    Rebuilding fish stocks no later than 2015: will Europe meet the deadline?

    Maintaining or restoring fish stocks at levels that are capable of producing maximum sustainable yield is a legal obligation under the United Nations Convention on the Law of the Sea (UNCLOS) and has been given the deadline of no later than 2015 in the Johannesburg Plan of Implementation of 2002. Here, we analyse stock assessment data of all major fish stocks of the Northeast Atlantic to determine whether Europe will be able to deliver on this commitment, which it has helped to bring about. The analysis shows that, if current fishing pressure continues, 91% of the European stocks will remain below target. If European ministers in charge of fisheries were serious about meeting their obligations, they would have to reduce drastically fishing pressure and halt fishing completely on some stocks. But even if fishing were halted in 2010, 22% of the stocks are so depleted that they cannot be rebuilt by 2015. If current trends continue, Europe will miss the 2015 deadline by more than 30 years. We argue that, from a legal perspective, such repeated enactment of fisheries management measures,which are incapable of maintaining or restoring Bmsy, does not comply with the requirements contained in UNCLOS and may constitute a breach of the precautionary principle of European Community law

    Generic harvest control rules for European fisheries

    In European fisheries, most stocks are overfished and many are below safe biological limits, resulting in a call from the European Commission for new long-term fisheries management plans. Here, we propose a set of intuitive harvest control rules that are economically sound, compliant with international fishery agreements, based on relevant international experiences, supportive of ecosystem-based fisheries management and compatible with the biology of the fish stocks. The rules are based on the concept of maximum sustainable yield (MSY), with a precautionary target biomass that is 30% larger than that which produces MSY and with annual catches of 91% MSY. Allowable catches decline steeply when stocks fall below MSY levels and are set to zero when stocks fall below half of MSY levels. We show that the proposed rules could have prevented the collapse of the North Sea herring in the 1970s and that they can deal with strong cyclic variations in recruitment such as known for blue whiting. Compared to the current system, these rules would lead to higher long-term catches from larger stocks at lower cost and with less adverse environmental impact

    The Myth of International Delegation

    There is a growing and misinformed sense in some quarters that the United States and other countries have engaged (and continue to engage) in delegations to international institution that involve a significant threat to domestic sovereignty. Concerns about such delegations come from academics (John Yoo: “Novel forms of international cooperation increasingly call for the transfer of rulemaking authority to international organizations”), prominent politicians (Bob Barr: “Nary a thought is given when international organizations, like the UN, attempt to enforce their myopic vision of a one-world government upon America, while trumping our Constitution in the process. Moreover, many in our own government willfully or ignorantly cede constitutionally guaranteed rights and freedoms to the international community;” Jesse Helms: “The American people see the UN aspiring to establish itself as the central authority of a new international order of global laws and global government.”); and senior government officials (John Bolton: “For virtually every area of public policy, there is a Globalist proposal, consistent with the overall objective of reducing individual nation-state autonomy, particularly that of the United States”). In our view the perspective evidenced by the above quotes is almost wholly a myth. But it is a myth that persists and continues to attract attention. This Essay seeks to bring forward a more realistic and accurate view of international institutions and engagement. We demonstrate that meaningful delegations of sovereignty are extremely rare and even when they do exist they are carefully cabined. Decision-making authority in all areas remains firmly in the hands of national governments

    Brexit and Fisheries: A Question of Conflicting Expectations

    International audienceThe UK fishing sector has been under the spotlight since the beginning of the Brexit debate. Political commentators claimed that up to 90 per cent of British fishers supported Brexit as they considered the UK was disadvantaged compared to other EU Member States. Their main grudge is about the equal access that all Member States have had to all EU waters – with the exception of territorial waters, up to 12 nautical miles from the coast – since the formal inception of the Common Fisheries Policy (CFP) in 1983. Combined with what they perceive to be an unbalanced allocation of fishing quotas, this legal framework is thought by the UK fishing industry to be the main reason for the poor management of EU fisheries, which could be terminated following Brexit thus regaining the UK's status as an independent coastal state. The key issue addressed in this article is the possible reallocation of fishing opportunities within British waters. It outlines the current allocation system and summarises the views of major stakeholders. This is complex as historical fishing rights may or may not be acknowledged but it remains that the UK fishing industry needs access to EU markets and EU labour to bring the fish to value

    From principles to practice: a spatial approach to systematic conservation planning in the deep sea

    Increases in the demand and price for industrial metals, combined with advances in technological capabilities have now made deep-sea mining more feasible and economically viable. In order to balance economic interests with the conservation of abyssal plain ecosystems, it is becoming increasingly important to develop a systematic approach to spatial management and zoning of the deep sea. Here, we describe an expert-driven systematic conservation planning process applied to inform science-based recommendations to the International Seabed Authority for a system of deep-sea marine protected areas (MPAs) to safeguard biodiversity and ecosystem function in an abyssal Pacific region targeted for nodule mining (e.g. the Clarion–Clipperton fracture zone, CCZ). Our use of geospatial analysis and expert opinion in forming the recommendations allowed us to stratify the proposed network by biophysical gradients, maximize the number of biologically unique seamounts within each subregion, and minimize socioeconomic impacts. The resulting proposal for an MPA network (nine replicate 400 × 400 km MPAs) covers 24% (1 440 000 km(2)) of the total CCZ planning region and serves as example of swift and pre-emptive conservation planning across an unprecedented area in the deep sea. As pressure from resource extraction increases in the future, the scientific guiding principles outlined in this research can serve as a basis for collaborative international approaches to ocean management
