Andalucía y sus relaciones con la Unión Europea: (aspectos jurídico-políticos)

Cuando en 1986 España ingresa en las Comunidades Europeas, al igual que en el resto de los Estados miembros, se establecen, en el marco de los Tratados constitutivos, una serie de transferencias de competencias soberanas a las Instituciones comunitarias. Por otra parte, España al ser un Estado autonómico, dentro del mosaico que lo constituye transfiere, también, competencias a las Entidades autónomas reguladas por sus correspondientes Estatutos. Ambas transferencias, ad extra y ad intra, se encuentran jurídica y políticamente respaldas por la Constitución Española. Dentro de este contexto, la Unión Europea promueve una serie de políticas comunitarias que tienen como finalidad el desarrollo de las regiones europeas, a través de acciones estructurales y de ayudas económicas. A la Comunidad Autónoma de Andalucía le ha correspondido gozar de importantes beneficios en el marco de estas políticas, por lo que en reiteradas ocasiones ha manifestado su interés, como Comunidad autónoma, de hacer oír su voz en las Instituciones Europeas cuando en éstas se diriman cuestiones que estén dentro del catálogo de las competencias exclusivas atribuidas a la Administración andaluza. Además, a partir de una importante sentencia del Tribunal Constitucional, se ha admitido la posibilidad de que las Comunidades autónomas puedan abrir una Oficina de representación en Bruselas, por lo que la Junta de Andalucía promulga un Decreto, en 1995, con el que formaliza la apertura de una Delegación en la capital comunitaria con la idea de defender los intereses de Andalucía ante las Instituciones de la Unión EuropeaEntering the European Union in 1986, Spain, as the rest of the Member States, transfers, as it is stabilised in the framework of the Treaties, a series of sovereign competences in favour of the communitarian institutions. Being Spain an autonomic State, constituted by a medley of autonomic entities, it transfer, as well, competences to the mentioned entities, which are regulated by its correspondent Statutes. Both transferences, ad extra and ad intra, find it selves supported by the Spanish Constitution. In this context, the European Union promotes a series of communitarian policies that have as main objective the development of the European regions, through structural actions and economic aids. The Autonomic Community, to make its voice been heard in the European Institutions when these are resolving on questions atributed to the Andalusian Administration. Also, from a very important sentence of the Spanish Constitutional Court, it has been admitted the possibility for the Autonomic Communities to open a representation Office in Brussels. In this context, the Junta de Andalucía (Autonomic Goverment) enacted a Decree, in 1995, in which it formalises the opening of a Delegation in the communitarian capital, for the defence of the interest of Andalucía before the European Union Institutions

Advocacy for global commons

In the law treaties of medieval England we already find a definition of the concept of the global commons, which were those lands belonging to the community or to the municipality, that were exploited for common benefit, without belonging to anybody in particular. It is from this medieval legal criterion that the concept was extrapolated to modern times and, today, it is used to define those spaces subject to the interest of the international community. We can point out that the high seas and the remaining sea and oceanic areas, as well as the polar territories, can be classified as such, making a clear distinction between the Arctic as an “icy” sea and Antarctica as a continent. Also the air space outside of the state´s sovereignty as well as outer space, noting that the common boundaries of both spaces have not yet been defined and, that recently, cyberspace has to be added, which is a virtual space that lacks a physical demarcation

The Post-COVID-19 Universe and the Recovery of Individual Freedoms

he emergence of the pandemic generated by COVID-19 has led to a significant reduction in fundamental freedoms, which, although justified as part of the fight against the pathogen, in some situations certain red lines have been crossed. This implies the need to recover the statu quo ante and generate a return to the principles of respect for human rights and to consider a global strategy on what has been called “the post-COVID-19 universe”.EL UNIVERSO DE LA POSCOVID-19 Y LA RECUPERACIÓN DE LAS LIBERTADES INDIVIDUALESLa aparición de la pandemia generada por la COVID-19 ha supuesto una merma importante de las libertades fundamentales que, si bien se ha justificado como parte de la lucha contra el patógeno, en determinadas situaciones se han sobrepasado ciertas líneas rojas. "Against" Bolonia

Se trata de un análisis crítico sobre el llamado Proceso de Bolonia que, demasiado inspirado en el modelo universitario anglosajón, puede llegar a influir negativamente sobre el modelo universitario continental, sin que por ello se nieguen los perfiles aceptables que el mismo posee. Modelos universitarios.   Abstract We make a critical approach to the Bologna process, which is inspired in the Anglo-Saxon model, prevailing upon the Continental University model.
