    Introduction: This paper is the first in a series of reflections on the relationship between discrimination, sport and the law, a body of work that has been motivated in part by the potential impact of the 2000 Equalities Directive upon European sports law, but also by developments in human rights jurisprudence and in the domestic laws of several jurisdictions. The phenomenon of age discrimination in sport, and the social and economic impact thereof, has been far less widely considered than is the case with other forms of sports discrimination (although the literature would miraculously emerge if the subject-matter were more directly concerned with men’s professional football). In contrast, free movement and competition law have impacted significantly upon sports provisions that discriminate on the basis of nationality; it is equally evident that age discrimination in the context of sports employment has not been considered with anything approaching the degree of sophistication that pervades our understanding of discrimination in occupation or employment on the grounds of disability, sexual orientation and religion/belief (the other discriminatory forms that are covered by the 2000 Directive); and our poor understanding of age-related sports discrimination generally stands in marked contrast to our appreciation of how challenges to discrimination on the grounds of sex and race have precipitated far-reaching changes to sports practices. Throughout the EU, with the possible exception of the Irish Republic, age discrimination law is far less advanced than is the case with discrimination which takes any of those other forms, the remedies are weaker and fewer people are aware of them. However, this state of affairs will undoubtedly change under the impact of the Equalities Directive, and even though the provisions themselves (and member states’ transposing of them) attract legitimate criticism, some longstanding practices of sports bodies are now open to challenge

    Management and leadership in UK universities: exploring the possibilities of change

    This paper considers the case for reform of management struc- tures in UK universities and offers proposals for change. The model of top-down, performance-led management that characterises many institutions is both outmoded and ill-suited to the chal- lenges of an increasingly turbulent higher education sector. Drawing on the experiences of a university that introduced a new scheme of performance management, I explore alternative approaches to leadership and management, collaborative or part- nership working designed to improve employee voice and the need to re-evaluate approaches to Human Resource Management.     Reconceptualizing Profit-Orientation in Management: A Karmic View on "Return on Investment" Calculations

    From the perspective of the present day, Puritan-inspired capitalism seems to have succeeded globally, including in India. Connected to this, short-term profit-orientation in management seems to constrain the scope of different management approaches in a tight ideological corset. This article discusses the possibility of replacing this Puritan doctrine with the crucial elements of Indian philosophy: Karma and samsara. In doing so, the possibility of revising the guiding principles in capitalist management becomes conceivable, namely the monetary focus of profit-orientation and its short-term orientation. This perspective allows a detachment of the concept of profit from the realm of money, as the seemingly only objectifiable measure of profit. Furthermore it allows a removal of the expectation that every "investment" has to directly "pay off". A karmic view offers management a possible facility for being more caring about the needs and fates of other stakeholders, as profit-orientation would no longer be attached as a factual constraint to merely accumulate money.     Left ventricular twist mechanics during incremental cycling and knee extension exercise in healthy men

    Purpose: The objective of the present study was to investigate left ventricular (LV) twist mechanics in response to incremental cycling and isometric knee extension exercises. Methods: Twenty-six healthy male participants (age = 30.42 ± 6.17 years) were used to study peak twist mechanics at rest and during incremental semi-supine cycling at 30 and 60% work rate maximum (W) and during short duration (15 s contractions) isometric knee extension at 40 and 75% maximum voluntary contraction (MVC), using two-dimensional speckle tracking echocardiography. Results: Data presented as mean ± standard deviation or median (interquartile range). LV twist increased from rest to 30% W (13.21° ± 4.63° to 20.04° ± 4.76°, p  0.05), whilst twisting velocity increased (rest 89.15° ± 21.77° s to 75% MVC 124.32° ± 34.89° s, p  0.05) then increased from 40 to 75% MVC [−98.44 (43.54)° s to −138.42 (73.29)° s, p < 0.01]. Apical rotations and rotational velocities were greater than basal during all conditions and intensities (all p < 0.01). Conclusion: Cycling increased LV twist to 30% W which then remained unchanged thereafter, whereas twisting velocities showed further increases to greater intensities. A novel finding is that LV twist was unaffected by incremental knee extension, yet systolic and diastolic twisting velocities augmented with isometric exercise

    Quality Assurance Driving Factors as Antecedents of Knowledge Management: a Stakeholder-Focussed Perspective in Higher Education

    Similar to many other types of organisations, the successful development of higher education institutions generally depends on proactive multi-stakeholder management strategy. As a social responsibility of universities, quality assurance (QA) of higher education is already an established research domain. However, the issues that serve as driving factors in higher education’s quality are acknowledged in this vast knowledge stream in a dispersed way. An objective of this paper is to provide a quick snapshot of the major QA driving factors in higher education. Another objective here is to discuss the significance of these existing QA driving factors in higher education as prospective antecedents of knowledge management among the key stakeholders in the higher education sector and beyond. An inductive constructivist approach is followed to review the relevant QA driving factors from the extant scholarly views. A number of relevant factors are précised from the literature that would be instrumental to uphold quality in higher education. The discussion demonstrates that these factors are also significant to transfer and share knowledge between the key stakeholders not only for universities, but also for businesses, governments and other organisational stakeholders. The paper proposes a framework of the QA drivers’ application for meaningful knowledge transfer between diverse stakeholders and clarifies the framework’s managerial implications. This conceptual framework specifies different scenarios and perspectives of QA drivers’ application in the global education sector. The academic novelty is based on the inductive approach applied in the paper. QA practitioners will be able to follow these factors as steering phenomena to effectively assure quality, in relation to their multi-stakeholder relationships in higher education and beyond
