The Bankruptcy-Law Safe Harbor for Derivatives: A Path-Dependence Analysis

U.S. bankruptcy law grants special rights and immunities to creditors in derivatives transactions, including virtually unlimited enforcement rights. This article argues that these rights and immunities result from a form of path dependence, a sequence of industry-lobbied legislative steps, each incremental and in turn serving as apparent justification for the next step, without a rigorous and systematic vetting of the consequences. Because the resulting “safe harbor” has not been fully vetted, its significance and utility should not be taken for granted; and thus regulators, legislators, and other policymakers—whether in the United States or abroad—should not automatically assume, based on its existence, that the safe harbor necessarily reflects the most appropriate treatment of derivatives transactions under bankruptcy and insolvency law or the treatment most likely to minimize systemic risk

Das Zitat von André Bazin „Das Theater hilft dem Film“, ebenso wie der gesamte Text, in welchem dieses eingegliedert ist, „Théâtre et cinéma“, bilden den Anfang einer Auseinandersetzung mit dem Verhältnis der beiden Künste, Theater und Film, im Frankreich der 1950er und 1960er Jahre. 1951 verfasst, prägten dieser Text, sowie das gesamte filmkritische und filmtheoretische Werk Bazins eine Generation späterer Filmemacher, deren Nähe zum Film sich ebenfalls in der filmkritischen Auseinandersetzung bildete. Claude Chabrol, Jean-Luc Godard, Jacques Rivette, Eric Rohmer und François Truffaut erteilten in den 1950er Jahren in ihren Artikeln in La Gazette du cinéma, Cahiers du cinéma oder Arts eine klare Abfuhr an das französische, zeitgenössische Kino, welches sich mit der Bezeichnung Cinéma de qualité schmückte. Dessen Perfektion, Redundanz und Inhaltslosigkeit wurden unter anderem unter dem Aspekt der Theater-Film-Beziehung beleuchtet und führten schnell zu einer definitiven Absage an die unreflektierte Anwendung theatraler Elemente im Film. Das Szenario, charakterisiert mit „du propre, du fini, du travail bien fait“ und die dadurch entstandenen Films de scénaristes, zu deren Realisierung der Regisseur einzig die Anweisungen des Drehbuchs befolgte, wurden als theatrales Erbe verurteilt: theatrale Dramaturgie, Dramatisierung nach theatralen Konventionen und künstliche Sprache. Im weiteren Produktionsprozess lehnten die fünf Kritiker die Fortführung von theatralen Strukturen in der Mise en scène ab. Verbunden war dies mit der Verweigerung theatraler Illusion und der Forderung nach Realismus, dessen Mittel sie in Profondeur de champ und Cinémascope fanden. Bazins Ideen aufnehmend, wurde ein bewusster, reflektierter Umgang mit Theatralität begrüßt – sei dies nun in Form inhaltlicher Adaption oder ästhetischer Strukturen –, solang das Medium und seine spezifische Sprache nicht verraten wurden. Als ab 1959 Chabrol, Godard, Rivette, Rohmer und Truffaut das Medium ihrer Kritik von Schrift zu Film wechselten, lässt sich auch über die folgenden Jahre hinweg eine Veränderung der Wahrnehmung von Theatralität im Film erkennen. PARIS NOUS APPARTIENT (1961) von Jacques Rivette, VIVRE SA VIE (1962) von Jean-Luc Godard und LA COLLECTIONNEUSE (1967) von Eric Rohmer bilden eine Auswahl, anhand deren unter ähnlichen Aspekten wie bei der schriftlichen Kritik das Verhältnis von Theater und Film untersucht wird: Das Szenario erfährt in der Nouvelle Vague eine Neuwertung, es integriert sich in den Produktionsprozess, den sie stetig reflektiert. Auf unterschiedliche Art und Weise – es reicht von sehr subtil und nuanciert bis offensichtlich und forciert – wird Theater als Element des Inhalts integriert. Inhaltliche Dramatisierung spielt mit inhaltlicher Distanzierung, theatrale Sprache mit realer Sprache. Körperliche Präsenz wird auf bildlicher Ebene in der Arbeitsweise gesucht, Theatralität verschreibt sich als Konstrukt dem Raum, ebenso wie dem Blick. Die Reflexion des Mediums ist ein wichtiger Beitrag zur Distanzierung in der Mise en scène, ebenso wie zur Realitätsbildung. Die Rolle des Zusehers und der Zuseherin ändert sich, Identifikation weicht Opposition, Passivität Aktivität. Im Zuge der Theorie des theatralen Realismus, wird die Wirklichkeit in den Mittelpunkt der filmischen Welt gerückt. Es vollzieht sich ein Einbruch von Theatralität im Film, den es alleinig als das Produkt der Reflexion zu bezeichnen gilt; darin integriert ist auch die frühere Ablehnung der Theatralität des Cinéma de qualité. Die Theorie Bazins wurde sowohl in der schriftlichen Kritik der 1950er Jahre, wie in der filmischen Kritik der 1960er Jahre immer wieder aufgegriffen, diskutiert und verteidigt, sie veranlasste Gegenpositionen einzunehmen und die eigene Haltung zu festigen. Die Ablehnung der Theatralität in den Kritiken der 1950er Jahre wandelte sich in ein Einlösen von Theatralität in den filmpraktischen Arbeiten der 1960er Jahre; alleinig der Bruch mit dem alten Verständnis schuf Raum für etwas Neues

