    Joint Dominance and Tacit Collusion - An Analysis of the Irish Vodafone/O2 Case and the Implications for Competition and Regulatory Policy

    The paper takes as its starting point the Irish telecom regulator ComReg’s finding of joint dominance by two firms in the mobile phone market in Ireland. The paper argues that the regulator’s decision was inconsistent with the facts in the case. However, it argues that the case raises wider questions about the whole concept of joint dominance as it has evolved under EU competition law which in our view is confused. We regard the approach of the ECJ in trying to use a single approach to joint dominance in merger analysis and in competition analysis as unjustified, misguided and at odds with economic analysis.

    Learning Systems used on robots require either a-priori knowledge in the form of models, rules of thumb or databases or require that robot to physically execute multitudes of trial solutions. The first requirement limits the robot’s ability to operate in unstructured changing environments, and the second limits the robot’s service life and resources. In this research a generalized approach to learning was developed through a series of algorithms that can be used for construction of behaviors that are able to cope with unstructured environments through adaptation of both internal parameters and system structure as a result of a goal based supervisory mechanism. Four main learning algorithms have been developed, along with a goal directed random exploration routine. These algorithms all use the concept of learning from a recent memory in order to save the robot/agent from having to exhaustively execute all trial solutions. The first algorithm is a reactive online learning algorithm that uses a supervised learning to find the sensor/action combinations that promote realization of a preprogrammed goal. It produces a feed forward neural network controller that is used to control the robot. The second algorithm is similar to first in that it uses a supervised learning strategy, but it produces a neural network that considers past values, thus providing a non-reactive solution. The third algorithm is a departure from the first two in that uses a non-supervised learning technique to learn the best actions for each situation the robot encounters. The last algorithm builds a graph of the situations encountered by agent/robot in order to learn to associate the best actions with sensor inputs. It uses an unsupervised learning approach based on shortest paths to a goal situation in the graph in order to generate a non-reactive feed forward neural network. Test results were good, the first and third algorithms were tested in a formation maneuvering task in both simulation and onboard mobile robots, while the second and fourth were tested simulation

    Characterizing cardiac involvement in chronic kidney disease using CMR—a systematic review

    Purpose of Review: The aim of the review was to identify and describe recent advances (over the last 3 years) in cardiac magnetic resonance (CMR) imaging in patients with chronic kidney disease (CKD). We conducted a literature review in line with current guidelines. Recent Findings: The authors identified 22 studies. Patients with CKD had left ventricular global and regional dysfunction and adverse remodeling. Stress testing with CMR revealed a reduced stress-response in CKD patients. Native T1 relaxation times (as a surrogate markers of fibrosis) are elevated in CKD patients, proportional to disease duration. Patients with CKD have reduced strain magnitudes and reduced aortic distensibility. Summary: CMR has diagnostic utility to identify and characterize cardiac involvement in this patient group. A number of papers have described novel findings over the last 3 years, suggesting that CMR has potential to become more widely used in studies in this patient group

    Limitation Periods for Federal Causes of Action After the Judicial Improvements Act of 1990

    Congress often enacts statutes that create specific causes of action for aggrieved individuals. Many federal statutes, however, create duties with no corresponding action for breach, leaving courts to create causes of action for individuals owed those duties.\u27 When the courts, rather than Congress, create a cause of action, no specific statute of limitations governs the suit. Surprisingly, many statutory causes of action also lack limitation periods. Courts frequently face actions not governed by any statute of limitations because traditionally there has been no general statute of limitations governing all federal actions. Courts usually are not content to find that a party may bring suit at any time after the cause of action accrues. Throughout history,courts have found time limitations necessary to protect possible defendants, the judicial system, and society in general. Because many federally derived causes of action do not have statutory limitation periods,courts must look elsewhere for appropriate time restrictions. In 1990 Congress sought to relieve the courts of the arduous task of borrowing limitation periods. The Judicial Improvements Act of 1990 (the Act) contains a general statute of limitations governing actions arising under federal statutes that contain no specific limitation periods. Part II of this Note discusses the Act in more detail. Part III evaluates options courts have when confronting a federal cause of action with no limitation period, including borrowing from state law, borrowing from federal law, applying no limitation period, limiting the action with laches, or simply creating an appropriate period. Part IV examines steps Congress could take to ensure that every action arising under a federal statute has an appropriate limitation period and examines constitutional concerns regarding congressional delegation of the power to fix statutes of limitations. Finally, this Note concludes that the general fallback statute of limitations in the Act is insufficient as a remedy for the uncertainty caused by Congress\u27s failure to provide limitation periods in statutes that create causes of action. Because courts are unable to provide uniform solutions to this problem, Congress must enact additional legislation

    Over a Decade of recA and tly Gene Sequence Typing of the Skin Bacterium Propionibacterium acnes: What Have We Learnt?

