    The legal issue to be discussed in this article is the involvement of the Constitutional Court in adjudicating issues concerning the relationship between national – local government in general, and the distribution of power to the local government in particular. To be more specific, this article will criticise by delivering a casenote over the Constitutional Court decisions, i.e. Decision Number 87/PUU-XIII/2015, Decision Number 137/PUU-XIII/2015, Decision Number 30/PUU-XIV/2016 and Decision Number 56/PUU-XIV/2016. The casenote will notify the need to a deeper conceptual understanding of the differences between unitary State and federalism principles and its implication in giving prescriptions. This is a response to the Constitutional Court’s judicial opinion which tends weightier to federalism, instead of unitary State principle. According to this situation, it is recommended that the Constitutional Court should not review the constitutionality of laws which contain the legal issues concerning the relationship between national – local government in general, and the distribution of power to the local government in particular.     The background of this research was m­banking users in Indonesia is still low despite the mobile phone users in developed and developing countries in the world has increased rapidly since 21st century. Some bank companies in Indonesia has been offering m­banking service but the use of m­banking for financial transaction is still low and limited. The objectives of this research was to analyze the antecedents of attitude towards m­banking and its impact on behavioral intention to adopt m­banking. The design of this research applies hypothesis testing. 200 samples selected from prospective user of 3 government bank. The sampling technique was purposive sampling with cross­sectional study. Data analysis used in this research was collected by questionnaire technique with item of statements for each variable. In order to obtain valid and reliable instrument tool, validity and reliability test has been done. The result of this research conclude that there is positive effect perceived usefulness, perceived ease of use, perceived competence, perceived communication, perceived privacy and security, society influence, and facilitating condition on attitude towards m­banking. This study supports that there is positive influence on attitude towards m­banking on behavioral intention to adopt m­banking

    Menguji Ketangguhan Realisme: Kritik terhadap Putusan Mahkamah Konstitusi Nomor 14/PUU-XI/2013 Pasca Pemilu Serentak 2019

    Artikel ini hendak menelaah Putusan Mahkamah Konstitusi Nomor 14/PUU-XI/2013 dikaitkan dengan hasil pemilu serentak 2019. Objek dari kritik yang hendak dilakukan adalah ketepatan dari penggunaan pendekatan realisme sebagai teori ajudikasi oleh MK dalam memutuskan konstitusionalitas Undang-Undang Nomor 42 Tahun 2008 tentang Pemilihan Presiden. Dapat disimpulkan bahwa, berdasarkan hasil pemilu serentak, putusan MK tidak berhasil dalam memperkuat presidensialisme di Indonesia melalui teori efek ekor jas, seperti harapan MK. Menanggapi kegagalan tersebut artikel ini menyarankan supaya penggunaan pendekatan realisme harus mengantisipasi falibilitasnya. Menanggapi isu yang lebih umum, artikel ini mengajukan usulan untuk perubahan konstitusi guna menata ulang mekanisme pengujian yudisial sesuai dengan model Kanada yang secara konseptual dikenal sebagai pengujian yudisial dengan finalitas legislatif. Rekomendasi tersebut bertujuan mengantisipasi kesalahan yudisial dalam interpretasi konstitusi seperti ditunjukkan oleh Putusan MK Nomor 14/PUU-XI/2013.This article examines Constitutional Court Decision Number 14/PUU-XI/2013 following the simultaneous elections of 2019. The object is the correctness of the utilisation of realism as a theory of adjudication by the Court in deciding the constitutionality of Law Number 42 of 2008. It can be concluded that, the Court’s decision is false, i.e. it fails to strengthen presidential in Indonesia, as expected by the Court, according to coattail effect theory. Hence, responding to this failure, this article suggests a caveat that the utilisation of realism should anticipate its fallibility. Therefore, responding to the issue to be more general, this article also suggests a proposal for a constitutional amendment to restructure the judicial review mechanism in accordance with the Canadian model known as, conceptually, judicial review with legislative finality. The recommendation aims to anticipate judicial error in constitutional interpretation as shown by the Constitutional Court Decision Number 14/PUU-XI/2013

    Ecojustice, Religious Folklife and a Sound Ecology

    Folk, traditional, and indigenous ecological knowledges have a significant role to play in ecojustice. A case study in the traditional ecological knowledge among one of the religious communities with whom I have spent several decades illustrates how they embody the main principle and three fields of an ecological rationality: the community of inter-related beings; the ways the beings participate in that community or place; and the relations of nature and the nonhuman world to humans and human nature. Ecological rationality stands in contrast to economic rationality, a branch of instrumental reason exemplified by what economists call rational choice theory. An ecological rationality is based in the principles of connection, relation, engagement, cooperation and interdependence, in contrast to the economic rationality of separation, distance, individualism, and self-interest. I conclude with a gesture to my current project of a sound ecology, a thought experiment in which sounds rather than texts or objects enable the connections that lead to sound experience, sound communities, sound economies, and a sound ecology. A sound ecology embodies an ecological rationality aimed at who we think we are, how we know what we know, and what we can do to bring about ecojustice in a sustainable world

    Judicial interpretation of the right to be free from discrimination is a central issue in the practice of judicial review of the constitutionality of legislation by the MKRI. This article tries to describe and systematize this practice and then to restate the legal principles as it is stated by the MKRI into its case law.     There is a strong commitment that constitutional adjudication should be more predictable. As a principle, what has been rightly decided in the past should be the law for the future cases or controvercies. This article makes a substantial critics directed to the constitutional court of decision Number 14/PUU-XI/2013 on the constitutionality of presidential election rules. This articles argues that the decision shows that predictability is still a serious matter in constitutional adjudication in Indonesia. The author then recommends that to be more predictable the constitutional of court should make a judicial tradition for respecting its past right decisions
