Agente encubierto: acercamiento legal, jurisprudencial y de hechos en torno a la protección física

Con el presente artículo se pretende determinar si el Estado Colombiano brinda o no garantías a los agentes encubiertos en cuanto a la protección de sus derechos fundamentales a la vida, integridad personal y salud. Para lo anterior, se consultó información documental desde las esferas normativas, jurisprudenciales y doctrinales, abordando la noción de la técnica especial de investigación de agente encubierto, mencionando brevemente sus antecedentes y finalidad. Además, se realizó un seguimiento a la evolución del marco jurídico y jurisprudencial respecto a la implementación del agente encubierto en Colombia, partiendo desde la Convención de las Naciones Unidas contra la Delincuencia Organizada Transnacional, ratificada por el Estado Colombiano mediante la Ley 800 de 2003. A nivel internacional se tuvo en cuenta las recomendaciones de la OEA en esa materia y la regulación vigente en Argentina y Bolivia, países que tienen establecidos procedimientos de protección para el agente encubierto y su familia, antes, durante y después de finalizada la operación encubierta. Lo anterior permite inferir que en Colombia la técnica especial de investigación de agente encubierto no se encuentra regulada desde un ámbito amplio que incluya medidas de protección, seguimiento profesional médico y psicológico antes, durante y después de la finalización de la operación, en pro del servidor público y su familia.Universidad Libre Seccional Pereira -- Facultad de Derecho, Ciencias Políticas y Sociales -- DerechoThe purpose of this article is to determine whether or not the Colombian state provides guarantees to undercover agents concerning the protection of their fundamental rights to life, personal integrity and health. For the above, the documentary information was consulted from the normative, jurisprudential and doctrinal spheres dealing with the concept of the technique of investigation of special undercover agent with a brief mention of its context and purpose. In addition, a follow-up was carried out on the evolution of the legal and jurisprudential framework regarding the implementation of the undercover agent in Colombia, starting from the United Nations Convention against Transnational Organized Crime, ratified by the Colombian State through Law 800 of 2003. Internationally, the recommendations of the OAS in this matter and the regulations in force in Argentina and Bolivia were taken into account, countries that have established protection procedures for the undercover agent and his/her family, before, during and after the end of the undercover operation. The above leads us to conclude that in Colombia, the technique of investigating special undercover agents is not regulated from a broad scope that includes protective measures, medical and psychological care before, during and after the completion of the operation on behalf of the server public and family

Relationship between chemotherapy-induced adverse reactions and health-related quality of life in patients with breast cancer

Chemotherapy does not only affect cancer cells; it also affects, to a greater or lesser degree, all other cells in the body. This toxicity should be assessed according to its severity, frequency, and duration, taking into account objective and subjective dimensions in its assessment. This assessment is a highly relevant aspect when providing care to chemotherapy patients, mainly due to the impact of the treatment on the patient's quality of life, as well as the vital risk it may imply under certain circumstances. For all this, the objective of this study was to assess the relationship between chemotherapy-associated adverse reactions and health-related quality of life in breast cancer patients. With this purpose, a descriptive cross-sectional study was developed on 110 breast cancer patients who were treated with docetaxel, epirubicin, and cyclophosphamide. It is worth highlighting the negative effect of nausea, dysgeusia, peripheral neuropathy, loss of appetite, myalgia, and peripheral edema on the quality of life. Likewise, it is worth mentioning peripheral neuropathy as the toxicity that affects a greater number of quality-of-life indicators. To sum up, it would be necessary to make health professionals aware of the importance of chemotherapy-associated adverse reactions