    The Gram-positive, anaerobic bacterium Propionibacterium acnes forms part of the normal microbiota on human skin and mucosal surfaces. While normally associated with skin health, P. acnes is also an opportunistic pathogen linked with a range of human infections and clinical conditions. Over the last decade, our knowledge of the intraspecies phylogenetics and taxonomy of this bacterium has increased tremendously due to the introduction of DNA typing schemes based on single and multiple gene loci, as well as whole genomes. Furthermore, this work has led to the identification of specific lineages associated with skin health and human disease. In this review we will look back at the introduction of DNA sequence typing of P. acnes based on recA and tly loci, and then describe how these methods provided a basic understanding of the population genetic structure of the bacterium, and even helped characterize the grapevine-associated lineage of P. acnes, known as P. acnes type Zappe, which appears to have undergone a host switch from humans-to-plants. Particular limitations of recA and tly sequence typing will also be presented, as well as a detailed discussion of more recent, higher resolution, DNA-based methods to type P. acnes and investigate its evolutionary history in greater detail

    Multiplex Touchdown PCR for Rapid Typing of the Opportunistic Pathogen Propionibacterium acnes

    The opportunistic human pathogen Propionibacterium acnes is composed of a number of distinct phylogroups, designated types IA(1), IA(2), IB, IC, II, and III, which vary in their production of putative virulence factors, their inflammatory potential, and their biochemical, aggregative, and morphological characteristics. Although multilocus sequence typing (MLST) currently represents the gold standard for unambiguous phylogroup classification and individual strain identification, it is a labor-intensive and time-consuming technique. As a consequence, we developed a multiplex touchdown PCR assay that in a single reaction can confirm the species identity and phylogeny of an isolate based on its pattern of reaction with six primer sets that target the 16S rRNA gene (all isolates), ATPase (types IA(1), IA(2), and IC), sodA (types IA(2) and IB), atpD (type II), and recA (type III) housekeeping genes, as well as a Fic family toxin gene (type IC). When applied to 312 P. acnes isolates previously characterized by MLST and representing types IA(1) (n = 145), IA(2) (n = 20), IB (n = 65), IC (n = 7), II (n = 45), and III (n = 30), the multiplex displayed 100% sensitivity and 100% specificity for detecting isolates within each targeted phylogroup. No cross-reactivity with isolates from other bacterial species was observed. This multiplex assay will provide researchers with a rapid, high-throughput, and technically undemanding typing method for epidemiological and phylogenetic investigations. It will facilitate studies investigating the association of lineages with various infections and clinical conditions, and it will serve as a prescreening tool to maximize the number of genetically diverse isolates selected for downstream higher-resolution sequence-based analyses

    An expanded multilocus sequence typing scheme for propionibacterium acnes : investigation of 'pathogenic', 'commensal' and antibiotic resistant strains

    The Gram-positive bacterium Propionibacterium acnes is a member of the normal human skin microbiota and is associated with various infections and clinical conditions. There is tentative evidence to suggest that certain lineages may be associated with disease and others with health. We recently described a multilocus sequence typing scheme (MLST) for P. acnes based on seven housekeeping genes (http://pubmlst.org/pacnes). We now describe an expanded eight gene version based on six housekeeping genes and two ‘putative virulence’ genes (eMLST) that provides improved high resolution typing (91eSTs from 285 isolates), and generates phylogenies congruent with those based on whole genome analysis. When compared with the nine gene MLST scheme developed at the University of Bath, UK, and utilised by researchers at Aarhus University, Denmark, the eMLST method offers greater resolution. Using the scheme, we examined 208 isolates from disparate clinical sources, and 77 isolates from healthy skin. Acne was predominately associated with type IA1 clonal complexes CC1, CC3 and CC4; with eST1 and eST3 lineages being highly represented. In contrast, type IA2 strains were recovered at a rate similar to type IB and II organisms. Ophthalmic infections were predominately associated with type IA1 and IA2 strains, while type IB and II were more frequently recovered from soft tissue and retrieved medical devices. Strains with rRNA mutations conferring resistance to antibiotics used in acne treatment were dominated by eST3, with some evidence for intercontinental spread. In contrast, despite its high association with acne, only a small number of resistant CC1 eSTs were identified. A number of eSTs were only recovered from healthy skin, particularly eSTs representing CC72 (type II) and CC77 (type III). Collectively our data lends support to the view that pathogenic versus truly commensal lineages of P. acnes may exist. This is likely to have important therapeutic and diagnostic implications
