Stan obecny i przyszłość czołowego organu nauk historycznoprawnych w Polsce. Uwagi do dyskusji

Pod koniec XX wieku, zwłaszcza po zmianie ustrojowej 1989 roku, pojawiła się – nie nowa zresztą – tendencja zmierzająca do przebudowy przedmiotów historycznoprawnych. Dążyć poczęto do usunięcia tych przedmiotów z programu pierwszego roku studiów, gdzie tradycyjnie służyły jako wprowadzenie do nauki prawa. Już wcześniej dążyć poczęto do ich kumulacji w postaci dwóch kierunków: historii ustroju oraz historii prawa. W niektórych ośrodkach trwale tego dokonano. Refleksje o nauce historii prawa, jej „Czasopiśmie Prawno-Historycznym” i jego Redaktorze

Zachętę do napisania tych uwag stanowiły dwie okoliczności. Jednej z nich dostarczył skromny, ale istotny jubileusz – publikacja sześćdziesiątego szóstego tomu „Czasopisma Prawno-Historycznego”. Drugą stanowiła konferencja Komitetu Redakcyjnego „Czasopisma”. Odbyła się ona 9 września 2014 r. w Instytucie Historii Prawa Uniwersytetu Warszawskiego. Doprowadziła do dalszych dyskusji, niesformalizowanych i prowadzonych de omnibus rebus et quibusdam aliis, ale interesujących i wartościowych. Obydwie te okoliczności zasługują na omówienie

Memories of Professor MichałProfessor Dr. Michał Patkaniowski (1907–1972), a distinguished professor at the Faculty of Law and Administration of the Jagiellonian University, had deserved his right to fame as an outstanding scholar and efficient organizer of academic life. His silhouette has been presented in numerous biographical notes, including the Polish Biographical Dictionary. Yet what seems particularly worthy of recalling here are his efforts to expand the library collection of the historical and legal chairs. Thanks to his efforts, the collection became enlarged by over 3000 books which had been withdrawn from the libraries of Krakow courts as well as from the libraries of other courts in Krakow’s surrounding

Remarks on the Reformatory Plans of King John Casimir

The article presents the reformatory ideas of King John Casimir in the years 1655–1658. They are worth mentioning, although they had no chance of being realized. Due to the danger of war the King proposed that the military obligation should be exceeded not only on noblemen, but the Sejm should impose it on representatives of lower estates. The towns should have been transformed into “fortresses of the Commonwealth”, well prepared for effective defence. Also peasants would have to bear new military obligation, by serving in the re-modelled “Lands’ infantry”. In his oath on April 1st, 1656 the King pronounced a considerable limitation of feudal obligations over peasants, such as serfdom. After the war with Sweden he didn’t return to these ideas. In the field of the Commonwealth’s political system, the King proposed limitation of the “liberum veto” system in the Sejm and the reform of free election of the King. These proposals, especially the idea of the election “vivente rege”, i.e. the election of the King during the reign of the previous monarch, were strongly contested by noblemen.
