La cooperación intermunicipal en la realización de las obras y los servicios locales (reflexiones a propósito de algunos mecanismos distintos de la creación de entidades supramunicipales
Los municipios más pequeños, con escasa capacidad económica o técnica, se encuentran,
con frecuencia, con dificultades para ejercer sus competencias, en particular para la
prestación de los servicios de carácter obligatorio. Para afrontar este problema, el legislador
ha renunciado a corregir el deficiente mapa municipal, optando por fomentar la creación
de nuevas entidades, de carácter intermunicipal como las Mancomunidades de Municipios,
o interadministrativo como los Consorcios. Pero, en los últimos tiempos, han surgido
otras posibilidades de cooperación entre los municipios, que son las analizadas en este estudio.
A tal finalidad, se ha tomado como referencia la Ley 5/2010, de 11 de junio, de Autonomía
Local de Andalucía, que dedica especial atención a la cooperación territorial. Sobre
la base de un planteamiento general sobre el tema, se analiza con cierto detalle, en primer
lugar, la posibilidad de crear una sociedad mercantil de capital íntegramente público, pero
perteneciente a varios municipios, teniendo en cuenta la jurisprudencia comunitaria sobre
los medios propios. En segundo lugar, se estudia la cooperación transfronteriza intermunicipal
potenciada por el Consejo de Europa y la Unión Europea. Y, para finalizar, se da
cuenta de otros mecanismos como las comunidades de municipio en Cataluña y las redes
de cooperación en Andalucía.Smaller municipalities with limited economic or technical capacity, often experience
difficulties in exercising their powers, in particular with regard to the provision of compulsory
services. To address this problem, the legislator, rather than trying to correct the
deficient municipal map, has chosen to promote the creation of new entities, of either
an intermunicipal nature —Joint Municipalities—, or an interadministrative nature
—Consortia—. But in the last few years, other possibilities for cooperation between the
municipalities have arisen, and it is these which will be analyzed in this study. To this end,
the study focuses on the Law 5/2010 of June 11, of local self-government of Andalusia,
which pays particular attention to territorial cooperation. By means of a general examination
of the issue, firstly an analysis is made of the possibility of creating a public corporation,
with wholly state-owned capital, but belonging to different municipalities. Secondly,
we study the inter-border cooperation between municipalities which has been enhanced by
the Council of Europe and the European Union. And finally, we analyze other mechanisms
such as the communities of the municipality in Cataluña and the cooperation networks
in Andalusia
Directiva de servicios y transportes terrestres
El Tratado de Roma utilizó la expresión «servicio público» para referirse
a los transportes terrestres y, en su desarrollo, los servicios de transporte terrestre
se sujeta a una regulación propia, quedando excluidos del ámbito de aplicación de
Directiva 2006/123/CE, del Parlamento Europeo y del Consejo, de 12 de diciembre,
relativa a los servicios en el mercado interior. Así lo establece también la Ley española
17/2009, de 23 de noviembre, sobre el libre acceso a las actividades de servicios y
su ejercicio, de trasposición de la Directiva. No obstante, la Ley 25/2009, de 22 de
diciembre, de modificación de diversas leyes para su adaptación a la Ley sobre el libre
acceso a las actividades de servicios y su ejercicio, ha modificado algunos preceptos
de las Leyes estatales relativas al transporte por carretera y por ferrocarril que es el
objeto de estudio.The Treaty of Rome used the term «public service» to refer to land
transport and in its development, land transport services are subject to its own proper
regulation, being excluded from the scope of Directive 2006/123/EC of European
Parliament and Council of 12 December on services in the interior market. The Spanish
law 17/2009 of 23 November, on free access to service activities and its exercising,
which transposes the cited Directive, adopts the same approach and therefore, excludes
land transport services from its scope. However, the aim of this study will be the analysis
of Law 25/2009, of December 22, which amends various laws in order to adapt them
to the Law on free access to service activities and its exercising, introducing changes in
certain provisions of other state laws relating to transport by land and rail
El impacto de la Directiva Bolkestein y la reforma de los servicios en el Derecho Administrativo

The competencies regarding agriculture in Spain have been divided between the state and autonomous communities (comunidades autonomas), the largest units of territorial division. The Spanish Constitution of 1978 does not make any direct reference to agriculture as a branch of economy not regulated by the state, but it provides that competencies regarding matters related to agriculture and breeding animals may be taken over by autonomous communities. Despite the apparent absence of an explicit regulation separating the competences of the state and autonomous communities, the opinion presented in the paper is that conflict situations are infrequent and if they do occur, all disputes are settled by the Constitutional Tribunal.In Spagna le competenze nell’ambito dell’agricoltura sono state ripartite tra lo Stato e le più grandi unità di divisione territoriale di base ‒ le comunità autonome (comunidades autonomas). La Costituzione del 1978 non menziona in modo diretto l’agricoltura come uno dei settori dell’economia esente da regolazione statale, essa si limita soltanto a stabilire che le competenze in materia di agricoltura e allevamento degli animali spettino alla regolazione effettuata da parte delle comunità autonome. A parere dell’autrice, benché manchi una espressa regolazione costituzionale capace di differenziare in modo chiaro e nitido le competenze dello Stato dalle competenze appartenenti alle particolari comunità autonome nel settore agroalimentare, non si giunge troppo spesso a una situazione di con-flitto. Nel caso in cui essa si verifichi spetta alla Corte Costituzionale giudicare a chi attribuire la competenza di regolare una data materia agroalimentare.16122924312Przegląd Prawa Rolneg
