    Este artigo trata da delegação existente no Decreto no 7.499/2011 e problematiza o tolhimento de direitos fundamentais em razão da inércia daqueles a quem foi outorgada competência para adequar à realidade a faixa de renda necessária à participação do programa Minha Casa Minha Vida (PMCMV). O objetivo geral do trabalho foi demonstrar a influência da delegação legislativa disfarçada no estabelecimento de patamares de renda no PMCMV. Os objetivos específicos foram sedimentar o direito fundamental social a moradia, relacionar o princípio da dignidade da pessoa humana e o desenvolvimento sustentável, apresentando o processo legislativo e a teoria da delegação legislativa disfarçada, para, por fim, apontar as atribuições do Poder Executivo no PMCMV. A linha metodológica utilizada foi a jurídica propositiva. O raciocínio utilizado para responder à pergunta do presente no artigo foi o dialético. Em linhas gerais foram debatidos temas como os direitos fundamentais, a justiça social, o desenvolvimento sustentável, a dignidade da pessoa humana – especialmente como norte da interpretação de normas –, as atribuições do Ministro de Estado e a delegação contida no Decreto 7.499/2011. Buscou-se verificar se essa delegação atende a Constituição da República Federativa do Brasil de 1988 (CRFB/1988) de modo formal e material. Concluiu-se que o Presidente da República deve utilizar um instrumento constitucional de elaboração legislativa para adequar a mudança de parâmetros do Programa Minha Casa Minha Vida

    Accountability it from that article which promotes environmental damage in particular the Environmental Protection Area. We discuss existing paradoxes when environmental degradation caused and by acts arising from housing installation in environmentally protection area. We approach the historical, accountability forms in brazilian law, beyond the theories of risk. Also analyzed the obligation of the State to promote public policies for the implementation of the right fundamental social decent housing. Nevertheless, it was made a reflection on the constants in the world sustainable vision, informing a new design will assist in the search to text purpose. We deal also do theme conservation area proposed by Law 9985 /00.O artigo trata de responsabilização daquele que promove dano ambiental em determinada Área de Proteção Ambiental. Discutimos os paradoxos existentes quando a degradação ambiental é causada por atos decorrentes da instalação de moradia em áreas ambientalmente protegidas. Abordamos o histórico, a formas de responsabilização no direito brasileiro, além das teorias do risco. Analisamos também a obrigatoriedade do Estado de promover políticas públicas para a implementação do direito fundamental social à moradia digna. Não obstante, foi feita uma reflexão sobre as características constantes na visão sustentável de mundo, informando uma nova concepção que auxiliará na busca do objetivo do texto.     The research investigates the term "sustainable development" in its dimensions and legislative regulation. The overall objective is to list the dimensions and legislative regulation. The specific objectives were to characterize the dimensions, and the identification of his trajectory. Was employed as a theoretical-methodological approach to legal-sociological therefore at the breadth of the subject, the legal branch was insufficient to achieve the objectives. It proceeded with deductive reasoning, with a view to idealization of general principles that should be used in particular cases. There was a reinterpretation of the phrase, as well as spread the word on legislation from 2000.A pesquisa investiga o termo “desenvolvimento sustentável”, em suas dimensões e a regulamentação legislativa. O objetivo geral é elencar as dimensões e a regulamentação legislativa. Os objetivos específicos foram a caracterização das dimensões, bem como a identificação de sua trajetória. Empregou-se como linha teórico-metodológica a jurídico-sociológica, pois, ante a amplitude do tema, o ramo jurídico foi insuficiente para alcançar os objetivos. Procedeu-se com o raciocínio dedutivo, tendo em vista a idealização de princípios gerais que devem ser empregados em casos particulares.     O artigo compara o texto do anteprojeto da Comissão Afonso Arinos ao da Constituição da República de 1988 (CR/88) no que tange a proteção ambiental. Houve uma intensa participação para construção do texto final. A hipótese diz sobre a proteção mais eficaz da CR/88, tendo em vista a participação popular. Utilizou-se o raciocínio dialético, uma vez que estabeleceu uma tese (CR/88) e uma antítese (Comissão) para alcançar uma síntese, além de uma investigação jurídica na forma jurídico-comparativa.     NEOTROPICAL ALIEN MAMMALS: a data set of occurrence and abundance of alien mammals in the Neotropics

    Biological invasion is one of the main threats to native biodiversity. For a species to become invasive, it must be voluntarily or involuntarily introduced by humans into a nonnative habitat. Mammals were among first taxa to be introduced worldwide for game, meat, and labor, yet the number of species introduced in the Neotropics remains unknown. In this data set, we make available occurrence and abundance data on mammal species that (1) transposed a geographical barrier and (2) were voluntarily or involuntarily introduced by humans into the Neotropics. Our data set is composed of 73,738 historical and current georeferenced records on alien mammal species of which around 96% correspond to occurrence data on 77 species belonging to eight orders and 26 families. Data cover 26 continental countries in the Neotropics, ranging from Mexico and its frontier regions (southern Florida and coastal-central Florida in the southeast United States) to Argentina, Paraguay, Chile, and Uruguay, and the 13 countries of Caribbean islands. Our data set also includes neotropical species (e.g., Callithrix sp., Myocastor coypus, Nasua nasua) considered alien in particular areas of Neotropics. The most numerous species in terms of records are from Bos sp. (n = 37,782), Sus scrofa (n = 6,730), and Canis familiaris (n = 10,084); 17 species were represented by only one record (e.g., Syncerus caffer, Cervus timorensis, Cervus unicolor, Canis latrans). Primates have the highest number of species in the data set (n = 20 species), partly because of uncertainties regarding taxonomic identification of the genera Callithrix, which includes the species Callithrix aurita, Callithrix flaviceps, Callithrix geoffroyi, Callithrix jacchus, Callithrix kuhlii, Callithrix penicillata, and their hybrids. This unique data set will be a valuable source of information on invasion risk assessments, biodiversity redistribution and conservation-related research. There are no copyright restrictions.     NEOTROPICAL CARNIVORES: a data set on carnivore distribution in the Neotropics

