    Litigating Terror in The Sinai After The Egyptian Spring Revolution: Should States Be Liable to Foreign Investors for Failure to Prevent Terrorist Attacks?

    The ambiguity of the due diligence standard of the Full Protection and Security obligation in investment treaties persists to this day. A recent ICSID tribunal found a developing state liable for breaching the Full Protection and Security obligation due to its inability to protect a foreign investment against terrorist attacks in a remote deserted area. In this article, we analytically criticize the Ampal v. Egypt arbitral award against the comprehensive factual matrix behind the case. Based on our criticism of Ampal, we argue that developing states should not be liable for failing to prevent or stop terrorist attacks under the Full Protection and Security obligation when they exert efforts relevant to their limited capacity to offer such protection. Further, we argue that investors should also optimize political risk insurance offered by the Multilateral Investment Guarantee Agency when they choose to invest in a host state that might be vulnerable to terrorist attacks, might face potential insurgencies, or suffer from political turmoil. Finally, we highlight the importance of integrating other subfields of international law – such as international human rights law – to the international investment arbitration system, especially in defining what acts or omissions are required of a host state to fulfill the due diligence standard of the Full Protection and Security Obligation

    Maximal unramified 3-extensions of imaginary quadratic fields and SL_2(Z_3)

    The structure of the Galois group of the maximal unramified p-extension of an imaginary quadratic field is restricted in various ways. In this paper we construct a family of finite 3-groups satisfying these restrictions. We prove several results about this family and characterize them as finite extensions of certain quotients of a Sylow pro-3 subgroup of SL_2(Z_3). We verify that the first group in the family does indeed arise as such a Galois group and provide a small amount of evidence that this may hold for the other members. If this were the case then it would imply that there is no upper bound on the possible lengths of a finite p-class tower.Comment: 7 pages. No figures. LaTe

    Evaluation of E-Learning Lessons for Strengthening Early Childhood Practitioner Use of Family Capacity-Building Practices

    Findings from a case study field-test evaluation of e-learning lessons for promoting early childhood intervention practitioners’ understanding and use of family capacity-building practices are described. Participants were two early childhood program directors, two early childhood technical assistance providers, and two early childhood intervention practitioners. Pattern matching was used to evaluate whether or not participants with different roles and responsibilities judged the instructional design, interactivity, video illustrations, and usefulness of the e-learning lessons similarly or differently. Results indicated that the different features of the e-learning lessons were rated highly by all but one participant and that the patterns of responses were much the same regardless of participants’ professional roles or responsibilities. Participant feedback and suggestions were used to revise the e-learning lessons and correct technical problems

    Ultrastructure of Lymphocystis in the Heart of the Silver Perch, Bairdiella chrysura (Lacépède), Including Observations on Normal Heart Structure

    The fine structure of normal heart muscle from the silver perch, Bairdiella chrysura (Lacépède), is similar to that previously reported for marine and freshwater teleosts. Cardiac lymphocystis is a viral disease manifested by single, giant-cell lesions variously located in the epicardium, trabecular spaces, and subendocardium – in direct apposition to myocardial cells. Occasionally, the hyaline capsule of lymphocystis cells partially surround myocardial cells but cause no pathological changes or inflammatory reaction. The lymphocystis cells contain typical cellular organelles, including the viroplasmic net unique to these cells. Annulate lamellae, often continuous with the rough endoplasmic reticulum, are present, usually along the periphery of the cell. Some elements of the rough endoplasmic reticulum are dilated and contain a finely granular material, but others contain cross-banded fibrils, each having a periodicity of 30 nm. Similar fibrils are present in the perinuclear cisternae

    Generic theory of colloidal transport

    We discuss the motion of colloidal particles relative to a two component fluid consisting of solvent and solute. Particle motion can result from (i) net body forces on the particle due to external fields such as gravity; (ii) slip velocities on the particle surface due to surface dissipative phenomena. The perturbations of the hydrodynamic flow field exhibits characteristic differences in cases (i) and (ii) which reflect different patterns of momentum flux corresponding to the existence of net forces, force dipoles or force quadrupoles. In the absence of external fields, gradients of concentration or pressure do not generate net forces on a colloidal particle. Such gradients can nevertheless induce relative motion between particle and fluid. We present a generic description of surface dissipative phenomena based on the linear response of surface fluxes driven by conjugate surface forces. In this framework we discuss different transport scenarios including self-propulsion via surface slip that is induced by active processes on the particle surface.     Phoretic Motion of Spheroidal Particles Due To Self-Generated Solute Gradients

    We study theoretically the phoretic motion of a spheroidal particle, which generates solute gradients in the surrounding unbounded solvent via chemical reactions active on its surface in a cap-like region centered at one of the poles of the particle. We derive, within the constraints of the mapping to classical diffusio-phoresis, an analytical expression for the phoretic velocity of such an object. This allows us to analyze in detail the dependence of the velocity on the aspect ratio of the polar and the equatorial diameters of the particle and on the fraction of the particle surface contributing to the chemical reaction. The particular cases of a sphere and of an approximation for a needle-like particle, which are the most common shapes employed in experimental realizations of such self-propelled objects, are obtained from the general solution in the limits that the aspect ratio approaches one or becomes very large, respectively.Comment: 18 pages, 5 figures, to appear in European Physical Journal

    Extensional flow affecting shear viscosity: experimental evidence and comparison to models

    The effect of extensional flow on apparent shear viscosity has never previously been directly measured nor is it often considered. Here, for the first time, through using a novel flow configuration (two-phase shear response under extensional flow), we have directly measured the effect extensional flow has on the apparent shear viscosity of a viscoelastic polymer solution in a controlled and kinematically mixed manner. We show, via a control transient shear experiment, that the apparent shear viscosity of the solution under mixed deformation depends not only on the shear rate but also on the extension rate and their relative direction: shear thinning being enhanced by parallel and reduced by perpendicular extensional flow, respectively. A 62% reduction in apparent viscosity with parallel extension was seen in this work. We then test the ability of the commonly used Giesekus and Carreau–Yasuda (incorporating generalized shear rate) models to predict the effect of extension rate on apparent shear viscosity against our data. The Giesekus model was found to predict the correct qualitative behavior under both parallel and perpendicular extensional flow, and depending on the fitting parameters, also provided a loosely quantitative agreement. Conversely, the generalized shear rate description does not capture the qualitative behavior, with the most significant errors occurring for perpendicular extension (i.e., expansion) flows. This work emphasizes the rarely noted shortcomings of the latter approach when used for experimental analysis and engineering design when extensional flows are additionally present
