    Immigration Legislation and Issues in the 114th Congress

    The House and the Senate have considered immigration measures on a variety of issues in the 114th Congress. The Consolidated Appropriations Act, 2016 (P.L. 114-113) extends four immigration programs through September 30, 2016: the EB-5 immigrant investor Regional Center Pilot Program, the E-Verify employment eligibility verification system, the Conrad State program for foreign medical graduates, and the special immigrant religious worker program. P.L. 114-113 also contains provisions on the Visa Waiver Program and certain nonimmigrant visa categories. Other enacted immigration-related measures include the Border Jobs for Veterans Act of 2015 (P.L. 114-68) on border security personnel, the Adoptive Family Relief Act (P.L. 114-70) on intercountry adoption, and the National Defense Authorization Act for Fiscal Year 2016 (P.L. 114-92) on the Afghan special immigrant visa program. The House has passed several other immigration-related bills. Among them are the Northern Border Security Review Act (H.R. 455), the Preclearance Authorization Act of 2015 (H.R. 998), the Border Security Technology Accountability Act of 2015 (H.R. 1634), the Enforce the Law for Sanctuary Cities Act (H.R. 3009), and the American SAFE Act of 2015 (H.R. 4038). H.R. 998 has also been reported by the Senate Homeland Security and Governmental Affairs Committee with an amendment in the nature of a substitute. In addition, various bills on border security, interior enforcement, visa security, and asylum, among other issues, have been considered by a House or Senate committee. Border security- related measures have been reported or ordered to be reported by the House Homeland Security Committee (H.R. 399, H.R. 3583, H.R. 3586), or the Senate Homeland Security and Governmental Affairs Committee (S. 750, S. 1808, S. 1864,S. 1873). Interior enforcement provisions are included in bills ordered to be reported by the House Judiciary Committee (H.R. 1147, H.R. 1148, H.R. 1153) or reported by the House Appropriations Committee (H.R. 3128). S. 1635, as reported by the Senate Foreign Relations Committee, also contains interior enforcement- related provisions. Several of these interior enforcement bills also contain key provisions on other immigration issues. Among the other issues addressed in these bills are employment eligibility verification (H.R. 1147); visa security and naturalization (H.R. 1148); and expedited removal, asylum, parole, and unaccompanied alien children (H.R. 1153). H.R. 1149, as ordered to be reported by the House Judiciary Committee, also addresses unaccompanied alien children. This report discusses these and other immigration-related issues that have received legislative action or are of significant congressional interest in the 114th Congress.     The U.S. Supreme Court’s race jurisprudence suffers from a stunning lack of imagination where possibilities for meaningful local government involvement in combating structural racial inequality are concerned. Cases such as Parents. and Ricci limit dramatically the freedom that localities have to address racial inequity within their borders. Instead of constraints on local efforts in the race context, Professor Lenhardt argues that what we need, if persistent racial inequalities are ever to be eliminated, is greater innovation and experimentation. In this article, Professor Lenhardt thus introduces an extra-judicial tool called the race audit, which would permit individual cities or a regional coalition of localities voluntarily to determine the extent to which their governmental systems and policies create, enable, or perpetuate inequitable conditions for racial minorities. This tool, grounded in the tenets of structuralism, breaks from traditional audit mechanisms in the race context by eschewing a singular focus on intentional discrimination. Instead, it seeks to uncover the specific structural mechanisms that generate cumulative racial disadvantage across domains, time and generations by, inter alia, being attuned to the spatial dimensions, meaning, and operation of race in the United States. The race audit’s main goal – which falls outside the reach of most existing tools for measuring discrimination – would be achieved through the work of a “community of inquiry” consisting of academics, philanthropic organizations, non-profits and civil rights groups, governmental agencies, and business leaders charged with assessing the segregative effects of the locality’s policies and programs. The race audit process, whose results might be similar to those produced by truth and reconciliation commissions, would produce a counter-narrative about race in metropolitan areas whose telling would have numerous benefits, including generating more effective remedies for addressing structural discrimination, and promoting democratic conversations about equality and what is necessary to secure belonging at the local level. Most of all, the race audit would make apparent the deep potential cities have for being important “equality innovators.” designed to identify the sources of persistent racial inequality that can be productively deployed by localities. This tool, grounded in the tenets of structuralism, eschews a singular focus on intentional discrimination. Instead, it seeks to uncover the specific structural mechanisms that create cumulative racial disadvantage across domains, time, and generations by, inter alia, being attuned to the spatial dimensions, meaning, and operation of race in the United States. The race audit process, in addition to highlighting the capacity of localities to be important change agents, would help produce a counternarrative about race and the seeming naturalness of the racial segregation and disadvantage now evident in urban and suburban areas alike. The Author contends that, in doing so, the race audit would identify better, more effective strategies for alleviating structural racial inequality. Situating the race audit proposal in a larger project on the commitments underlying civil rights advocacy more broadly, she highlights the potential that the race audit and other innovative tools might have to spur democratic conversations about race and the conditions necessary for belonging at the local level; generate a thicker, more substantive account of equality than has thus far been forthcoming in U.S. Supreme Court cases; and reconcile the perceived tensions between notions of equality and liberty in the area of race

