    Charter Rights & Health Care Funding: A Typology of Canadian Health Rights Litigation

    Canadian health consumers have increasingly relied on the Charter of Rights and Freedoms to demand certain therapies and reasonably timely access to care. Organizing these cases into a 5-part typology, we examine how a rights-based discourse affects allocation of health care resources. First, successful Charter challenges can, in theory, lead to courts granting and enforcing positive rights to therapies or to timely care. Second, courts may grant a right to certain health services; however, subsequently government fails to deliver on this right. Third, successful litigation may create negative rights, i.e. rights to access care or private health insurance without government interference. Fourth, consumers can fail in their legal pursuit of a right but galvanize public support in the process, ultimately effecting the desired policy changes. Lastly, a failed lawsuit can stifle an entire advocacy campaign for the sought-after therapies. The typology illustrates the need to examine both legal and policy outcomes of health right litigation. This broader analysis reveals that the pursuit of health rights seems to have caused largely a regressive rather than progressive impact on Canadian Medicare

    Detection of eight different tospovirus species by a monoclonal antibody against the common epitope of NSs protein

    Rabbit antisera against the nucleocapsid protein (NP) have been commonly used for detection of tospoviruses and classification into serogroups or serotypes. Mouse monoclonal antibodies (MAbs) with high specificity to the NPs have also been widely used to identify tospovirus species. Recently, a serogroup-specific MAb against the NSs protein of Watermelon silver mottle virus (WSMoV) was produced by our laboratory to react with five members of WSMoV serogroup, i.e., WSMoV, Capsicum chlorosis virus (CaCV), Calla lily chlorotic spot virus (CCSV), Peanut bud necrosis virus (PBNV) and Watermelon bud necrosis virus (WBNV). The epitope recognized by the NSs MAb was determined and the comparison with the reported sequences of tospoviral NSs proteins revealed that the epitope is highly conserved at the N-terminal region of NSs proteins among members of WSMoV and Iris yellow spot virus (IYSV) serogroups, and Melon yellow spot virus (MYSV) serotype. When the NSs MAb was further used to react with the crude antigens of MYSV serotype, IYSV and Tomato yellow ring virus (TYRV) of IYSV serogroup, strong serological reactions, both in ELISA and western blotting, were observed. Thus, our results indicated that the NSs MAb is a useful and convenient tool for detection of the eight tospovirus species.     Magnetic phase diagrams of the Kagome staircase compound Co3V2O8

    At zero magnetic field, a series of five phase transitions occur in Co3V2O8. The Neel temperature, TN=11.4 K, is followed by four additional phase changes at T1=8.9 K, T2=7.0 K, T3=6.9 K, and T4=6.2 K. The different phases are distinguished by the commensurability of the b-component of its spin density wave vector. We investigate the stability of these various phases under magnetic fields through dielectric constant and magnetic susceptibility anomalies. The field-temperature phase diagram of Co3V2O8 is completely resolved. The complexity of the phase diagram results from the competition of different magnetic states with almost equal ground state energies due to competing exchange interactions and frustration.Comment: Proceedings of the 2007 Conference on Strongly Correlated Electron Systems, 2 pages, 2 figure

    Perturbative QCD analysis of B→ϕK∗B \to \phi K^* decays

    We study the first observed charmless B→VVB\to VV modes, the B→ϕK∗B\to\phi K^* decays, in perturbative QCD formalism. The obtained branching ratios B(B→ϕK∗)∼15×10−6B(B\to\phi K^*)\sim 15 \times 10^{-6} are larger than ∼9×10−6\sim 9\times 10^{-6} from QCD factorization. The comparison of the predicted magnitudes and phases of the different helicity amplitudes, and branching ratios with experimental data can test the power counting rules, the evaluation of annihilation contributions, and the mechanism of dynamical penguin enhancement in perturbative QCD, respectively.Comment: 14 pages, 2 tables, brief disscussion on hard sacle added, version to appear in PR

    Orientations of two coupled molecules

    Orientation states of two coupled polar molecules controlled by laser pulses are studied theoretically. By varying the period of a series of periodically applied laser pulse, transition from regular to chaotic behavior may occur. Schmidt decomposition is used to measure the degree of entanglement.     Characterization of a wheat HSP70 gene and its expression in response to stripe rust infection and abiotic stresses

    Members of the family of 70-kD heat shock proteins (HSP70 s) play various stress-protective roles in plants. In this study, a wheat HSP70 gene was isolated from a suppression subtractive hybridization (SSH) cDNA library of wheat leaves infected by Puccinia striiformis f. sp. tritici. The gene, that was designated as TaHSC70, was predicted to encode a protein of 690 amino acids, with a molecular mass of 73.54 KDa and a pI of 5.01. Further analysis revealed the presence of a conserved signature that is characteristic for HSP70s and phylogenetic analysis demonstrated that TaHSC70 is a homolog of chloroplast HSP70s. TaHSC70 mRNA was present in leaves of both green and etiolated wheat seedlings and in stems and roots. The transcript level in roots was approximately threefold less than in leaves but light–dark treatment did not charge TaHSC70 expression. Following heat shock of wheat seedlings at 40°C, TaHSC70 expression increased in leaves of etiolated seedlings but remained stable at the same level in green seedlings. In addition, TaHSC70 was differentially expressed during an incompatible and compatible interaction with wheat-stripe rust, and there was a transient increase in expression upon treatment with methyl jasmonate (MeJA) treatment. Salicylic acid (SA), ethylene (ET) and abscisic acid (ABA) treatments had no influence on TaHSC70 expression. These results suggest that TaHSC70 plays a role in stress-related responses, and in defense responses elicited by infection with stripe rust fungus and does so via a JA-dependent signal transduction pathway

    AbstractIn order to realize lightweight design of a high-bypass turbofan engine, topology optimization of vacuum structure on a wide-chord fan blade was carried out regarding mixed loading conditions as static strength, vibration and bird-strike. Without changing the leaf shape, relationship of performance indices on vacuum structure was analyzed with simplified mechanical model of loading conditions. Topology optimization designs were carried out according to the highly sensitive conditions. Vacuum structure layout of fan blade was constructed integrating the major load transfer paths in each design proposal. Performance indices of different fan blade structures were compared. Result shown that optimized fan blade can realize lightweight as well as meeting the strength design requirement
