Protection of persons with disabilities in Turkish Law
Los derechos de las personas discapacitadas desde la perspectiva del derecho privado; si pueden hacer valer y disfrutar de algún derecho o trato especial en el marco del derecho civil y ante los tribunales civiles nunca se han evaluado en la doctrina turca. En este estudio, hemos intentado tomar como punto central la práctica de los tribunales civiles y nos hemos centrado en la legislación de derecho privado que suele ser objeto de jurisprudencia. En consecuencia, hemos abordado ciertos derechos de las personas con discapacidad previstos en la CDPD, es decir, la igualdad de reconocimiento ante la ley, el acceso a la justicia, el respeto al hogar y a la familia, el trabajo y el empleo, que pueden tener aspectos de derecho privado, y hemos investigado si la ley y su práctica están en consonancia con la CDPD. Además, la igualdad y la no discriminación han sido objeto de varias decisiones del Tribunal Europeo de Derechos Humanos (TEDH) en las que los demandantes son ciudadanos turcos con discapacidades. Por lo tanto, hemos dedicado una sección de este estudio a estas decisiones y a su impacto en las recientes decisiones del Tribunal Constitucional turco dictadas en relación con solicitantes en circunstancias similares
Optimum positioning for AP pelvis radiography : a literature review
Aim
Pelvic radiography is used for the identification of hip joint changes, including pathologies such as osteoarthritis. Several studies have recommended that the position for this radiological procedure should be standing, not supine, to reflect the functional appearances of the hip joint. The aim of this review was to evaluate pelvis radiography positioning with respect to the image appearances and information provided for clinical decision-making. Aside from this, potential recommendations to the radiographic technique for an erect pelvis projection will be considered.
Method
A literature search was performed using databases/abstract systems (ScienceDirect, Web of Science, PubMed, and MEDLINE). Only articles written in English were included.
Results
Twenty-five articles were identified. Findings from the review describe the effect of repositioning from supine to erect on a series of specific hip measurements. These include pelvic tilt, joint space width, and the acetabular component.
Conclusion
Evidence within the literature illustrates that in several studies, there were differences when repositioning from supine to standing for a number of pelvic metrics. Standing positioning is promoted by some authors since this may facilitate the early diagnosis of hip joint pathology and assist in the planning of surgical interventions. Literature is very limited on how to optimally perform erect pelvis radiography, and this should be an area for future research
Antinuclear antibody testing in a Turkish pediatrics clinic: is it always necessary?
Introduction: the term anti-nuclear antibody (ANA) is used to define a large group of autoantibodies which specifically bind to nuclear elements. Although healthy individuals may also have ANA positivity, the measurement of ANA is generally used in the diagnosis of autoimmune disorders. However, various studies have shown that ANA testing may be overused, especially in pediatrics clinics. Our aim was to investigate the reasons for antinuclear antibody (ANA) testing in the general pediatrics and pediatric rheumatology clinics of our hospital and to determine whether ANA testing was ordered appropriately by evaluating chief complaints and the ultimate diagnoses of these cases.
Methods: the medical records of pediatric patients in whom ANA testing was performed between January 2014 and June 2016 were retrospectively evaluated. Subjects were grouped according to the indication for ANA testing and ANA titers.
Results: ANA tests were ordered in a total of 409 patients during the study period, with 113 positive ANA results. The ANA test was ordered mostly due to joint pain (50% of the study population). There was an increased likelihood of autoimmune rheumatic diseases (ARDs) with higher ANA titer. The positive predictive value of an ANA test was 16% for any connective tissue disease and 13% for lupus in the pediatric setting.
Conclusion: in the current study, more than one-fourth of the subjects were found to have ANA positivity, while only 15% were ultimately diagnosed with ARDs. Our findings underline the importance of an increased awareness of correct indications for ANA testing
The Applicable Law to Proprietary Issues on Digital Assets Considering Recent Developments: Lex Rei Sitae or Not?
The legal nature of digital assets and the applicable law for digital assets have been debated in recent years in many legal systems, including Turkish law. The inability to reach a definite conclusion on evaluating the legal nature of digital assets in Turkish law makes it difficult to determine the applicable law to proprietary issues on digital assets in private international law. In the context of conflict of laws rules, determining the applicable law for rights over digital assets depends more on the medium in which the asset is recorded than its function. National legislators and legal institutions are seeking new connecting factors beyond the traditional lex rei sitae principle, given that digital assets predominantly exist in electronic environments. Therefore, our study aims to address how to bridge the gap in Turkish private international law concerning the applicable law for digital asset proprietary issues by drawing on comparative law developments. © 2025 Elsevier B.V., All rights reserved

In the current study, 52 six year old children (26 boys and 26 girls) attending a preschool education institution were studied to assess the impact of a memory education program applied to them to learn to what extent the program affected their memory improvement. Children's Memory Scale (CMS), developed by Morris Cohen (1997), was used to collect data. The test group (n=26) was applied a supportive educational program for memory improvement verbally and visually two days per week and for two weeks only. Mann Whitney U test and Wilcoxon Signed Rank Test were used in the analysis of the data. It was found that the program applied resulted in a significant increase in the scores of these children's general memory

LA PROTECCIÓN DE LAS PERSONAS CON DISCAPACIDAD EN LA LEGISLACIÓN TURCA
IThe rights of disabled persons from a perspective of private law; whether they can assert and enjoy any rights or special treatment under the civil law and before the civil courts have never been evaluated in the Turkish doctrine. In this study, we tried to take civil court practice as our center point and focused on private law legislation which frequently constitute subject of case-law. Consequently, we have dealt with certain rights of the disabled people provided in the CRPD; i.e., equal recognition before the law; access to justice; respect for home and the family; work and employment, which may have private law aspects and inquired whether the law and its practice is in concord with the CRPD. Additionally, equality and non-discrimination have been subject to a number of European Court of Human Rights (ECtHR) decisions where the applicants are Turkish citizens with disabilites. We have, therefore, devoted a section in this study, to these decisions and their impact on the recent Turkish Constitutional Court decisions rendered concerning applicants in similar circumstances. © 2022 Ibero-American Law Institute.