    The design has gradually been considered by people as an important element for organizations, reinforcing their identities and consequently their image perceived by the society. The design assumes the compromise of intermediate the communication process producer-consumer, aggregating and highlighting the value of the products, in order to create a concept that reflects and increments their main characteristics. In this context, we listed and discussed the basic dimensions of the proposed model, identifying their influences and connections in the sector of agriculture and of aquaculture. In the case of the model of 7I’s, it is possible to identify in the same context the need of opting for actions aimed to the integration of the areas as a way to ensure more comprehensive solutions, thus bringing in it innovations at different levels (basic incremental and radical, as well as the social innovations). Additionally there is an intervention process with proactive characteristics (preferentially) which may similarly potentialize the interaction of all involved at all levels, in an intelligent and articulated form. Besides, it generates a feedback process in an integral form. All this leads to the shaping of a systemic approach of the situation. Social innovation and integration can be achieved through the implementation of actions of design. In this article we present cases occurring in sectors of agriculture and family aquaculture, in which, through of a suggestion of applied design management, it was possible to check positive results. The partnerships established between the government, university and other copartners, as well as with the producers themselves, have been resulting in concrete and evident actions of improvement on weaknesses detected in the sectors being studied. With systematic and planned procedures of management and design, it was possible to transform some actualities, by having them measured, quantitatively at points of sale, and qualitatively based on perception of consumers/users

    Place matters: but does local leadership?

    The arrival of New Labour into Government witnessed the prominent re-emergence of place onto the policy agenda. This heralded a range of area-based-initiatives designed to both tackle neighbourhood forms of deprivation and to re-establish a sense of identity and connection between individuals and their local community. In terms of place-making, effective and inclusive participation, representation and leadership were all identified as prerequisites for the creation of sustainable communities . But how important is local leadership and strategic vision within local public service organisations in achieving the desired place-making outcomes? This paper examines the extent to which local leadership and strategic vision represents a significant factor in promoting higher levels of satisfaction, belonging, cohesion and participation across single tier councils in England. The ensuing empirical evidence raises significant questions not only about the importance of local leadership in place-making, but also the environmental and organizational factors that shape local places

    Geographic variation in U. S. populations of the tiger beetle Cicindela obsoleta Say (Coleoptera: Cicindelidae)