    Mammalian carnivores are considered a key group in maintaining ecological health and can indicate potential ecological integrity in landscapes where they occur. Carnivores also hold high conservation value and their habitat requirements can guide management and conservation plans. The order Carnivora has 84 species from 8 families in the Neotropical region: Canidae; Felidae; Mephitidae; Mustelidae; Otariidae; Phocidae; Procyonidae; and Ursidae. Herein, we include published and unpublished data on native terrestrial Neotropical carnivores (Canidae; Felidae; Mephitidae; Mustelidae; Procyonidae; and Ursidae). NEOTROPICAL CARNIVORES is a publicly available data set that includes 99,605 data entries from 35,511 unique georeferenced coordinates. Detection/non-detection and quantitative data were obtained from 1818 to 2018 by researchers, governmental agencies, non-governmental organizations, and private consultants. Data were collected using several methods including camera trapping, museum collections, roadkill, line transect, and opportunistic records. Literature (peer-reviewed and grey literature) from Portuguese, Spanish and English were incorporated in this compilation. Most of the data set consists of detection data entries (n = 79,343; 79.7%) but also includes non-detection data (n = 20,262; 20.3%). Of those, 43.3% also include count data (n = 43,151). The information available in NEOTROPICAL CARNIVORES will contribute to macroecological, ecological, and conservation questions in multiple spatio-temporal perspectives. As carnivores play key roles in trophic interactions, a better understanding of their distribution and habitat requirements are essential to establish conservation management plans and safeguard the future ecological health of Neotropical ecosystems. Our data paper, combined with other large-scale data sets, has great potential to clarify species distribution and related ecological processes within the Neotropics. There are no copyright restrictions and no restriction for using data from this data paper, as long as the data paper is cited as the source of the information used. We also request that users inform us of how they intend to use the data

    Geoeconomic variations in epidemiology, ventilation management, and outcomes in invasively ventilated intensive care unit patients without acute respiratory distress syndrome: a pooled analysis of four observational studies

    Background: Geoeconomic variations in epidemiology, the practice of ventilation, and outcome in invasively ventilated intensive care unit (ICU) patients without acute respiratory distress syndrome (ARDS) remain unexplored. In this analysis we aim to address these gaps using individual patient data of four large observational studies. Methods: In this pooled analysis we harmonised individual patient data from the ERICC, LUNG SAFE, PRoVENT, and PRoVENT-iMiC prospective observational studies, which were conducted from June, 2011, to December, 2018, in 534 ICUs in 54 countries. We used the 2016 World Bank classification to define two geoeconomic regions: middle-income countries (MICs) and high-income countries (HICs). ARDS was defined according to the Berlin criteria. Descriptive statistics were used to compare patients in MICs versus HICs. The primary outcome was the use of low tidal volume ventilation (LTVV) for the first 3 days of mechanical ventilation. Secondary outcomes were key ventilation parameters (tidal volume size, positive end-expiratory pressure, fraction of inspired oxygen, peak pressure, plateau pressure, driving pressure, and respiratory rate), patient characteristics, the risk for and actual development of acute respiratory distress syndrome after the first day of ventilation, duration of ventilation, ICU length of stay, and ICU mortality. Findings: Of the 7608 patients included in the original studies, this analysis included 3852 patients without ARDS, of whom 2345 were from MICs and 1507 were from HICs. Patients in MICs were younger, shorter and with a slightly lower body-mass index, more often had diabetes and active cancer, but less often chronic obstructive pulmonary disease and heart failure than patients from HICs. Sequential organ failure assessment scores were similar in MICs and HICs. Use of LTVV in MICs and HICs was comparable (42·4% vs 44·2%; absolute difference -1·69 [-9·58 to 6·11] p=0·67; data available in 3174 [82%] of 3852 patients). The median applied positive end expiratory pressure was lower in MICs than in HICs (5 [IQR 5-8] vs 6 [5-8] cm H2O; p=0·0011). ICU mortality was higher in MICs than in HICs (30·5% vs 19·9%; p=0·0004; adjusted effect 16·41% [95% CI 9·52-23·52]; p<0·0001) and was inversely associated with gross domestic product (adjusted odds ratio for a US$10 000 increase per capita 0·80 [95% CI 0·75-0·86]; p<0·0001). Interpretation: Despite similar disease severity and ventilation management, ICU mortality in patients without ARDS is higher in MICs than in HICs, with a strong association with country-level economic status
