QUANTITATIVE CALCULATION OF THE QUALITY OF TEACHING AS A PROJECT MANAGEMENT FACTOR OF THE INTERNATIONAL CONTRACT

One of the most problematic places in the implementation of international contracts is inefficient project management. The choice of inappropriate methodology for managing the educational project, irrational allocation of resources, untimely monitoring quality of the provided services can lead not only to the loss of an existing contract, but also to the reduction of the university's reputation in the international arena in conditions of competitive struggle in the educational services market. In turn, this minimizes the probability of concluding of new contracts. An innovative methodology for managing projects for the provision of educational services to a foreign customer has been developed. A general calculation of the quantitative assessment of a quality of the provision of an educational service is applied in this methodology. In order to significantly reduce the calculation time was created a universal computational program that allows processing of large data blocks with visualization of results in a two-dimensional coordinate system. The methodology was implemented in the NUOS workflow. The obtained results make possible to control the quality of rendering educational services to a foreign customer with minimum expenses of human resources and make adjustments to the educational process quickly if it necessary

Изменение фактических обстоятельств в контексте вынесения судебных актов по гражданским делам

The subject of the study within the framework of this article are the norms of civil procedural law and arbitration procedural law concerning the issuance of judicial acts in connection with a change in factual circumstances relevant to the case. The purpose of the study is to identify and classify cases in which the current legislation and law enforcement practice allow the issuance of a new judicial act in connection with a change in the actual circumstances of the case. At the same time, the purpose of the study is related to the confirmation of the hypothesis about the diversity of the bases of such a classification.Within the framework of this study, the functional method, the system-structural method, the formal-legal method and the hermeneutic method were used. The use of these methods is due to the need to analyze a large volume of legal norms and judicial practice on the subject of the study. The article analyzes the legal mechanisms, the application of which is associated with the issuance of judicial acts in the framework of civil and arbitration proceedings based on changes in the factual circumstances of the case. The following mechanisms are identified as these mechanisms: the possibility of filing a claim with a new basis, revision of judicial acts under new circumstances, changing the method and procedure for the execution of a court decision, postponement and installment of the execution of a court decision, indexation of the amounts awarded.Cases of application of these mechanisms are classified according to the procedural order of consideration by the court of changes in circumstances and its consolidation in judicial acts, while the following types are distinguished: cases related to the consolidation of circumstances by making a new court decision on a claim with a new basis; cases related to the consolidation of circumstances by making a court ruling in connection with the emergence of new circumstances; cases related to the consolidation of circumstances by issuing a court ruling in connection with a change in the method and procedure for the execution of a court decision, postponement and installment of the execution of a court decision, indexation of the amounts awarded. Cases of the use of these mechanisms are also classified by the type of judicial act fixing such changes, while the following types are distinguished: cases related to the consolidation of circumstances by issuing a court decision; cases related to the consolidation of circumstances by issuing a court ruling.The author concludes that the use of the term "new circumstances" is incorrect in relation to certain grounds for reviewing judicial acts, in connection with which it is proposed to amend the norms of procedural legislation. In relation to these cases, it is proposed to use not the term "new circumstances", but the term "change in the content of legal norms or their interpretation that is relevant to the case".Based on the above, the purpose of the study has been fully achieved.Анализируются правовые механизмы, применение которых связано с вынесением судебных актов в рамках гражданского и арбитражного процесса на основании изменения фактических обстоятельств дела. Случаи применения данных механизмов классифицированы по процессуальному порядку рассмотрения судом изменения обстоятельств и его закрепления в судебных актах, а также по виду судебного акта, фиксирующего такие изменения. Делается вывод о некорректности применения термина «новые обстоятельства» применительно к отдельным основаниям пере-смотра судебных актов, в связи с чем предлагается внести изменения в нормы процессуального законодательства

The thermal expansion and thermophysical properties of an aluminum and Al/B 4 C composite

Concept and implementation of International Educational Programs of the Admiral Makarov National University of Shipbuilding are used as the basis of this study. The object of study is an International Educational Programs of NUS, and subject is – the successful functioning of the mechanisms and the implementation of these programs. The mechanisms of the implementation of two key programs in terms of project management is being studied. The development of Sectoral Distribution of Responsibility for project management training programs "2 + 2" and "4 + 0" was performed. They are proposed as fundamental approaches of project management that are applicable to a variety of other programs that already exist, or are planned to be implemented by the universities of Ukraine.Концепции и выполнения международных образовательных программ Национального университета кораблестроения имени адмирала Макарова взяты за основу данного исследования. Разработаны секторальные распределения ответственности при управлении проектами учебных программ "2 + 2" и "4 + 0". Providing timely and high-quality educational services for a foreign customer is a critical task determining the university’s reputation in the international arena and, consequently, subsequent international orders. In the conditions of competition in the global market of educational services, it is necessary to constantly confirm the high standards of the university. It is suggested to apply general calculation of a quantitative assessment of the quality of training in the project management of foreign students’ education in joint programs with international partners. To significantly reduce the time of calculation, a universal computing program has been created. This program allows processing extensive data blocks with visualization of the results in the two-dimensional coordinate system. The results make it possible to quickly make adjustments in the educational process in order to improve the quality of educational services to international customers.Аннотация. В управлении проектами обучения иностранных студентов по совместным программам с международными партнерами предлагается применять общий расчет количественной оценки качества преподавания. Для значительного сокращения времени этого процесса была создана универсальная вычислительная программа, которая позволяет обрабатывать обширные блоки данных с визуализацией результатов в двухмерной системе координат. Полученные результаты дают возможность оперативно вносить коррективы в учебный процесс с целью повышения качества предоставляемых образовательных услуг международному заказчику

The study of gas dynamics and precipitation coefficients of the separation profile has been performed. The three-dimensional model of operating channels of the ship systems for cleaning air from condensed moisture is developed. The distribution of velocity, static pressure, dynamic pressure, turbulence kinetic energy, and precipitation coefficients for the flow rates of 5, 10, 15, 20 m/s in separating profiles with the radii of 5, 10, 15, 20, 25 mm. The condensed moisture precipitation coefficient is 99.9%. Designs of the ship systems for cleaning air from condensed moisture are developed for the air flow from 20 to 2000 m3/hour.Аннотация. Выполнены исследования газодинамики и коэффициентов осаждения сепарационного профиля. Разработаны трехмерные модели рабочих каналов судовых систем очистки воздуха от капельной влаги. Получено распределение скорости, статического давления, динамического давления, кинетической энергии турбулентности и коэффициентов осаждения для скоростей потока 5, 10, 15, 20 м/с в сепарирующих профилях с радиусами 5, 10, 15, 20, 25 мм.