    Geographic variation and subspecific taxonomy of United States populations of the tiger beetle Cicindela obsoleta Say are reviewed. Study of primary types and 1,424 museum specimens indicates that four subspecific entities are present in the U.S., for which the valid names are C. o. obsoleta Say, C. o. santaclarae Bates, C. o. vulturina LeConte, and C. o. neojuvenilis Vogt. All four subspecies are illustrated, including many color variants. ArcView Geographic Information System (GIS) computer software is used to study the distribution of these subspecies in the United States. Cicindela o. obsoleta and C. o. santaclarae are only partially allopatric, with extensive areas in Arizona, New Mexico, and Texas where their distributions overlap. Specimens intermediate in their elytral markings between C. o. obsoleta and C. o. santaclarae are reported from localities in New Mexico and Texas where these two subspecies co-occur. In contrast, C. o. vulturina and C. o. neojuvenilis are largely allopatric and show little intergradation with the C. o. obsoleta - C. o. santaclarae complex. It has been suggested recently that disjunct (but as yet unnamed) populations of C. o. vulturina in Missouri and Arkansas may represent a separate subspecies of C. obsoleta. However, the color and elytral pattern characteristics which have been interpreted as diagnostic features of these disjunct populations are also found in many Texas populations of C. o. vulturina, suggesting that the Arkansas and Missouri populations do not merit recognition as a separate subspecies on the basis of these characters alone

    Cryptic diversity: Two morphologically similar species of invasive apple snail in Peninsular Malaysia

    Invasive snails in the genus Pomacea have spread across Southeast Asia including Peninsular Malaysia. Their effects on natural and agricultural wetlands are appreciable, but species-specific effects are less clear because of morphological similarity among the species. Our objective was to establish diagnostic characteristics of Pomacea species in Malaysia using genetic and morphological criteria. The mitochondrial COI gene of 52 adult snails from eight localities in Peninsular Malaysia was amplified, sequenced, and analysed to verify species and phylogenetic relationships. Shells were compared using geometric morphometric and covariance analyses. Two monophyletic taxa, P. canaliculata and P. maculata, occurred in our samples. The mean ratio of shell height: aperture height (P = 0.042) and shell height: shell width (P = 0.007) was smaller in P. maculata. P. maculata co-occurred with P. canaliculata in five localities, but samples from three localities contained only P.canaliculata. This study is the first to confirm the presence of two of the most invasive species of Pomacea in Peninsular Malaysia using a molecular technique. P. canaliculata appears to be the more widespread species. Despite statistical differences, both quantitative and qualitative morphological characteristics demonstrated much interspecific overlap and intraspecific variability; thus, shell morphology alone cannot reliably verify species identity. Molecular techniques for distinguishing between these two highly invasive Pomacea species are needed to understand their specific ecological niches and to develop effective protocols for their management

    Localities as Equality Innovators

    This Article thus argues that instead of regarding cities and localities that, like Seattle and Louisville, try to develop serious solutions to existing racial disparities as bad cities no different from those whose notorious policies spurred the civil rights movement of the 1950s and 1960s, we should be regarding them as potential equality innovators.” Their on-the-ground experience with the realities of race and its operation in the twenty-first century arguably places them in a better position than courts to develop innovative approaches to the structural racial inequities with which so many municipalities must grapple. Existing doctrine limits dramatically the ability of courts to confront in any meaningful way how localities and the people that inhabit them actually navigate race

    Employing geographical principles for sampling in state of the art dialectological projects

    The aims of this paper are twofold: First, we locate the most effective human geographical methods for sampling across space in large-scale dialectological projects. We propose two geographical concepts as a basis for sampling decisions: Geo-demographic classification, which is a multidimensional method used for the socio-economic grouping of areas. We also develop an updated version of functional regions that can be used in sociolinguistic research. We then report on the results of a pilot project that applies these models to collect data regarding the acceptability of vernacular morpho-syntactic forms in the North-East of England. Following the method of natural breaks advocated for dialectology by Horvath and Horvath (2002), we interpret breaks in the probabilistic patterns as areas of dialect transitions. This study contributes to the debate about the role and limitations of spatiality in linguistic analysis. It intends to broaden our knowledge about the interfaces between human geography and dialectology
