cesarean section rate should not exceed 10 to 15%. However in many countries cesarean delivery has increased steadily over years. Hence present study is conducted to analyze various indications of primary cesarean section in a tertiary hospital, with an aim to reduce cesarean section rate.Methods: This is a retrospective study conducted in Cheluvamba hospital, Mysore Medical College Research Institute, Mysore, which is a tertiary care centre. For a period of 6months from 1st June 2018 to 31st November 2018Inclusion criteria: All primary cesarean section done at Cheluvamba hospital during study period were included.Exclusion criteria: Previous cesarean section, patients with previous history of laparotomy done for any obstetric or gynecological cause were excluded.Results: During the study period there was 3799 number of cesarean section. Amongst these 983 cases were primary cesarean section done for varying indications. Hence the rate of cesarean section in our hospital is 25.87%. There were 40.3% cases of fetal distress, failed induction (13.6%), breech (10%), CPD (8%), IUGR with poor BPP (1.8%) Ante partum haemorrhage (3%), DTA (3.5%).Conclusions: From our study, we would conclude that rising trend in cesarean section is an alarming issue. Measures need to be taken to reduce cesarean delivery like Regular use of partograph, Judicious use of amniotomy, oxytocin with inducing agents, Expertization of skills to conduct instrumental vaginal delivery, which is a lost art in modern obstetrics

Pankkien asiakkaisiin kohdistuvat verkkohuijaukset : Pankin ja asiakkaan välinen vastuunjako sekä riskienhallintakeinot

Digitaalisten pankkipalveluiden käyttö on lisääntynyt koronapandemian ja tek- nologian kehityksen myötä, jonka seurauksena rikollisten tavat toteuttaa verkossa huijauksia ovat lisääntyneet ja monimutkaistuneet maailmanlaajuisesti. Suomessa verkossa huijauksen kohteeksi joutuneiden määrä kasvaa vuosi vuodelta ja vuonna 2022 suomalaiset menettivät ver- kon kautta 32,4 miljoonaa euroa huijareille muun muassa romanssihuijauksissa, sijoitushuijauk- sissa, tietojen kalastelussa ja valepoliisihuijauksissa. Huijareille menetetty summa olisi paljon suurempi, elleivät viranomaiset ja pankit olisi onnistuneet estämään 14,5 miljoonan euron välit- tymisen huijareille ja palauttamaan varat uhreille. Rikolliset suunnittelevat ja toteuttavat huijaukset hyödyntäen psykologisia keinoja ja vetoavat ihmisen perustunteisiin, kuten pelkoon, rakkauteen ja ahneuteen. Tietyt käyttäytymismallit joh- tavat siihen, ettei huijauksen kohde kykene harkitsemaan toimintaansa rationaalisesti, jonka vuoksi huijauksen torjuntaan voidaan hyödyntää käyttäytymistaloustiedettä. Petostapauksissa pankkien voi olla hyvin haastavaa tunnistaa, kun asiakkaan pankkitunnuksia käytetään oikeudet- tomasti ja joissain tapauksissa asiakas on itse manipuloitu suorittamaan maksu omalla laitteel- laan. Usein pankin perinteiset väärinkäytösten monitorointijärjestelmät eivät kykene havaitse- maan kaikkein moderneimpia huijaustapoja, jonka vuoksi on tärkeää, että pankki tuntee asiak- kaan tavanomaisen toiminnan ja siitä poikkeavan toiminnan. Vuonna 2018 tulleen PSD2- mak- supalveludirektiivin tavoitteena on muun muassa verkkomaksamisen turvallisuuden lisääminen ja väärinkäytöksien väheneminen. Kyseinen direktiivi voi myös luoda uusia mahdollisuuksia hui- jareille, sillä sen myötä ulkopuoliset palveluntarjoajat pääsevät tarkastelemaan asiakkaiden ti- lejä ja maksutapahtumia. Kansallisen maksupalvelulainsäädännön kannalta pankin ja asiakkaan välinen vastuunjako verkkohuijaustapauksissa kulminoituu siihen, miten asiakkaan katsotaan menetelleen huolimattomasti tai jopa törkeän huolimattomasti. Lainsäädännön vaikuttavuutta voidaan arvioida sillä, kuinka onnistuneesti lainsäädännölle asetetut tavoitteet voidaan saavuttaa. Viranomaiset, pankit ja muut sidosryhmät voivat hallita verkkohuijauksista syntyviä riskejä. Keskeisemmäksi keinoksi huijauksien ennaltaehkäisemiseksi on todettu kansalaisten oman valppauden ja tietoisuuden lisääminen. Rahanpesulaki edellyttää, että pankit ovat selonotto - ja ilmoitusvelvollisia, joka tarkoittaa, että pankin tulee selvittää lii- ketoimen tarkoitus havaitessaan tavanomaisesta poikkeavan tai epäilyttävän liiketoimen. Pan- killa on myös velvollisuus muodostaa riskiarvio, jonka avulla pystytään tunnistamaan ja ymmär- tämään omaan toimintanan liittyvät rahanpesun ja terrorismin rahoittamisen riskit sekä laati- maan ja toteuttamaan riskienhallintakeinoja oikeassa mittasuhteessa. Pankki voi asettaa asiak- kaan tehostettuun tuntemiseen, jos riskiarvion perusteella voidaan todeta, että asiakkaaseen liittyy tavanomaista suurempi rahanpesun ja terrorismin rahoittamisen riski. Pankit tekevät tii- vistä yhteistyötä viranomaisten kanssa ja toimittavat tietoa huijauksista. Viranomaisten ja sidos- ryhmien epäselvät yhteistyömallit kuitenkin edesauttavat huijareiden toiminnan menestykselli- syyttä, vaikka viranomaisten yhteistyö eri sidosryhmien kanssa tulisi olla mahdollisimman laajaa, jotta huijauksia voitaisiin torjua tehokkaasti
