Implantación y aplicabilidad de la Ley de Promoción de la autonomía personal y atención a las personas en situación de dependencia : reflexión sobre el contexto de Andalucía = Implementations and application of the law for the promotion of personal autonomy and assistance to dependent people : a reflections on the Andalusian context

La reciente aprobación de la "Ley de Promoción de la autonomía personal y atención a las personas en situación de dependencia", ha supuesto la oportunidad para completar el sistema de bienestar social generado para las personas dependientes y, para sólo en parte, permutar el sistema de redes sociales que ha significado, hasta ahora, su único soporte. En este trabajo se examina el contexto social e institucional del contexto andaluz en el que se implanta este instrumento jurídico novedoso, con una presencia destacada de sociedades rurales carentes de servicios y en las cuales opera con más fuerza el apoyo informal y con una estructura demográfica que pronostica en los próximos años un considerable índice de dependencia de personas ancianas y un crecimiento del tramo de edad de los "older Old".The recent Law of Promotion of personal autonomy and attention to dependent people has meant the opportunity to complete the social welfare system generated for the dependent and, perhaps only partly, to change the system of social networks that has meant, until now, their only support. In this article we examine the social and institutional Andalusian context in which the new juridical instrument is implemented, with the significant presence of rural societies lacking in services, in which informal support appears more strongly, and with a demographic structure that allows us to predict a considerable level of dependence of elders and a growth of the so-called “older old” in the next few years

Social Work and Accessibility of Persons with Disabilities in Mexico: Hidden Barriers

This article proposes that a thorough understanding of the concept of diversity should facilitate the full inclusion of all people in society. Furthermore, it proposes that we should look at diversity and inclusion from a community perspective. Consistent with these premises, Mexico has recently taken a significant leap forward by developing programs to serve functionally diverse people. Most significantly, the federal government has created the National Program for the Wellbeing and Development of People with Disabilities that is sponsored by the executive branch of government. The creation of this program followed the dissemination by the National System for the Integral Development of Families, of the work conducted by the National Board for the Development and Inclusion of People with Disabilities (CONADIS, in Spanish), the Advisory Council for the People with Disabilities, other civic organizations, and people with disabilities and their families. The authors conclude that, in spite of the considerable progress observed, there are still invisible or hidden barriers to a full social integration of persons with disabilities

La protección penal del menor : referencia al caso andaluz

La L.O. 5/2000, de 12 de enero, reguladora de la responsabilidad penal de los menores, modifica de forma sustancial todo lo relativo a la protección de los menores. Desde una perspectiva sancionadora-educativa, la ley establece un amplio catálogo de medidas aplicables. Debe primar el interés del menor en la flexible adaptación judicial a la medida más idónea, en función de las características del caso concreto y de la evolución personal del sancionado durante la ejecución de dicha medida. Las medidas a imponer son las siguientes: internamiento en régimen cerrado, internamiento en régimen semiabierto, internamiento en régimen abierto, internamiento terapéutico, tratamiento ambulatorio, asistencia a un centro de día, permanencia de fin de semana, libertad vigilada, convivencia familiar, prestaciones en beneficio de la comunidad, realización de tareas socioeducativas, amonestación, privación del permiso de conducir y privación de las licencias de caza o de armas. Este trabajo pretende analizar si las nuevas medidas establecidas son suficientes para lograr la reinserción del menor delincuente, todo ello unido a la dificultad que se plantea por la descentralización competencial a nivel autonómico para llevar a cabo la ejecución de las mismas.The L.O. 5/2000, January 12th, regulates criminal responsibility of the minors, modifies in a substantial way the entire relative one to the minors protection. From a sanctioned- educational perspective, the law establishes a wide catalog of applicable measures. Minor’s interest should prevail in the flexible judicial adaptation to the most suitable measure, in function of the characteristics of the concrete case and personal evolution of the sanctioned one during the execution of this measure. The measures to impose are the following ones: imprisonment in closed regime, imprisonment in half-open regime, imprisonment in open regime, therapeutic imprisonment, ambulatory treatment, daily attendance to a center, weekend permanency, watched over freedom, family coexistence, provision in assistance of the community, realization of socio-educational works, admonishment, depriving of driving, hunting or gun licences. This work seeks to analyze if new established measures are enough to achieve the delinquent minors rehabilitation, and everything jointly to the difficulty that it set out because of decentralization of competence at autonomous regions level to carry out the execution of the same ones

The development of the dependence system and caregivers in Spain: needs of assistance and new ways of support