Simulating METIS SCAO System

METIS, the Mid-Infrared ELT Imager and Spectrograph, is one of the four first-generation ELT instruments scheduled to see first light in 2028. Its two main science modules are supported by an adaptive optics system featuring a pyramid sensor with 90x90 subapertures working in the H and K bands. During the PDR and FDR phases, extensive simulations were carried out to support the sensing, reconstruction, and control concept of METIS single-conjugate adaptive optics (SCAO) system. We present details on the implementation of the COMPASS-based environment used for the simulations, the metrics used for analyzing our performance expectations, an overview of the main results, and some details on special cases like non-common path aberrations (NCPA) and water vapor seeing, as well as the low-wind effect.Comment: 17 pages, 14 Figures, AO4ELT VII Conference - Avignon - June 202

Experimental study of temperatures in characteristic sections of the working zone of a closed two-phase thermosyphon under the condition of a heat removal by external periphery

We present the results of the experimental study of temperature fields in a closed two-phase thermosyphon. Operational modes of a thermosyphon with different heat supply conditions are studied experimentally using setup consisting of the copper case, systems of heat supply and removal in evaporation and condensation zones, and temperature recording facilities. The height of the heat exchanger is 161 mm, thickness of the side walls and bottom wall are 1.5 mm and 2 mm, respectively, inner diameter is 39 mm. Heat is supplied to the bottom wall by heating element. The heat carrier is distilled water. We obtained thermograms when heat fluxes to the bottom wall of the thermosyphon are 695 - 2136 W/m{2}

Y-box protein-1 is actively secreted through a non-classical pathway and acts as an extracellular mitogen

Y-box protein (YB)-1 of the cold-shock protein family functions in gene transcription and RNA processing. Extracellular functions have not been reported, but the YB-1 staining pattern in inflammatory glomerular diseases, without adherence to cell boundaries, suggests an extracellular occurrence. Here, we show the secretion of YB-1 by mesangial and monocytic cells after inflammatory challenges. It should be noted that YB-1 was secreted through a non-classical mode resembling that of the macrophage migration inhibitory factor. YB-1 release requires ATP-binding cassette transporters, and microvesicles protect YB-1 from protease degradation. Two lysine residues in the YB-1 carboxy-terminal domain are crucial for its release, probably because of post-translational modifications. The addition of purified recombinant YB-1 protein to different cell types results in increased DNA synthesis, cell proliferation and migration. Thus, the non-classically secreted YB-1 has extracellular functions and exerts mitogenic as well as promigratory effects in inflammation

Evasive Malware via Identifier Implanting

To cope with the increasing number of malware attacks that organizations face, anti-malware appliances and sandboxes have become an integral security defense. In particular, appliances have become the de facto standard in the fight against targeted attacks. Yet recent incidents have demonstrated that malware can effectively detect and thus evade sandboxes, resulting in an ongoing arms race between sandbox developers and malware authors. We show how attackers can escape this arms race with what we call customized malware, i.e., malware that only exposes its malicious behavior on a targeted system. We present a web-based reconnaissance strategy, where an actor leaves marks on the target system such that the customized malware can recognize this particular system in a later stage, and only then exposes its malicious behavior. We propose to implant identifiers into the target system, such as unique entries in the browser history, cache, cookies, or the DNS stub resolver cache. We then prototype a customized malware that searches for these implants on the executing environment and denies execution if implants do not exist as expected. This way, sandboxes can be evaded without the need to detect artifacts that witness the existence of sandboxes or a real system environment. Our results show that this prototype remains undetected on commercial malware security appliances, while only exposing its real behavior on the targeted system. To defend against this novel attack, we discuss countermeasures and a responsible disclosure process to allow appliances vendors to prepare for such attacks