Desde la aprobación de la Ley 39/2006 de Promoción de la Autonomía Personal y Atención a las Personas en Situación de Dependencia, se ha producido un aumento de la visibilidad social de las personas cuidadoras en España. En este trabajo se reflexiona sobre las consecuencias de la labor del cuidador/a informal, así como sobre algunas diferencias con respecto al trabajador/a profesional. Analizamos también aspectos que pueden ser positivos y novedosos en el proceso de cuidado: la accesibilidad y las Tecnologías de la Información y la Comunicación. Para ello, hemos utilizado técnicas como el análisis documental, la revisión bibliográfica e información estadística y la matriz de análisis DAFO. Los resultados nos muestran que la mayoría de las cuidadoras informales son mujeres que no tienen igualdad de oportunidades con respecto a otros trabajadores y que necesitan también cuidados._____________________________________________The work of caregivers is paid special attention since the passing of the Law 39/2006 on the Promotion of Personal Autonomy and Care for Dependent Persons in Spain. The present article compares the work of professional and informal caregivers, and considers the relevance of the Technologies of Information and Communication for this field. The paper provides a descriptive and prospective analysis of reality, using techniques such as document analysis, literature review, statistical information and the SWOT technique. The results show that most informal caregivers today are still women who should also be assisted in their task

The woman and the youth: Towards a better effectiveness in the treatment of delinquency

Este artículo intenta un acercamiento a la realidad de la intervención social diseñada por la Ley Orgánica General Penitenciaria, al amparo del artículo 25 de la Constitución española. La finalidad de la pena siempre es la reeducación y la reinserción social del delincuente. Pero la realidad se separa mucho de esta afirmación. La planificación para la actuación de la administración se encuentra de espaldas a los sectores de población implicados. Este desajuste se agrava en el caso de las mujeres y de los jóvenes.This article approaches the reality of the social intervention designed by the General Organic Law of Penitentiaries , under the 25th article of the Spanish Constitution. The purpose of the punishment is always the re-education and the social reintegration of the convict. But the reality is far from this ideal. The planning for the Administration's action fell onto the shoulders of the sectors of population involved. Migraciones y diversidad funcional. Realidad invisible de las mujeres

Given the invisibility of functional diversity in migratory studies and the timid interest of migrations in studies on disability, this work aims to make functional diversity visible, especially to women with functional diversity in migration processes. Based on the analysis of the bibliographic material, the scientific production on migrant women with disabilities is explored through a systematic review of the phenomenon. A typology of people who interact with disability and migration is identified: persons with disabilities who perform the migration; adults who have accessed the disability situation after the migration process or associated with it and minors who, accompanied by their families, migrate to seek better social protection systems that support their disability.Ante la invisibilidad de la diversidad funcional en los estudios migratorios y el tímido interés de las migraciones en los estudios sobre discapacidad, este trabajo tiene como objeto hacer visible la diversidad funcional, especialmente a  las mujeres con diversidad funcional en los procesos migratorios. A partir del análisis del material bibliográfico se explora la producción científica sobre las mujeres con discapacidad migrantes mediante una revisión sistematizada del fenómeno. Se perfila cierta tipología de personas que interactúan con la discapacidad y la migración: personas con discapacidad que realizan la migración; personas adultas que han accedido a la situación de discapacidad después del proceso migratorio o asociado al mismo y menores que acompañados por sus familias migran para buscar mejores sistemas de protección social que apoyen su discapacidad

The past, present, and future of accessible tourism research: A bibliometric analysis using the Scopus database

At present, it is estimated that there are more than 1 billion people with some type of disability worldwide. Against this background, it is important to reconceive every life sphere and activity to ensure the inclusion, participation and equal opportunity of people with disabilities and to promote respect for their capacities and desires as people. The tourism sector is leaving large segments of global society behind. Tourism companies need more training and guidance to address the requirements of tourists who have specific needs or require certain types of support. This study aims to analyze and map the progress in scientific research on accessible tourism. To achievethis objective, this paper presents a bibliometric analysis of scientific paperson accessible tourism published in the Scopus database between 1997 and 2021. The study used the VOSviewer and CiteSpace software to map and visualize publication trends within this field. A total of 254 articles were included, of which 95.6% were original research. These studies were published in 52 countries. Australia is among the countries with high researchproductivity in this field. The most productive journals are Tourism Management and Sustainability (Switzerland), and the most prominent author is Simon Darcy. The analysis of keywords allows us to continually review the opportunities that new information and communication technologies(specifically smartphones and virtual reality) offer for the future development of the accessible tourism sector.Peer Reviewe
